Procurement will be carried out in accordance with the World Bank’s Procurement Regulations for IPF Borrowers dated September 2023 (Procurement Regulations); the Guidelines on Preventing and Combating Fraud and Corruption in Projects Financed by IBRD Loans and IDA Credits and Grants, revised July 1, 2016; and the provisions stipulated in the Financing Agreement In accordance with paragraph 5.9 of the "World Bank Procurement Regulations for IPF Borrowers" (September 2023) ("Procurement Regulations") the Bank's Systematic Tracking and Exchanges in Procurement (STEP) system will be usedto prepare, clear and update Procurement Plans and conduct all procurement transactions for the Project. This textual part along with the Procurement Plan tables in STEP constitute the Procurement Plan for the Project. The following conditions apply to all procurement activities in the Procurement Plan. The other elements of the Procurement Plan as required under paragraph 4.4 of the Procurement Regulations are set forth in STEP. 2) The Bank’s Standard Procurement Documents shall be used for all contracts subject to international competitive procurement and those contracts as specified in the Procurement Plan tables in STEP. From effective September 1, 2023, the World Bank will require the use of Rated Criteria as the default approach for most of the international procurements1 (subject to either prior or post review of the Bank) 3) National Procurement Arrangements: In accordance with paragraph 5.3 of the Procurement Regulations, when approaching the national market (as specified in the Procurement Plan tables in STEP), the country's own procurement procedures may be used. Open National competition for the procurement of goods, works and non- consulting services according to the established thresholds will be conducted in accordance with paragraphs 5.3 – 5.6 of Section V of the Regulations and the following provisions: 1. Only the model bidding documents for National Competitive Procurement (NCP) agreed with the GOI Task Force (and as amended for time to time), shall be used for bidding. 2. Invitations to bid shall be advertised on a widely used website or electronic portal with free open access at least 30 days prior to the deadline for the submission of bids, unless otherwise agreed in the approved procurement plan. 3. No special preference will be accorded to any bidder either for price or for other terms and conditions when competing with foreign bidders, state-owned enterprises, small-scale enterprises or enterprises from any given State. 4. Except with the prior concurrence of the Bank, there shall be no negotiation of price with the bidders, even with the lowest evaluated bidder. 5. Government e-Marketplace (GeM) set-up by Ministry of Commerce, Government of India will be acceptable for procurement under Request for Quotations (RFQ) method. 6. At the Borrower’s request, the Bank may agree to the Borrower’s use, in whole or in part, of its electronic procurement system, provided that the Bank is satisfied with the adequacy of such system. 7. Procurement will be open to eligible firms from any country. This eligibility shall be as defined under Section III of the Procurement Regulations. Accordingly, no bidder or potential bidder shall be declared ineligible for contracts financed by the Bank for reasons other than those provided in Section III of the Procurement Regulations. 1 New international procurements advertised on or after September 1, 2023 using a BankStandard Procurement Document must use Rated Criteria. However, the application of Rated Criteria will not be mandatory for: Pharmaceuticals; Vaccines; Off the shelf goods and educational materials; Commodities; Other exception cleared by the World Bank on a fit-for-purpose basis. 8. The request for bids/request for proposals document shall require that Bidders/Proposers submitting Bids/Proposals include a signed acceptance in the bid, to be incorporated in any resulting contracts, confirming application of, and compliance with, the Bank’s Anti-Corruption Guidelines, including without limitation the Bank’s right to sanction and the Bank’s inspection and audit rights. 9. The Borrower shall use an effective complaints mechanism for handling procurement related complaints in a timely manner. 10. Procurement Documents will include provisions, as agreed with the Bank, intended to adequately mitigate against environmental, social (including sexual exploitation and abuse and gender-based violence), health and safety (“ESHS”) risks and impacts. 4) Hands-on Expanded Implementation Support: Not Required 5) Leased Assets as specified under paragraph 5.10 of the Procurement Regulations: Not Applicable 6) Procurement of Second-hand Goods as specified under paragraph 5.11 of the Procurement Regulations: Not Applicable 7) Domestic preference as specified under paragraph 5.51 of the Procurement Regulations (Goods and Works). The eventual contracts shall be procured in accordance with advance contracting and retroactive financing (Para 5.1 of the Procurement Regulations). c) Fiduciary oversight and Procurement Review by the World Bank: All contracts not subject to prior review by the World Bank will be subject to post- review during the Project's Implementation Support Missions and/or special post- review missions, including missions by consultants hired by the Bank. The World Bank may conduct, at any time, independent procurement reviews of all the contracts financed under the loan. Additionally, if there are internal audits carried out for sample procurements, the Borrower may consult with the World Bank to include the Bank's requirements under the terms of reference for such audits, in which case the Bank will review the internal audit reports. d) Disclosure of procurement information. Contract award details will be published on the official website. The following will disclosed: (1) Procurement Plan and updates, (2) invitation for bids for goods, NCS, and works for all contracts, (3) request for expression of interest for selection or hiring of consulting services, (4) contract awards of procurements through open requestions for proposals or bids with international and national target markets, (5) consolidated list of contracts and purchase orders placed under limited request-for-quote procedures or direct contracting on a semi-annual basis, (6) a semi-annul financial and physical progress report of all contracts, and (7) a report of actions taken on complaints received on a semi-annual basis. e) Complaints Handling. For the procurement-related complaints, the project will follow the procedure prescribed in the Procurement Regulations (Para. 3.26 and 3.31). To deal with the complaints from bidders, contractors, suppliers, consultants, and the general public, a complaint-handling mechanism will be established. A formal grievance redress mechanism (GRM) or procurement complaint handling system was established under SMART Project and online system has been established in project website. Procurement records and documents were maintained in accordance with the guidance for procurement record keeping. The complaint handling mechanism and record-keeping will be further strengthened under the project and will be included in the Project Operations Manual. f) Record keeping. All records pertaining to the award of tenders, including bidnotification; registers pertaining to the sale and receipt of bids, bid-opening minutes, and bid-evaluation reports; all correspondence pertaining to bid evaluation, including communication sent to or with the World Bank in the process; bid securities; and approval of invitation to and evaluation of bids will be retained by respective agencies and uploaded in STEP. INR 1 Lakh = INR 100,000 = INR Hundred Thousand INR 10Lakhs =INR 1 million INR 100 Lakhs = INR 10 million= INR 1 Crore 1 US$ = INR 72.05 9) Prior review by World Bank: In the case of contracts subject to prior review, the Implementing Agencies will seek the World Bank’s no objection before granting/agreeing to: (a) an extension of the stipulated time for performance of a contract that either increases the contract price or has an impact on the planned completion of the project; (b) any substantial modification of the scope of works, goods, non- consulting services, or consulting services and other significant changes to the terms and conditions of the contract; (c) any variation order or amendment (except in cases of extreme urgency) that, singly or combined with all variation orders or amendments previously issued, increases the original contract amount by more than 15 percent; and (d) the proposed termination of the contract. Complaints received in all prior review cases shall be sent to Bank for review and the response to the complaint in such cases, shall be cleared with the Bank. Complaints with allegations of fraud and corruption, shall be shared with Bank, irrespective of the thresholds. All contracts not covered under prior review by the Bank will be subject to post review during implementation support missions and/or special post review missions, including missions by consultants hired by the Bank. The Bank may conduct, at any time, Independent Procurement Reviews of all the contracts financed under the loan. Even for Post Review cases, the inputs of Bank on Technical Specifications/TORs will be obtained by project. Procurement prior-review thresholds. The Bank will prior review contracts above the threshold indicated below: a) Works including Supply & Installation of Plant and Equipment: All contracts more than US$10 million equivalent b) Goods and IT System: All contracts more than US$2 million equivalent c) Non-consulting services: All contracts more than US$2 million equivalent d) Consultants: All contracts (i) more than or equal to US$1 million equivalent for firms; and (i) more than or equal to US$300,000 equivalent for individuals e) In addition to above, and irrespective of the contract value, the following procurement activities are subject to the Bank’s procurement prior review: • procurement processes involving contract negotiations, as described in Section VI, paragraphs 6.34-36, of the Procurement Regulation; • competitive dialogue; • sustainable procurement; • selection of probity assurance providers, as described in Section III, paragraph 3.3 of the Procurement Regulations; and • best and final offer. 10) Procurement Arrangements: The Procurement Arrangements as indicated in the below table and within the thresholds indicated in the below tables will be used. Also, consider the estimated cost, including all taxes, duties payable, and anticipated variations above the cost estimate during the price discovery to decide the threshold. 13) Government e-Marketplace [ (GeM) https://gem.gov.in/ ] is an online end to end procurement portal. All the activities from registration of buyers and sellers to purchase and even payment to the sellers are completely online. The Project may a) up to INR 50,000 in catalogue mode (viz. any available item could be selected by IA without further competition), provided selected Item/Supplier meeting the requisite quality, specification and delivery period. b) up to INR 3 million from the Supplier having the lowest price amongst at least three Suppliers meeting the requisite quality, specification and delivery period. The tools for online bidding and online reverse auction available on GeM may be used by the Purchaser. c) up to INR equivalent of US$ 100,000 from the Supplier having lowest price and meeting the requisite quality, specification and delivery period after mandatorily obtaining bids from at least three Suppliers, using online bidding or reverse auction tool provided on GeM. While making use of GeM portal, Special Terms and Conditions meant for World Bank financed projects shall be used https://assets- bg.gem.gov.in/resources/pdf/stc- world-bank.pdf. In both above cases Borrowers will record their assessment on reasonableness of price. GeM is not to be used for procurement in lieu of RFB - Open National or International Procurement Methods. d) Community Driven Development (CDD): The eligible Community-Based Organisations (CBOs) will undertake procurement at the community level under project. Under the WB Procurement Framework Regulations, the “Community Driven Development” will be followed for all the Procurements which will be carried out by eligible CBOs. Adhering to CDD arrangements, the Request for Quotation (RFQ), Local Competitive Bidding and Direct Selection will be used for Procurement of Goods, Works and Non- Consulting Services. For procurement of Consultants, Consultants’ Qualification-Based Selection (CQS) Method and Selection of Individual Consultant (IC) methods will be used. The detailed guidelines and standard documents for procurement under CDD will be provided to these CBOs to have common procurement documents. As per the community procurement manual (English version to be shared), the CBOs adopted various procurement methods [Direct Selection (DS)/Request for Quotation (RFQ) / Limited Competitive Bid (LCB)] based on the different thresholds (DS: up to INR 20,000; RFQ- simplified: above INR 20,000 up to INR 300,000; and RFQ: INR 300,000 up to INR 10 Lakh; and LCB: above INR 10 Lakh upto INR 72 Lakhs equivalent of USD 100,000 RFQ threshold for India).
