Current Project Development Objectives The objective of the project is to develop capacity of Azerbaijan's judicial system to achieve incremental improvements in efficiency, citizen information and i ts ability to handle future demand. Page 1 of 6 3. Project Description IDA Credit 4209-AZ (SDR14.8 million) to finance the JMP was approved on June 29, 2006. In 2011, the original closing date of December 31, 2011 was extended to June 30, 2013. An AF - comprising Public Disclosure Copy IDA Credit 4961-AZ (SDR5.8 million) and IBRD Loan 8068-AZ ($24.2 million) - was approved on June 7, 2011. The closing date for the AF is December 31, 2014. The AF was declared effective as of March 8, 2012. The total IDA and IBRD financing is $55 million. Despite the AF and the proposed restructuring, the project structure and focus remain fundamentally the same. It consists of four components: (1) strengthening the management capacity of judicial institutions, (2) upgrading of court facilities and technologies, (3) improving quality of operations of judges, staff and other legal professionals, and (4) improving citizen information and access to justice. The objective of the Project will not be changed and the focus of the components of the parent project will substantially remain the same. Under Component 1, ICT and other technical equipment is being provided to the Judicial-Legal Council and to the courts constructed under the Project. Judges and staff will receive training in ICT. Office equipment and furniture will be purchased for selected courts. Component 2 finances the construction of a set of modern courthouses (e.g. Oguz District Court, Gedabek District Court, Baku City Yasamal District Court, Gandja City Nizami District Court and Guba District Court) and court complexes (e.g. Sabunchu and Sheki Court Complexes, each housing multiple courts). Component 3 finances, among other things, a case-file analysis, a bar association professionalization assessment, capacity-building measures and the development of courses for the Justice Academy. Component 4 includes activities focusing on access to justice, such as free legal aid to the vulnerable, an analysis of the market for legal services, the development and implementation of an e-notary system, an empirical analysis of court dispute resolution and alternative dispute resolution Public Disclosure Copy mechanisms, an enforcement analysis, and the establishment of legal and judicial information centers. 4. Summary of Key Safeguard Issues 1. Describe any safeguard issues and impacts associated with the Restructured project. Identify and describe any potential large scale, significant and/or irreversible impacts: The activities being implemented under the AF are similar to those financed by the original credit, and include construction, rehabilitation and/or renovation of courthouses and court complexes. The locations of the sites for construction, rehabilitation and/or renovation were chosen due to availability of sufficient land and communal infrastructure; the nature of adjacent facilities; accessibility, etc. Civil works have been completed at three sites (Oguz, Yasamal and Gandja) and are almost complete at one more (Gedabek – original works have been completed and additional works are ongoing). The project is financing construction of courthouses/court Public Disclosure Copy complexes at Sheki, Sabunchu and Guba. Environmental Assessment (OP 4.01) was triggered at project approval. The environmental impacts associated with the implementation of the proposed activities are already addressed in the updated Environmental Management Plan (EMP). Since no environmental concerns other than those already dealt with are expected, the environmental category of the project remains the same, and no changes to the envisaged environmental procedures are required. The Involuntary Resettlement Policy (OP 4.12) has been triggered. In the course of implementation one case of land acquisition occurred, which was addressed through the preparation of an abbreviated Resettlement Action Plan (RAP). While no further land acquisition or physical displacement of persons is expected, this experience from ongoing activities shows that the need for minor land acquisition could arise to improve construction design, and/or provide adequate space for access and security. In addition, land acquisition could be required due to unforeseen events, in which case the civil works envisaged may require more land. A Resettlement Policy Framework (RPF) has been prepared by the MOJ, approved by the Bank and disclosed on July 19, 2012 in the Infoshop. Site-specific RAPs will be developed - if and as necessary – during implementation. The RPF and RAPs will ensure proper calculation and recording of the land area to be acquired and identify and mitigate the impacts of land acquisition on the affected persons to ensure that there is no adverse effect on living conditions and livelihoods. Page 3 of 6 The Physical Cultural Resources Policy (OP 4.11) is being triggered, as civil works are ongoing or envisioned for historical urban areas which may be subject to potential chance finds. The EMP Public Disclosure Copy has been amended to incorporate the procedures to be followed by the contractor and client in case of chance finds at project sites. 2. Describe any potential indirect and/or long term impacts due to anticipated future activities in the project area: The potential long-term impacts of the project activities are expected to be positive as the areas surrounding newly constructed or renovated buildings will be generally improved and better maintained. Also, the buildings will be operated in a more environmentally sustainable manner than the old ones (e.g. advanced heating systems with emission filtering features, improved drainage, paper material recycling practices, etc.). The project is expected to have positive long- term social impacts from a more efficient judicial system, including improved service and access information for users. 3. Describe any project alternatives (if relevant) considered to help avoid or minimize adverse impacts. The project sites are chosen based on the need for judicial services. Detailed assessments are available for all project sites. These did not identify any serious or irreversible potential impacts, which would have caused consideration of alternative locations. 4. Describe measures taken by the borrower to address safeguard policy issues. Provide an assessment of borrower capacity to plan and implement the measures described. An EMP was developed for the original project and updated at AF and restructuring respectively. The Borrower has demonstrated its capacity to deal successfully with environmental aspects of project implementation. The PIU has designated consultants responsible for regular environmental monitoring and coordination of environmental matters with designers, technical experts and contractors. Public Disclosure Copy An RPF has been prepared by the MOJ, approved by the World Bank, and disclosed on June 28, 2012 on the official MOJ web-site and on July 19, 2012 in the Infoshop. Site-specific RAPs will be developed - if and as necessary - in the course of project implementation. Discussions with judges, support staff and bailiffs have been held in Baku and other regional locations during project preparation and implementation. The project has also benefited from consultations with community associations and NGOs. Consultations will continue throughout the life of the project to review activities and enhance impacts. The updated EMP has been duly disclosed in the country and published in the Infoshop on July 17, 2012. B.
