This Plan identifies the GoVN and IDA requirements for public consultation and disclosure, describes the consultation activities conducted to date, and presents a set of activities to be conducted from the date of preparation of this document to GoVN approval of the VWRAP FS and associated documents in order to meet GoVN and IDA requirements. IDA's obligations for consultation and disclosure (e.g., preparation, disclosure, and updating of Project Information Document (PID), Project Concept Document (PCD), Project Appraisal Document (PAD), and Integrated Safeguards Data Sheet (ISDS)) are not included in this Plan. 1.2 Background 1.2.1 VWRAP Obiectives VWRAP has the following objectives: . Support the modernization of Vietnamese agriculture and enhance water resources management by improving irrigation services through the introduction of modern hydraulic infrastructure and management; e Reduce flood and disaster risk by improving dam safety and management; and * Promote the environmentally sustainable development of Thu Bon Basin through integrated development and management of water resources. VWRAP is comprised of four separate but integrated elements: Component 1: Irrigation Modernization and Dam Safety in six irrigation schemes: - Dau Tieng (Tay Ninh Province and Ho Chi Minh City) - Da Ban (Khanh Hoa Province) - Phu Ninh (Quang Nam Province) - Ke Go (Ha Tinh Province) - Yen Lap (Quang Ninh Province) - Cam Son - Cau Son (Bac Giang Province): Component 2: Dam Safety: - MARD Dam Repair Fund for other MARD dams outside the scope of VWRAP - EVN Hoa Binh Dam Safety Instrumentation and Da and Red River Reservoir Operations Infrastructure - Dam Safety Institutional Development through establishment of a National Dam Safety Unit Component 3: Thu Bon Integrated River Basin Development (Quang Nam Province): - Quana Hue-Vu Gia River Control Works: - Thu Bon Investment Preparation Component 4: Institutional Development and Capacity Building: - Training and Capacity Building - Design and Supervision Technical Assistance - Provincial and MARD Incremental Costs 1.2.2 Contents and Format for EIA Reporting This report is the draft final Public Consultation Report prepared as part of overall VWRAP preparation. This report has been prepared and submitted in accordance with the Terms of Reference for Consulting Services for the VWRAP. This document is one component of the overall VWRAP EIA: Volume 1: A synthesized EIA report summarizing the seven Sub-Project specific EIA reports, including institutional arrangements and linkages with the resettlement and indigenous peoples' plans (being prepared by the Consultant). This volume will also contain an overview of the programmatic framework for addressing the investments not identified by appraisal. This volume contains an Executive Summary. Volume 2: Collation of the seven Sub-Project specific EIA reports. These will be technical appendices to Volume 1 and will each contain an Executive Summary. Volume 3: Public Consultation Report 1.2.3 Purpose of Consultation in VWRAP EIA Preparation The purpose of consultation in the EIA Component under VWRAP is to: * make all potentially affected parties, organizations and individuals aware of VWRAP, the reasons for it, and the requirements and purpose of the VWRAP EIA; * encourage and solicit public input and comment on VWRAP so as to assist in identification of environmental issues and the resolution of those issues through the development of environmental management plans for the various Sub-Projects; * ensure that everyone interested in VWRAP has access to accurate information about it; • meet the requirements of the GoVN and the IDA in respect of public disclosure of information and consultation; * establish ongoing contacts in stakeholder organizations and commune groups to assist with the implementation of the environmental management plans during VWRAP implementation; * assist in obtaining broad public acceptance of VWRAP 1.3 Requirements for Consultation 1.3.1 National Requirements Save for certain provisions, there are no specific requirements for consultation in the national legal, policy, and regulatory framework for environmental impact assessment in Viet Nam (i.e., National Law on Environmental Protection [NLEP, 1993]; Decree 175/CP/1994 on Implementation of the NLEP; Circular 490/19981TT-BKHCNMT on Setting Up and Appraising Environmental Impact Assessment Reports). Most of the provisions requiring consultation are related to the appraisal of environmental impact assessments: . The Ministry of Natural Resources and Environment (MoNRE) is responsible for appraising reports on the assessment of environmental effects of projects and economic entities for larger projects (identified in Appendix II of Decree 175/CP). The National Environmental Agency (NEA) is assigned the responsibility for assisting MoNRE in performing these environmental management responsibilities', MoNRE/NEA is required to complete appraisals within 60 days of receiving the required EIA reports and associated documentation; . National government ministries are responsible for the implementation of state management of environmental protection. This means that they participate as required in the appraisal of environmental impact assessments for larger projects. . Provincial (and city) People's Committees are responsible for the implementation of state management of environmental protection. This includes appraising reports on assessment of environmental effects of projects and local economic entities for smaller projects. The provincial Departments of Science, Technology, and Environment (DoSTE) are responsible to the provincial (and city) People's Committees for this task and provincial government departments participate in appraisals as required. In addition, mass associations (such as Women's Union, Labour Union, etc.) are responsible for assuring the proper implementation and compliance with the legal, policy, and regulatory framework for environmental protection. 1.3.2 IDA Requirements IDA has classified VWRAP as a Category "A" Project2. Under OP 4.01, the requirements for consultation for a Category A Project are: . The borrower must consult Project-affected groups and local non-governmental organizations (NGOs) about Project's environmental aspects and must take their views into account. . The borrower is to initiate such consultations as soon as possible. . The borrower must consult with these groups at least twice: - Shortly after environmental screening and before the Terms of Reference for the EA are finalized; and - Once a draft EIA report is prepared. There may be changes in the responsibilities for environmental management at the national and provincial levels with the recent formation of the new Ministry of Natural Resources and Environment. However, the basic allocation of responsibilities between the central govemment and the provinces will not change. 2 meaning that the Project may have significant adverse environmental impacts that are sensitive, diverse, or unprecedented 2 In addition, the borrower must consult with such groups throughout Project implementation as necessary to address EIA-related issues that affect them. Such provisions need to be a part of the Environmental Management Plans (EMPs) prepared as part of the Sub-Project ElAs and the EIA review needs to ensure that these consultations are included in the EMPs. However, consultations during Project implementation are beyond the scope of the requirements for consultation during Project preparation activities. 1.3.3 Identification of Project-affected Groups in VWRAP STAKEHOLDER ANALYSIS Stakeholder Definition Stakeholders are people, group or institutions that are likely to be affected by the proposed intervention (either negatively or positively, or those which can affect the outcome of the intervention). Project-affected groups (stakeholders) in VWRAP have been identified on the basis of: Meetings and discussions with MARD/CPO, the Consultant, MoNRE/NEA and EIA team members; * Workshops, meetings, consultations, and interviews held in the area of influence of each Sub-Project; 0 Information and data obtained from provincial agencies in the area of each Sub-Project; Existing information sources; and * Information received from Irrigation Management Companies (IMCs). Identification of Stakeholders' Institutions and Organizations Project-affected groups have been identified as the following institutions and organizations in each Sub-Project: * Provincial, District and Commune People's Committees (PPCs, DPCs and CPCs); . farmers and aquaculturalists; . Women's Unions and Farmers Unions as the most important local political-social organizations; * Water User Groups (WUGs) or Irrigation Cooperative Groups; . Irrigation Management Companies (IMCs); * Provincial Departments of: - Agriculture and Rural Development (DARD) for agricultural production issues - Science Technology and Environment (DoSTE) for appraisal of Sub-Project environmental impact assessment and implementation of environmental management plan for the Sub-Project - Labour, Invalids and Social Affairs (DoLISA) for poverty issues - Industry (Dol) for Sub-Project water allocation to industrial uses - Fisheries (DoF) for planned aquaculture production increases within Sub-Project Stakeholders at the central level are: MARD; MoNRE, MPI, and central ministries that may participate in EIA appraisal. 1.3.4 Summarv of Consultations Conducted to Date Table 1 contains the consultations held to date as part of EIA preparation. A first round of extensive consultations has been carried out all Sub-Project areas. 1.3.5 Comments from Stakeholders in first round of Sub-project Consultations CANI SON- CAU SON SUB-PROJECT * Luc Nam District: have a difficulty to get irrigation water in time and normally later than Yen Dung and Lang Giang districts about 2 weeks, so crop yield and production are always affected; . Lack of irrigation water because of increasing crop intensity from 2.7 to 2.9 . From the statistic data of two villages only, about 70% of women suffered gynecology disease, almost of them working in the water field; about 26% of people suffered skin-disease. Some farmers use groundwater to irrigate their fields, however, groundwater do not meet the crop water demand. * Quality of groundwater in the terrace land is generally good, but in the low land is polluted by iron, especially, well water in Dinh Tri Commune is black, fishy smell, and high Canxi Carbonate content. * Bac Giang Tailor Enterprise with 1,000 workers who are living nearby Nui Sui Canal, have discharged waste water direct into this canal causing more water pollution. * Some enterprises in Bac Giang Town discharge untreated wastewater into surface water of sub-project area, mostly to the Thuong Reviver. The largest polluter is the Bac Giang Fertilizer Factory, as well as number of food processing factories (e.g., breweries) YEN LAP SUB-PROJECT * Coal mining enterprises belonging to the Dong Bac Coal Factory and the Hoanh Bo Coal Mine Enterprise have been illegally expending their activities into the protective forests of Yen Lap Reservoir; . This includes discharge of sediments and coal mining waste into watercourses that empty into the Yen Lap Reservoir . Not enough water for irrigation in the end-tail canals, especially Ha Nam island . High seepage water comes from canals * Groundwater resources in Yen Hung district are poor. Groundwater in coastal areas east of Highway No.10 Highway are saline. Groundwater resources of Ha Nam Island district are very poor. Almost dug wells surfer from salinity intrusion with high salinity content, and groundwater is also polluted by ammonia, manganese and iron and of particular concern is the prevalence of high mercury levels in the groundwater of Ha Nam Island. Aquatic weed growths in the canals which cause low flow in the canals, and water is polluted * strong erosion and sedimentation in the irrigation and drainage canals . seepage problem through the canals banks KE Go SUB-PROJECr . strong erosion and sedimentation in the irrigation and drainage canals * not enough water for irrigation at the end-tail canals . high seepage problem through the canal banks All comments in the consultations have been screened during the environmental assessment preparation. 1.3.6 Do Son Workshop Consultations In the Do Son Workshop (3 - 5 July, 2003), participants from all Sub-Projects agreed with the environmental impact assessment findings. After three days workshop with several group and plenary discussion sections, the major environmental related conclusion that the project is environmentally positive, the potential negative impacts are localized, mitigable through appropriate construction planning and management; the wider impact in the long term perspective would be mitigated by a range of agricultural extension service, well designed training program for water user group and strengthening management & coordination between govemance authorities within project area. The workshop agreed for the proposed EMP management mechanism from PMO under MARD/or CPO to PPMUs at subproject localities to be established exclusively managing the project's implementation. Attached to this mechanism, an environmental consultant specialist needs to be deployed at PMO level to manage and plan the overall project's environmental safeguard included the safeguard planning for the second/ third phase and MARD's Dam Safety Fund of the project. At each PPMU, an environmental safeguard is needed to facilitate, conduct, monitor the mitigation/monitoring program included compliance monitoring contractor during construction. The PMO/PPMUs environmental safeguards will work closely with project's training coordinator (in charge of training component) to design and facilitate the training for different project management levels/ water user group that cover the environmental issue related to irrigation, aquaculture and industrial uses, wastewater control and water sanitation. They also agree with Environmental Management Plan as well as the institutional organization which will be implemented in the implementation phases of project and added the following comments and ideas: • Aquatic weeds control should also be introduced to Dau Tieng, Tay Ninh subproject where it is a problem and every year they have to spend billion VND to remove it up for improving water flow and conveyance. . In the F/S and detail design, at a number of main, primary, secondary canal of subprojects, the adequate number of bridge should be provided to ensure safety, accessibility for local people, the lack of these bridges may lead to breaking canal standard design structure if local people self create their accessibility. . The provision of improvement of management road built on canal's bank surface should be considered with due attention on demand to market farm products, and socio economic development of communes living in command area. 1.4 Requirements for Disclosure 1.4.1 National Requirements Disclosure during the EIA process, as described in Circular 490/1998/TT-BKHCNMT on Setting Up and Appraising Environmental Impact Assessment Reports, consists of the EIA Appraisal Council to which the EIA documents are provided for review. This Council, acting as a Consultant to MoNRE/NEA, consists of scientists, managers who have appropriate subject-matter knowledge, as well as social organizations and representatives of local people. 8 1.4.2 IDA Requirements Under OP 4.01, and the World Bank Policy on Public Disclosure (BP 17.50; September 1993) the requirements for Disclosure for a Category A Project are: ° Whenever the Bank requires an environmental assessment, the borrower prepares an EIA report as a separate, free-standing document. The EA report is made publicly available (a) after the borrower has made the draft EIA report available at a public place accessible to project-affected groups and local NGOs, and after the EIA report has been officially received at the IDA, but before the IDA begins formal appraisal of the Project; . For meaningful consultations to occur between the borrower and Project-affected groups and local NGOs on Category A proposed for IDA financing, the borrower is to provide relevant material in a timely manner prior to consultation and in a form and language that are understandable and accessible to the groups being consulted; . The borrower must provide for the initial consultation a summary of the proposed Project's objectives, description, and potential impacts; and . For consultation after the draft EA report is prepared, the borrower must provide a summary of the EIA's conclusions. In addition, the borrower must make the draft EIA report available at a public place accessible to Project-affected groups and local NGOs34. For the VWRAP EIA, the public places at which the VWRAP EIA will be accessible will be: - the Viet Nam Development Information Center, Ground Floor, 63 Ly Thai To Street, Hoan Kiem, Ha Noi; - the MARD Website; and - offices of the Provincial, District, and Commune People's Committees, as well as the IMCs in the Sub- Projects. 1.4.3 Summarv of Disclosure to Date The proposed Project's objectives, description, and potential impacts were provided in the initial consultations described in Table 1, above. The EIA Scoping Report has been translated to Vietnamese but not distributed to Project-affected groups. 1.5 Consultation and Disclosure Plan for Remainder of EIA Component of VWRAP The Consultation and Disclosure Plan for EIA Component of VWRAP is presented in Table 2. This Plan: * completes the requirements for the first of two sets of consultations required for Category A Projects; and • contains a set of activities for the second of the two sets of consultations required for Category A Projects. Given the short Ume frame for the completion of all VWRAP preparation activities and as this Plan will be integrated with the Consultant's Plan for Consultation and Disclosure, efficiencies need to be found in the consultation and disclosure process. It is therefore recommended that reviews to be conducted of the VWRAP pre-FS, FS, and EIA be done at a single workshop in each Sub-Project and at a single national workshop. The schedule for this Plan is based on the VWRAP preparation schedule contained in the Aide-Memoire of the IDA Pre-Appraisal Mission of 23 June to 14 July. 3 Public availability in the borrowing country and official receipt by the Bank of Category A reports for projects proposed for IDA financing are prerequisites to appraisal. Once the borrower officially transmits the Category A EIA report to the Bank, the Bank distributes the summary (in English) to the executive directors (EDs) and makes the report available through its InfoShop.
