PROJECT STATUS AND RATIONALE FOR RESTRUCTURING This document seeks approval for a proposed restructuring of the Support to Land and Mining Management Strengthening Project (P169267). The restructuring will enable Burkina Faso to adapt the project to the current country political and security contexts which have materially changed compared to prevailing conditions during project preparation. It responds to a letter from the Government dated April 29, 2024, and will enable Burkina to learn from implementation lessons thus far to focus on impacts and results feasible currently, lay the technical, legal, regulatory, technological, and capacity foundations for expanded mining and land activities in the future. The restructuring will account for the reduced geographical scope of land activities because of insecurity, cancel funds unlikely to be used by project closing to reallocate them to Government’s current priorities while still supporting improved drivers of resilience in the two sectors. The original closing date for the project is maintained. A. Project Status The project which became effective on November 11, 2021, had a budget of USD 150 million equivalent funded through fifty percent grant and fifty percent credit from the IDA allocation. The exchange rate fluctuation meant that the original budget was reduced to USD 134.6 million on the day (April 30, 2024) the letter requesting the restructuring was received by the World Bank. The project is under the institutional leadership of the Ministry of Economy, Finance and Prospective (MEF) and jointly implemented with the Ministry of Energy, Mines and Quarries (MEMQ) through two fully staffed implementation units (PIU) including one for land and one for mining. Implementation progress (IP) and project ratings. The Project Development Objective (PDO) is to improve national land and mining administration services, register land rights in selected municipalities and foster inclusive benefits from the mining sector. The project has the following five components: (i) Strengthening of the Legal Framework and Institutional Development, (ii) Strengthening of Land and Mining Information Management and Improving Land Tenure Security, (iii) Fostering Socio-Economic Inclusion and Community Development, (iv) Project Management, Monitoring and Evaluation and Knowledge Dissemination, and (v) Contingent Emergency Response Component (CERC). Progress towards achievement of the PDO is rated moderately satisfactory while IP is rated Moderately Unsatisfactory. The two coup d’états of January and September 2022 adversely impacted implementation, but the project has nevertheless made achievements including the support to the issuance of about 3,700 land titles, 7,900 land certificates, and 4,900 artisanal mining cards; the exclusion of 53,679 sq km of classified forests from the mining licensing system; the initiation of geoscientific mappings on the field; and the technical, financial and environmental monitoring and control of all mining operations last year. Procurement and financial management are rated 'Moderately Satisfactory' due to procurements constraints linked with the country context creating challenges for the mobilization of international consultants, the use of dual country and World Bank procurement systems with delays in country system approvals negatively impacting disbursement, and inefficiencies in the processes originating from agencies and departments. The project has USD57.6 million under procurement, USD25.6 million under contracts and has over the past six months benefited from the procurement facilities of the “Programme d’Urgence pour le Sahel” which is expected to impact implementation forward positively. The disbursement rate is at 15% with about USD 21.11 disbursed and USD 116 million undisbursed. The World Bank Task Team also confirms that at the time of this proposed restructuring there is no overdue audit and neither the loan, nor the country, is subject to an ongoing suspension of disbursements. Page 1 The World Bank Support to Land and Mining Management Strengthening Project (P169267) The project is supporting resilience in Burkina Faso through securing land tenure and enabling efficient and transparent land markets, which are key conditions to support good governance, promote a sustainable rural development (including agriculture and forest protection), and improve urban development and planning for more resilient and productive cities. The main land administration entities (Guichet Unique du Foncier, salles d’archivage, Service régionaux du foncier, réseaux géodésiques national, etc.) will benefit from new climate change informed operational buildings. In addition, all management programs, registration systems, various land titles and acts will have a secure back up in various locations. The improved presence of a decentralized administration for artisanal and small-scale mining (ASM) with 6 provincial heads nominated and 4 already active on site, support to the deployment of the funds earmarked for mining communities, local content, gender and alternative livelihoods programs contribute to resilience and inclusivity of benefits from mining. The ongoing mobilization of an NGO for GBV will enable the deployment of activities to address GBV and removal of children from selected ASM sites. Work is advanced for the establishment of 10 inclusive artisanal management conventions, the updating of local -economic development plans and the strengthening of the capacities of the o SMEs/SMIs for their supply of more goods and services to mining operations. Insecurity has materially impacted project implementation through the dual lenses of the narrowing of areas amenable to planned land activities, and challenges with the mobilization of international consultants to support mining activities. To mitigate some of the risks the project completed a security assessment and developed a related management plan despite these safeguards not being required for it. Moreover, a security specialist has been hired to support improved security for field related activities. Where feasible, the project resorted to using agencies for field activities with support from local consultant. Such is the case for geoscientific works by the Geological Survey of Burkina (BUMIGEB). B. Rational for Restructuring The proposed restructuring reflects the exchanges between the Government and Bank staff regarding the benefits of adapting the project to the current country political and security conditions which have materially changed since project preparation as well as the current priorities of the Government. The implementation of the Land related activities was affected by the spread of land functions over many departments, the resulting coordination challenges, and the unfamiliarity of these agencies with the implementation requirements for a Bank funded IPF as the project is the first such an investment in the land sector in Burkina. Additionally, many regions planned to be covered by the project are now considered insecure and unsafe. The acquisition of orthophotos and images, including with Light Detection and Ranging (LIDAR) technology to support the development of cadastral maps in 20 municipalities was cancelled by the Government for security related reasons. Six ministers in charge of mines presided over the mining sector from project preparation to date with corresponding key staff and counterparts’ turnover. The January and September 2022 coups also led to institutional changes with new agencies created (Autorité Nationale de Coordination du Foncier (ANCF) for land and Société Nationale des Substances Précieuses -SONASP for mining for example) and legal and regulatory reforms in the mining sector impacting the paradigms underlying project preparation and implementation. The country will benefit from setting the frameworks, the capacities and densifying interventions where security allows it currently, to enable it to expand interventions in both land and mining when the country context becomes more conducive. Summary of proposed changes This restructuring paper seeks the approval of the Country Director to undertake the following changes: (i) reduce the geographical scope of the land activities to take into account the country security context, ii) adjust project financing (from USD 150 million to USD 100 million after the restructuring) to drive results, impacts and resilience within the period available to project closure, iii) cancel the difference (USD 34.6 million reflecting the loss of USD 15.4 million from exchange rate fluctuations since project preparation) to allocate them to other Government priorities, and iv) slightly adjust the intermediary results framework. B. Reduce the geographical scope of the land activities. The geographical scope of the land component at project preparation was 71 municipalities. The prevailing security context in the country renders the deployment of the activities feasible in 51 municipalities and principally around large cities. The geoscientific investigations have also been narrowed to more secure areas of the country. The original ambition of supporting 20 municipalities to develop their cadastral plans and to carry out Systematic and On-demand Land Registration has now been reduced to 12 after the cancellation by the Government of the acquisition of orthophotos and images. C-Adjustment to components costs Costs and activities adjustments within the existing components and subcomponents are proposed to fit the project with the current context, account for the time lost and streamline implementation towards results and impacts. For land, mostly this means working to set the stage for an expanded land program by (i) informing legal and institutional reforms for setting an efficient and practical legal and institutional frame, simplifying land procedures; (ii) striving to support the creation of a single land reform agency ; (iii) ensuring technological underpinning with the development of land information system, (iv) setting methodological approach to ensure rapid and systematic registration of land transactions and titles, and (v) developing the human resources to be performant and to drive changes and use new technologies. Proposed changes by components includes: • Component 1 - Strengthening of the Legal Framework and Institutional Development is supporting adequate capacity strengthening for land and mining management, control and monitoring as well as the policy, legal and regulatory dimensions which were adjusted as follows: • Land: The number of working committees and workshops for the development and validation of deliverables relating to the legislative and regulatory texts have been reduced, and the cost of the main activities were updated with actual amounts which are significantly below the anticipated budget. The operational and maintenance costs for the geodetic network ground points will be directly supported by the Government and were consequently dropped form the project. • Mining: Significant regulatory activities under this subcomponent were completed including advisory services for assessments of government held mining assets, the development of a draft policy on how Government may dispose of mining assets it holds, etc. Downward costs adjustments were made to reflect the fact that the Government is not taping into the project for support for legal reforms, and a focus on activities directly impacting results and goals within the remaining project life. The provisioned cash Page 3 The World Bank Support to Land and Mining Management Strengthening Project (P169267) transfers to incentivize taking children away from artisanal mining will be cancelled to align the project with the decision of the Government to cancel all cash transfers in the country. • Component 2 - Strengthening of Land and Mining Information Management and Improving Land Tenure Security is supporting the production of cadastral base maps, the development of a new Land Information System (LIS), the continued modernization of the mining cadastre, the collection of geo-data, and the provision of capacity building to support land registration and the systematic registration of land rights. It also supports the delineation of classified forests and their exclusion from mining licensing. Below are proposed changes. • Land: new building constructions were added to enable the management of land administration from climate resilient, safe, operational and practical buildings. All construction cost estimates were updated to reflect higher prices currently practiced in the country. Given the fact that the acquisition of orthophotos and images to support the development of cadastral maps in 20 municipalities was canceled by the government, the project will rely on existing satellite images from the Institut Géographique du Burkina to carry the envisioned activities in 12 municipalities which can still be covered by the Systematic and On- demand Land Registration operation. The intervention of technical structures in the Système d’Information Foncière (SIF) design and implementation was rationalized and better organized, with resulting savings for the project. • Mining. Costs reduction were derived from the cancellation of the (i) prospecting of ASM sites through geophysical, geochemical and geological surveys, and subsurface samplings to reflect the current government priorities and approaches with the replacement of the ASM agency (ANEEMAS) by a new agency (SONAPS) which puts further emphasis on ASM equipment and gold purchasing; (ii) resources earmarked to promote the removal of children from ASM sites into schools using the social safety net financing approach which has been barred in Burkina by the Government; (iii) construction of a building anticipated for the mining cadaster to reflect insufficient Government support thus far for the establishment of sustainability underpinnings for a modernized cadaster. The current Government priority of increased ASM supervision/governance is reflected though support to the hiring of 25 people for the decentralized mining offices, the establishment of inclusive conventions for ASM management and equipment of already identified selected priority ASM sites. • For both land and mining the budget have been increased to reflect the actual costs for bursaries for 100 females undertaking graduate and post graduate education on land and mining. • Component 3 - Fostering Socio-Economic Inclusion and Community Development is supporting stakeholder participation in land policy dialogue and land rights registration, transparency in the management of mining resources, the provision of local content for mining operations, improved mining communities’ development and non-mining income generation approaches, and land use planning instruments and strategies to promote sustainable territorial management and improve soil conservation. • Land: Activities were reduced to reflect a smaller number of municipalities covered by massive real estate evaluation, the correction of some redundancies in the initial planning between systematic and on-demand land registrations. Page 4 The World Bank Support to Land and Mining Management Strengthening Project (P169267) • Mining: The activities were reduced to principally reflect what may be achievable within the time frame available to closure on local content and community development. • Component 4 - Project Management, Monitoring and Evaluation and Knowledge Dissemination, is supporting the two PIUs in fulfilling their responsibilities in the administrative, technical, fiduciary, and monitoring and evaluation (M&E) functions. Changes forward will include the gradual consolidation of the teams through the non- replacement of departing PIU staff for functions which moderate workloads. These are derived from an assessment of the current context and priorities with each originally anticipated activities reviewed based on whether they are: (i) feasible in the current country context and reflective of government priorities; ii) impacting results and beneficiaries, iii) laying the legal, regulatory, institutional, technical, technological and capabilities to densify land and mining interventions under improved country contexts, iv) lessons learnt during project implementation, and (v) time available to project closure in December 2027. Where activities are still relevant a further assessment is made on its maintenance, budget increase or decrease, or cancellation. It is worth noting that exchange rate fluctuations resulted in a loss of USD 15.4 million (about 10.4%) from the original budget of USD 150 million for the project as approved by the World Bank Board. Thus, the total reduction in the initial budget is US$50 million (US$ 50 million = US$34.6 million to be cancelled + US$15.4 million exchange rate losses). Page 6 The World Bank Support to Land and Mining Management Strengthening Project (P169267) E- Change in Results Framework Adjustments to the intermediary indicators are proposed to reflect project implementation and status to actual performance. These include the : (i) increase of the number of ASM cards from 4,000 (already achieved) to 10,000; (ii) The access to the information on the land information system (LIS) from 100% to 80% to reflect the reduction of the project scope; (iii) the reduction of the number of land use and economic development plans supported including through the MFLD from 30 to 20 to reflect the reduced geographical coverage of the project. Two new indicators were added to measure the number of buildings (28) financed by the Project, and the percentage o women (40%) participating to the consultation processes for systematic land registration . The rating which was satisfactory since project effectiveness for all the 7 triggered standards. The rating was downgraded to moderately satisfactory to reflect the delayed: (i) recruitment underway of the GBV specialized NGO and (ii) updating the Strategic Environmental and Social Assessment (SESA) which was principally caused by the pending halt by the Commerce Tribunal of Burkina Faso of the procurement for the consultant. The SESA is now being implemented under the leadership of the ministry of environment and with support from the technical assistant hired to support the implementation of the project’s environmental activities. The Codes of Conduct have been signed by all the PIUs’ staff including interns. The GRM both for key stakeholders and workers are in place and functional with 7 complaints recorded and 5 resolved. No incidents or accidents have been recorded. A long delay is noted in the processing of the project's environmental and social safeguard documents by the National Agency of Environmental Assessment (ANEVE), and recommendations were made by Bank staff to address this constraint.
