NIGERIA: NATINAL SOCIAL SAFETY NET PROJECT SCALE-UP PROJECT PROCUREMENT STARATEGY FOR DEVELOPMENT COUNTRY: NIGRIA PROJECT: NATIONAL SOCIAL SAFETY NET SCALE-UP PROJECT ID NO.: P176935 1.0 Introduction 1.1 Background: The proposed project, which is a follow-on operation to NASSP, builds on and scale up the existing delivery system to provide shock responsive safety nets and extend regular social assistance to the poor and vulnerable. The project will provide time-limited cash transfers in response to recent rising food prices and inflation. Apart from the COVID-CT program supported by NASSP, the cash transfers will be the first large-scale shock-responsive safety net support program in Nigeria. The project will also extend the duration of support to the current beneficiaries of NASSP regular cash transfer program. Together, the project will move Nigeria towards a shock responsive safety net programming and towards building a resilient society. 1.2 The proposed operation is consistent with and aligns to the Bank’s Country Partnership Framework (FY21-FY25) The project contributes to Core Objective Five of the CPF which seeks to increase the coverage and effectiveness of social assistance programs and promote the priorities for longer-term policy and institutional reforms and program effectiveness. 2.0 Project Overview: Summary of key Project Information and Developmental Objectives Country: Nigeria Full project Name: Nigeria: National Social Safety Net Scale Up Project Project Number 176935 Total Finance (US$): US$800 million Summary of Project Expand coverage of shock responsive safety Development Objectives: net support among the poor and vulnerable and strengthen the national safety net delivery system. 2.1 Project Description: Total investment for Nigeria National Social Safety Net Scale Up is US$800 million. NCTO and NASSCO will serve as the Project Implementation Units as in the parent project. 3.0 Strategic Assessment of Operating Context and Borrower Capability 3.1 Operational Context 3.1.1 Governance aspects: The government has recorded successes in its anti- corruption efforts. A Bank Verification Number (BVN) scheme has been introduced, which allows commercial bank account numbers to be linked to individuals and corporate bodies. Through the scheme, several fat accounts of public officials are being scrutinized by anti-corruption agencies to determine the sources of their acquisition. Over 143 million Nigerians are linked to the National Identification Number which ties together all records about citizens – demographic data, fingerprints, head-to-shoulder facial picture, other biometric data, and digital signature – in the National Identity Database making it relatively easy to confirm and verify individual identity when they engage in travels and carry out financial or other transactions. The government has implemented the TSA in its efforts to improve cash management by increasing cash availability through consolidation of funds hoarded by MDAs in multiple commercial bank accounts. By design, the TSA is one of the most comprehensive institutional arrangements in the Africa Region, covering major federal receipts on oil and minerals, taxes, customs, donor funds, internally generated revenues (IGRs), and levies. The government is implementing the integrated payroll and personnel information system (IPPIS) to remove the discrepancies between payroll and nominal rolls. A host of federal laws aimed at preventing fraud and corruption in the use of public resources, include the Economic and Financial Crimes Commission Establishment Act, 2004, the Corrupt Practices and Other Related Offences Act, 2000 and the Code of Conduct and Tribunal Act, 1991. Some legislations that address conflict of interest and promote transparency are the Asset Disclosure Act and Freedom of Information Act, 2011. Nigeria has adopted the UN Convention Against Corruption (UNCAC), which strengthens critical dimensions such as data collection, elimination of criminal immunities, protection of witnesses, and the independence of anti-corruption agencies 2 from the executive. The government recently introduced a whistleblower policy under which whistleblowers are rewarded by a percentage of retrieved funds. During the first year of its operation, over 8,000 whistles were received by the Presidential Advisory Committee Against Corruption, with some leading to the recovery of large sums of money. Despite these successes, corruption remains a significant obstacle to business in Nigeria: companies are very likely to encounter bribery and other corrupt practices. Corruption risks are pervasive throughout all institutions, but it is particularly pervasive in public procurement and the oil sector. Corruption is criminalized both at the federal and subnational levels primarily by the Criminal Code and the Corrupt Practices and Other Related Offences Act. Accepting or giving gifts as well as facilitation payments are illegal, and individuals can be penalized with up to seven years' imprisonment. Despite a strong legal framework, enforcement of anti-corruption legislation in Nigeria remains weak: in practice, gifts, bribery, and facilitation payments are the norm. The Perception Survey conducted in 2008 and the Procurement Value Chain undertaken in 2013 found evidence, among others, of fraudulent practices and kickbacks occasioned by greed perpetrated by some major players in the procurement process. 3.1.2 Economic aspects: During the last few years, Nigeria adopted relatively tight monetary policies which resulted in a drop of annual inflation from a high of 16.5 percent in 2017 to 11.4 percent in 2019. Since the COVID-19 shock coupled with limited supply of foreign exchange and other trade restrictions, inflation rose to 16.63% in September 2021 and is expected to remain elevated, with the additional impact of electricity-subsidy reforms. GDP grew from 1.92% in 2018 to 2.21% in 2019 but experienced a contraction of 1.79% in 2020 principally because of COVID-19 Pandemic. Fig. 1 shows the inflationary trend in Nigeria during the last 12 months. Fig 1: Nigeria’s Inflation – October 2020 to September 2021 3.1.3 Sustainability aspects: There are no significant sustainability and environmental aspects that will have impact on procurement, over and above compliance with Nigerian and international standards. The Scale-Up will be financing procurement of non-complex consultancy services and standard low value off-the- shelf goods and minor works, which will not require sustainable procurement. 3 3.1.4 Technological aspects: Nigeria has 80% fibre optics coverage, with good internet service and over 85% of the population own GSM telephone. Therefore, technological difficulties are not envisaged during the implementation of the project. Most activities to be financed are low value standard goods, non-consultancy services and consultancy services with the exception of the engagement of Payment Service Providers. Procurement opportunities are regularly widely made available to the bidding public through the Federal Tender Journal and national dailies. However, there is currently low availability of electricity throughout Nigeria. Therefore, most service providers rely on generators, solar power, and other alternative sources of energy to facilitate the use of ICT platforms, which may constrain access to procurement information on timely basis. As a mitigation, procurements of NCB value and above will continue to be published in at least one national daily and in the Federal Tender Journal and also placed in the project’s website. 3.1.5 Key Conclusions: Recent economic indices show that the Nigerian economy is currently experiencing swings, with prices of goods and services expected to remain high from short to medium term. There are no serious governance issues that can pose a threat to the use of the Project resources and there are no technological and sustainability issues that will negatively impact the implementation of the Project procurement activities. 3.2 Client’s Capability and Project Implementation Unit (PIU) Assessment 3.2.1 Procurement capacity is at acceptable level in NASSCO and NCTO. The Fiduciary In-depth Review which was concluded in 2020 identified capacity gaps which are being addressed. The Scale-Up operation will impose additional workload on the procurement unit in NCTO and NASSCO, respectively. As a result, additional procurement staff each will need to be seconded from the Bureau of Public Procurement to strengthen the current numerical strength in the agencies. 3.2.1 Previous experience: The 2020 Fiduciary In-depth Review identified some weaknesses in the procurement system in NCTO and NASSCO, respectively. The identified issues are being addressed through an action plan, which will be monitored regularly during the implementation of the parent project and Scale-Up operation. 3.2.2.Need for Hands-on Support: The Bank will provide hands-on support during implementation support missions and procurement post review exercises, especially in applying the provisions of the Procurement Framework. 3.2.3 Contract management capability and capacity: Contract management capacity will require strengthening as weaknesses were observed during the parent project. Under the proposed project, user departments and personnel with technical competence in the area of the procurement will play key roles in the acceptance of goods and services. 3.2.4 NASSCO and NCTO have implemented NSSNP since inception and are well acquainted with World Bank procurement procedures. Generally, both Project Implementing Units have the required technical skills to implement the proposed 4 project. Any capacity gaps will be closed through secondment of relevant technical staff or engagement of external resources. 3.3.5 Complaints management and dispute resolution systems: Clause 9.2 of the Public Procurement Act provides for Administrative Review in the procurement process. A bidder who is not satisfied with a procurement process can submit a petition at any stage to the procuring entity and the procuring entity must provide a response within 15 working days of receipt of the petition. The bidder can appeal to the BPP within 10 days of the response from the procuring entity and the decision of the BPP must be conveyed to the bidder within 21 days. Where the bidder is not satisfied with the decision of BPP, the Federal High Court can be approached for adjudication. However, the Bank’s complaints mechanism will be followed under the project. 3.2.6 Summary of findings: Procurement capacity in the implementing agencies is at acceptable level. However, the Bureau of Public Procurement will be approached to assign one highly skilled Procurement Officer each to NASSCO and NCTO to strengthen their procurement numerical strength. In addition, a Procurement Consultant will be engaged to support overall procurement implementation under the parent project and Scale-Up Operation. 3.3 Market Research and Analysis: A few consultancy services fall within QCBS threshold even though it is unlikely international firms will be interested in conducting data validation in highly dispersed remote areas. There is adequate local capacity for the proposed goods, and the remaining consulting services. The last bidding round witnessed new entrants, including commercial banks. The recent policy shift by the Central Bank of Nigeria to license the two biggest telecommunications companies, MTN and Airtel, as Payment Service Banks will improve competition in the bidding for payment service providers. The Payment Service Banks will enhance financial inclusion and the development of the payment system through a secured technology-driven environment. The Payment Service Banks are to operate mostly in the rural areas and unbanked locations, targeting financially excluded persons, with not less than 25 per cent financial service touch points in such rural areas. The Payment Service Banks will increase access to deposit products and payment/remittance services to small businesses, low-income households, and other financially excluded entities through high-volume low-value transactions in a secured technology-driven environment. With about 85% GSM coverage, the Payment Service Banks will be able to reach some of the remotest areas of the country with their products. 3.3.3 Financial: Although inflation has been reducing steadily over the last few months, it is still high at 16.69% (September 2021). Iinterest rates remain very high at about 26%. These may negatively impact the cost of goods and services and may constrain the bidding public’s ability to access the financial market. 3.3.4 Procurement trends: The foreign exchange rate volatility of the recent past and associated inflation has led to price volatility. Among other important trends impacting procurement is the widespread use of the internet. The internet has brought about significant changes by lowering costs through reducing intermediaries and increasing level playing field for both large as well as small service providers. With the virtual world now emerging as the new workplace, it has become relatively easier to get in contact with suppliers both within and outside Nigeria. The use of email has increased the speed of communication between purchasers and service providers. The proposed project will leverage emerging technology to obtain value for money in the use of the project’s resources. Some emerging challenges in the procurement environment in Nigeria are insufficient skilled procurement professionals, lack of 6 strategic treatment of procurement, corruption in public procurement, inadequate accountability and control mechanisms, changes in the institutional environment and lack of commitment to full-scale reforms. These weaknesses are being addressed through the delivery of five academic tracks in procurement and introduction of procurement certification scheme with support from World Bank-funded Sustainable Procurement, Environmental and Social Standards Enhancement Project. 3.3.5 Key conclusions: The market analysis reveals that while there is local capacity for consultancy assignments and goods and works. NCTO and NASSCO have experiences in the procurement areas. However, the indepth review conducted on the project between 2019 and 2020 revealed several weaknesses which have been mitigated in the Procurement Action Plan in the PPSD. The market analysis revealed evolving capacity especially for payment service. Recent bidding processes for payment service providers witnessed new entrants, including some commercial banks. The approval recently granted by the Central Bank of Nigeria for the two largest telecommunications companies, MTN and Airtel, to operate as Payment Service Banks will greatly enhance competition in the procurement of payment service providers under the Scale-Up operation. The market will continue to be engaged for better understanding of the trends and expectations, especially during the development of the technical specifications. A number of procurement and stakeholder risks were identified and mitigated in the PPSD. These include: (i) Political interference in contract award, which can be mitigated by carrying out advocacy on the procurement procedures agreed in the Financing Agreement. (ii) Currency fluctuation, which has been mitigated by allowing international and local bidders to submit pricing for imported goods in three convertible currencies. (iii) Use of old register of service providers and selection of service providers therefrom in a non-methodical manner to be addressed through revision of the register of service providers in a transparent manner and selection of service providers from the revised register in a methodical manner with appropriate audit trail. (iv) Lack of due diligence on the qualification and post-qualification information furnished by bidders which shall be mitigated by conducting appropriate due diligence on all qualification and post-qualification information submitted by the bidding public to eliminate collusive behavior. (v) Use of discretionary decisions in the award of contracts shall be mitigated by ensuring that contract awards are based only on the predisclosed evaluation criteria in the issued bidding document. (vi) Use of extraneous approval authority in procurement decisions shall be addressed by ensuring that only the roles defined in the project implementation manual make contract award decisions.
