It is located at Ban Khoang commune, Sa Pa district, Lao Cai province. This subproject was prepared for site clearance in 2007. However. the Nam Tien Trade and Construction JSC seeks to borrow the loan from the World Bank through a Participating Banh to continue this subproject. Since, the screening showed that there is a land acquisition, therefore it is necessary to trigger the OP 4.1 2 on "Involuntary Resettlement" o f World Bank for this subpro.ject. This RP will describe the activities which the subpro.ject developer has to do additionally after approving the RP to ensure that all activities can meet the requirements o f the World Bank safeguard policy on "lnvoluntary Resettlement" in general and in accordance with RPF o f REDP project in particular. The development o f Can Ho hydropower pro-ject causes main impacts on land due to acquisition. 10\.800m2 o f land will be acquired for construction works. in which 23,500m2 is fallo* hilly land, 14.800m2 is one-crop paddy-field land. and 63.500m2 is burnt-over land (corn. cassava). There are 22 displaced households with 157 person, but there is no H H have to relocate. All o f them are living at Lu Khau and Can Ho villages. There are 12 14Hs considered severely affected (they lose over 10% o f total their land). There is not any HH which impact on residential land and structures. Some HHs are impacted on trees and crops. The 12 displaced households are likely to decrease income mainly due to some loss of agriculture land over lo%, however there is no HH to decrease income due to loss of place o f business. The policy for compensation and assistance is prepared in accordance with the RPF approved by Government of Vietnam and the World Bank. The resettlement cost is estimated by VND 2,027,700,000. 1. INTRODUCTION 1.1 The subproject overview Can Ho small hydropower subprqject locates on Phin Ho stream and is one o f the cascade prqjects ot'Ngoi Xan hydro power plant system. Water flows start from the high region o f Hoang Lien Son mountain ridge, at an altitude o f 2700 - 3000m, going along the Southwestern - Northeastern direction and finally to come to Hong river at the altitude 1000m. The subproject is in the Northwest and 25 km far from Lao Cai town. Can H o small hydropower subproject is located at Ban Khoang commune, Sa Pa district, Lao Cai province. The two dams o f upstream reservoir and downstream reservoir are built on Can Ho stream and May Ho stream. Ban Khoang commune to drive water to the powerhouse. The plant is located on main flow o f Phin Ho stream, 2 km far from the dam on the water flou direction and has the basin area o f 32.2 km'. According to the topographic map ratio 01' 1 1 10.000. tlie subproject is located at north latilude: 22"25'58" and east latitude: 103"49'04". Can Ho smal hydro power project which is built on the Phin H o stream has a great significance in maximizing exploitation o f hydro power potentials o f the stream and generating power for socio-economic development. Can Ho smal hydro power subproject has an installed capacltj o f MM.-1.2. with a total investment capital o f USD 6.1 million, in which USD 4.3 million is allocated to the construct~onphase ( Ist phase) and USDI.8 million is for equipment procurenlent (2"d phase). The objective o f the subproject is to increahe the supply of' elcctr~c~tyto the nat~onalnetwork with an annual output o f kWh16.13 mill~on,contributing into the socio-economic develop~nentin this region. The major contruction works for this subproject consist o f dam, spillway (two damsites of superior reservoir and inferior reservoir) and intake, headrace channel, surge tank, penstock and powerhouse. Water in the reservoir is taken via the headrace channel, flowing to the surge tank. then through the penstock to the powerhouse, and finally it is discharged to the Phin Ho stream. This subproject was prepared t'or site clearance in late o f 7007. The Key Princip1e.r of /he RP This RP complies with Resettlement Policy Framework o f Renewable Energy Developtnent Prqject which in turn complies with World Bank OP 4.12 on "Involuntary Resettlement". Theretbre, this RP is applied the following key principles: (a) Involuntary resettlement should be avoided where feasible, or minimized, exploring all viable alternative project designs. (b) Where it is not feasible to avoid resettlement, resettlement activities should be conceived and executed as sustainable development programs. providing sufficient investment resources to enable the persons displaced by the project to share in project benetits. Displaced persons should be meaningfully consi~ltedand should have opportunities to participate in planning and implementing resettlement programs. (c) Displaced persons should be assisted in their efforts to improve their livelihoods and standards of' living or at least to restore them. in real terms. to pre- displacement levels or to levels prevailing prior to the beginning o f project implementation, whichever is higher Having based on principles o f the World Bank policy OP/BP 4.12 lnvolunrary Re.se/tlement, many design options were reviewed in order to seek an appropriate option and to mitigate potential impacts in lieu o f land acqi~isitionand assets. Finally, a new design option is worked out and proposed to mitigate potential impacts to the extent possible. 1.2.2. The Scope of(he Re.ve//lernc.n/P l ~ n Although large scale displacement o f population is not envisaged but the deployment o f Can Ho hydro power subproject are likely to cause adverse impacts in terms o f loss o f agriculti~raland tree crop land land and sources o f income o f some households residing In the area. Additionallq. there are likely to be some adverse impacts during the construction phase of such project. The popillation densit) of Ran Khoang commune is only 43 persons per square kilometer. while this tlg~~reof'Sa Pa districl and Vietnam are 70 and 227 per-sons per square respectively. This is a higlilj rnotrntainous area. therefore the popillation there live much sparsely. As the rerult, the involuntary land taking does not have significant impact as it is in low land or in the city. 2.2.1 Loss of land The development o f Can Ho hydropower prqiect causes main impacts on losing pans o f the land due to acq~iisition.I0 1.800m2 ot. land will be acquired for construction works, in which 23,500m2 is t:dllo\v hilly land. 13.800m' is one-crop paddy-field land. and 63,500m2 is burnt-over land (corn. cassava). There is no affected structure in the subproject site. Details for each type o f acquired land are as bellows: Table 3. All displaced persons agree with the mode o f compensation in cash to the area o f lost land in the consultation phase. The policy o f compensation is provided in the RPF. There is no household having to be relocated among the 22 displaced ethnic minority households (equivalent to 157 persons). and no household has land use right certificates for the affected land. However, lost agriculture land is legally under administration of the CPC o f Ban Khoang. Most o f inhabitants are planting rice, corn, cassava on such land. In fact, husbandrj. and planting are generating rnajor income for their families. However, there are twelve households having more than 10% o f their agriculture land to be acquired. The remaining 23,500m2 o f acquired land consist o f fallow hilly land and land under stream. Mosr o f it is self-reclai~nedand cultivated b j hoirseholds and legally under administration o f the CPC o f Ban Khoang since 1999. Loss of residential land und public lanrl There is no one among 22 displaced hoi~seholdslost residential land. And, the construction works will not produce any impact on the public land. 2.2.2 Impacts of thestructures There is no household will be impact on their structures. And there is no community structure will be suffered as well. 2.2.3 Impacts of trees and crops The 22 displaced households will be impact in trees and crops. Most o f displaced households are living at L u Khau village and Can Ho village, in which 20 households will lose agriculture land. most o f which is one-crop paddy-field land and burnt-over land growing corn, cassava. However. these households still have enough time to harvest crops on such land. The remaining 02 households will lose mainly trees other than timber. 2.2.4 Impacts of income and business Thepossible decreuse qf incomr,from the ugriculture The 22 displaced households are likely to decrease income mainly due to some loss o f agriculture land. There is one displaced household losing more than 10% o f agriculture land and one displaced household decrease over 10% of income due to the acquisition o f agriculture land. These households are living at L u Khau village. Table 5. So, there is no impact to the inhabitants in the subproject site in this regard. 2.2.5 Impacts of public construction and cultural construction There is no public construction and cult~~ralconstruction works in the subproject site. So no impact to the inhabitants in the subproject site in this regard. 2.2.6 Temporary impacts There are temporary impacts on small area of land due to construction and earth- moving activities. The temporary impacts will be compensated according to the laws and regulations, and will be paid to the citizens atter co~npletionof construction works. 2.3. Socio-economic characteristics of displaced households The socioeconomic census, inventory and survey in the areas of subproject were carried out by Nam Tien Company in January. 2007 with assistance of CPC of Ban Khoang, local authorities and inhabitants in subproject site. The socioeconomic census was conducted in all areas of subproject. The displaced households, especially the households lost cultivating land. were interviewed and consulted. The public consultations were held with participation ot'displaced persons at each proposed area of subproject. The consultant conducted consultations to displaced persons in some places. The contents of cons~~ltationsemphasize some following points: - Mode of compensation (by cash, other etc..) - Compensation cost (for lost lands, crops and structures1construction) - Income rehabilitation measures (stabilization of production1 business line) - Other allowances to satisfy the displaced persons' expectation or requirement On the orher hand. intervieivs with local authorities at all levels were made to realize their viewpoint to the impacts likely caused by subproject. Moreover, representatives of affected comlnunes have been mobilized to actively participate in determining types, scale and degree of losses for each household, and checking exactly address, as well as baseline socio-economic characteristics of each displaced household. The survey was conducted using face-to-face interviews, and delivery of questionnaires to households in case of absence. These questionnaires were filled with full information and signed by household's representative, head of v~llageas well as stamped by the CPC to demonstrate that the) agree with the inventory of affected assets. In some cases. the CPC' n4iisted to arrange solnc pc~blicmcetings to collect data of displaced households. The questionnaire form is attached in Annex 1. 2.4. Major findings in the socioeconomic census Representatives from each of 22 displaced households have been investigated with corresponding s~lrveyedstructure presented in the following table: Table 6. In which 9 households have from 4 to 6 persons. and 13 households have more than 6 persons per household. Households that are subject of social policy Among 22 displaced households there are no households that are subject social policy such as war invalid. revolutionary martyr. war veteran. people with disabilities etc... But there is one poor hoi~sehold(according to the poverty line set by the Ministry of Labour, Invalid and Social Affair - MOLISA. applied for the rural area). Sex structure 7'he proportion 01' ~naleand fe~nalt.among investigated households is acco~~nted for 44.58% and 55.42%, respectively. The proportion of female is higher that that of male in subprqject site reflects a gcneral characteristic of Ban Khoang cornmune. Table 7. According to the survey's results, the proportion people with primary education or lower level and secondary education represent 82.17% and 17.83% of displaced households, respectively. No one is doing business. And the proportion of investigated households earning their living from the agriculture production represents 100%. All of the DPs are farmers. Income of households The monthly average income per investigated household is standing at VND 1,822,300,equivalent to VND 255,300 person/month. Therefore, this income is a little bit higher than the poverty line set by of Ministry of Labour, Invalid and Social Affair applied for the rural area (VND 200.000/person/month). L 1 L I__ ii- Opinions of subproject affected persons All investigated households agree with objectives o f the subproject and are fully aware of the heneti~sand impacts hrought to the society in general and inhabitants living in the area of subproject in particular. However, the displaced persons require to be co~npensatedappropriately for lost land and assets in order to improve their livelihood and living standard. 3. POLICY FOR COMPENSATION FOR LOSS AND ASSISTANCE Basing on the results o f census and inventor!'. each type o f loss and object to be affected was identified and described in the following sessions. The policy for compensation and assistance is prepared in accordance with the RPF approved by Government of Vietnam and the World Bank. The summary of entitlement for different types o f losses is provided in the Table 10. According PRF, the DPs losing Inore than 10% o f agricultural land will be provided with subsistence assistance equivalent to market value of 30 kg of rice /person/month for 3 months if the DP do not have to relocate to new place, however, to encourage the DPs, this subproject developer will assist these HHs equivalent to market value of 30 kg o f rice /person/month for 6 months to guarantee the income of HHs and increase the productivity of the existing land. 3.1 Compensation and assistance policy for permanent losses 3.1.1 Lo.r.rof agricult~~irrland No household among 22 displaced households due to acquisition of agriculture land has land use right certificate or other legal claims for the acquired agriculture land. All 78,300m2 of the acquired agriculture are sel f-reclaimed and cultivated by the displaced households and are currently under legal administration by the CPC of Ban Khoang. Therefore, cash compensation. at full replacement cost for the acquired area will be provided to the displaced households. One arnong 20 displaced households has over 20% o f their agricultural land to be acquired. So. "land for land" co~npensationo f equal productive capacity and training for change of their production andi or business lines wit11 t h e arrangement of new jobs will be provided. Moreover, other assistances will be also provided to this DH. 3.1.2 Lo.r.7 o f re.ricientia1land (141ilhor witholrt .s/r~rc/~rre.rl The policy is applied for residential land owner with or without structure in the subproject site. But, no household is under this impact category and no household lost any land and structure. Therefore, this policy will not be used. 3.1.3 Loss of Structures and other Fixed Assets N o household is classified into this impact category in sub-project framework. Therefore. this policy will not be used. 3.1.4 Severe 1o.r.rof hu.rines.~/pp,ocl~~ctiveplocc. und ho2.r.r~lease No household is affected in their busiriess/prodi~ctiveplace and house lease. Therefore, this policy will not be used. 3.2 Compensation and assistance policy for lost trees and crops There are 22 displaced households lossing trees and crops. So, the loss o f standing crops and trees will be compensated in cash at current price issued by the PPC o f Lao Cai. The displaced households growing crops on the acquired land will have enough time to harvest. The subproject will wait until1 the DPs collect all o f their harvest. 3.2.1 Income ond li~~elihoodrehnhilitntion rnrn.surr.~ The objecti~eo f income and livelihood rehabilitation measures for the displaced household5 is to ensure that ad~el-selqaffectcd displa~edhouseholds will be assisted to improve or at least maintain their pre-project living standards, income earning capacity and production levels. The) will receive a cornpensation for loss o f income and assets equivalent to level o f loss Furthennore. additional assistance upon types and levels o f impact will be provided to the displaced households. According to the results o f socioecono~nicsurvey, the income o f displaced households corne froni agricullul-al produc~ion.1lie rehabilitation measures to improve their living standard4 and income earning capacit! are as fo\lows: The cash cornpensation will be provided to the entire area o f burnt-over land; The 6 households that losing agriculture land for rice cultivation will be compensated by land o f equivalent size in a location acceptable to displaced household. According to the proposal o f DPs, new land will be in Lu Khau village with total area o f 1.5 ha. Additionally they will receive a cash allowance to purchase food during thc first three )ears sine the paddb-field land starts to be reclaimed (The fomular used in calculation is defined: lost area \,quantity x current rice price). As a result, policy for transport/ shifting allowance and temporary house assistance will not be prepared. (iii) A.v.ri.rtunceto urrungenrent oJ'ne\~~~,job.\.~lnd/ruiningjbr change of theirproduction and/or business lines The Can Ho hydro power subproject management unit will encourage contractors in recruiting DPs for unskilled positions in the construction phase such as manual worker, watchman. 3.2.3 Other a.v.vi.vtence lo improve livelihoocfand .s/andardvof living In addition to the compensation and assistance entitlement presented above, in 2007, Nam Tien company gave the commune boarding - school support of winter coats and comforters with amount o f VNL) 50 millions. 3.3 Compensation and assistance policy for temporary losses In the unlikely event that loss is temporarily taken by the works under the project, DPs will be cornpensated for their loss ol' income. standing crops and trees in accordance with the RPF. RESETTLEMENT COST AND BUDGET All costs associated with compensation. site clearance would be a part of capital cost. The estimated cost will be established by entitlements for different types of losses presented in the attached Entitlement Matrix. The cost will be covered by subproject developer (Wam Tien Trade and Construction Joint Stock Company). 4.1 Procedures for compensation The compensation in lieu ot' land acquisition, assistances and resettlement cost will be covered by subproject developer. The resettlement committee of Sa Pa district on be half of Nam Tien Company will ~iiakepayment of compensation cost and assist directly to the displaced households. 4.2 Replacement cost I n the subproject site there is no transaction on land. It could be explained that the subproject is located in a large and high mountaineous area. As a result, the market price of land use in that area is difficult to define. However, we can indirectly use the commodity-land exchanges in similar area to estimate the land price in project area. * The land which the local residents are cultivating is mainly reclaimed by themselves. The reclaimed land is often used to cultivate for shifting cultivation. After several crops, when the land becomes infertile, they left fallow until being recovered by itself. Therefore. as mentioned above. it is very difficult to define the boundary of cultivating land of each HH since the HHs even do not knoh exactly how much land they owned or in their use. However, the consultation procedures on the compensation cost have been conducted by staff of Nam Tien company and all displaced persons agreed that the compensation cost for land accluisition and lost structures/ tixed assets will be complied with the compensation cost and assitance stipulated in the Resettlement Policy Framework of the REDP 4.2.I C'ompen.vcrfionco.rfjor Icrntl' ncqz~i.~i/ion As above mentioned. the real property market in subproject affected area has not been existed yet. so the price of land in market t\)rcalci~lationof co~npensationis difficult to define. Additionally, all displaced persons agree with the co~npensationcost stip~~lated by PPC of Lao Cai in the consultation phase. Decision No.79120071QD-UBND o f Provincial People Committee o f Lao Cai dated 3 1" December. 2007 regc~latingon price o f types o f land, classification o f land, zoning o f land and classification o f roadslstreets and land location for the year o f 2008 in scale o f Lao Cai province. This decision comes into effect from the date o f 01" January, 2008. According to legal framework o f Lao Cai PPC, the replacement unit o f paddy-field land is 10,00OVND/m2, burn-over land is 6,000VND11n2. hi114 land is 6,000VNDlm2. Howerver, to help the DPs restore their income and livelihood after resettlement, the subproject developer will apply the compensation costs at the replacement level for paddy-field land, burn-over land and hilly land are 20.000VNDlm2. 8.000VNDim2 and 8,000VNDlm2 respectively. Besides, the developer also give the DPs that lost more 10% oftheir land the assistance that is more than the assistance stipulated by Lao Cai PC. 4.2.2 Compen.~otionco.c;/for .srr~rcr~lre.v/fiued(I.F.YP~.Y The compensation cost issued by PPC of Lao Cai to be used to compensate the lost structures/ fixed assets. tree and scrops in the subprqject site is similar to the price o f these asset in market. Moreover. the displaced persons agree with the compensation cost issued by PPC o f Lao Cai. As a result, the compensation cost for structures1 fixed assets will be applied in accordance with Decision No.79120071QD-UBND o f PPC o f Lao Cai dated 31'' December, 2007 regulating on price o f types o f land. classification o f land, zoning o f land and classification o f roadsJstreets and land location for the year o f 2008 in scale o f Lao Cai province. In addition, the loss o f standing timber will be compensated at replacement cost and benefits from the harvested timber on the land affected will accrue to the displaced person. 4.2.3 Allowances and bonus The allowances and bonus stated in the RPF are similar to these allowance and bonus issued by the PPC o f Lao Cai. Theretbre. the allowance and bonus to be paid for the displaced households in the subproject site will be co~npliedwith the Decision No.79/2007iQD-UBND of PPC of Lao Cai dated 3 1 December, 2007 regulating on the policy o f compensation and assistance Vor land acq~liredb~ the State. 4.3 Cost for implementation arrangement All costs associated with institutional arrangement will represent 2.5% o f the initial resettlement cost. This cost will be added to the initial resettlement cost. Additionally, the cost estimates will make adeq~~ateprovision for contingencies, equivalent to 10% o f the resettlement cost (,includingcost for institutional arrangement) used to pay for untorseen circc~~nstances or delays. In case ot'cost overruns due to unforeseen circumstances or delays, the subproject developer will allocate additional ti~ndsas may be necessary to ensure the resettlement implementing activities satisf).ing the subprcqecr schedule. 4.4 Total resettlement cost The resettlement cost is estimated by VND 2,027,700,000 (Two billion bent), seven hundred million und .seven hz'indred /hou.sund C'IVD only). IMPLEMENTATION PLAN 5.1 Information disclosure Upon receipt o f investment license. Nain Tien Company have disclosed to the subprqject affected communities and other key stakeholders to ensure that they are fully aware o f the impacts o f subproject and mitigation rncasures proposed in this Resettlement Plan. These activities include following. - Meetings with (i) head of ethnic minority group; (ii) men; and (iii) women, especiall) to the inhabitants living in the affected areas. Tlie discussion was focused on types, scale and degree o f positive and negative impacts and recommendation for the subproject design. - Two group meetings were held at the oftice ofCPC of Ban Khoang in December, 2007, with the participation of 14 displaced persons. commune representative, land surveyor and commune police: - Focus groups discussion and interview \kith displaced persons to collect opinions on socio-economic and environmental impacts caused by subproject and obtain their agreement on their specific entitlement. The 2 discussions were held at the oft?ce o f Cornmune People Committee with 7 participants in each discussion. - Conducririg socio-economic census and data collection on impacts and losses to the ethnic rninoritc co~nlni~nitiesin the area o f subproject (conducting a survey of 23 representatives o f 23 ethnic m~norit) households living in the 2 afkcted villages). The issues discussed in the meetings and focus group discussions are compensation cost for land acquisition, the mode o f land acquisition and, the support for PAPSto rehabilitation o f the likelihood. Furthermore more, some o f DPs expressed their happiness when they will be able to use electricity when the Can Ho hydropower subproject is constructed. 3.2 Con.ru/tation and .rc~cio-economiccen.vr~.rto displucrdperson.~ Nam Tien Company conducted a socio-economic census and consultations with the displaced households in scope of subproject. especially to households displaced from land acquisition. The public consultations participated by displaced persons at each proposed area o f subproject were provided. The company organized some consultations to displaced persons in some places. The contents o f consultations emphasize some following points: - Mode o f compensation (by cash. other. etc.) - Compensation cost (lands, crops and structures/construction are lost) - lncome rehabilitation measures (stabilization o f production/ business line) - Other allowances to satisfy the displaced persons' expectation or requirement , On the other hand, an interview with local authorities at levels was made to realize their viewpoint to the impacts likely caused by subproject. Moreover, the representatives o f affected comniunes ha5 bccn ~ n o b i l i ~ eto d actively participate in determining types. scale and degree o f losses tbr each household. and checking exactly address, as well as baseline socio-economic characteristics o f each displaced household. The survey was conducted together with the face to face interview and delivery of questionnaire forms to hoi~srholdsin case o f being absence. These questionnaire forms were filled fully information and certified by household's representative, head o f village as well as stamped by Commune People Committee to demonstrate that they agree with the inventory of affected assets. Additionally. Commune People Committee assisted to arrange some pi~blicmeetings to collect data o f displaced households. During the construction phase o f the subproject, the Resettlement Committee who consists o f DPC o f Sa Pa. District Department o f Finance. District Department o f Natural Resource and Environment. CPC of Ban Khoang. Subproject developer (Nam Tien Trade and Construction Investment Joint Stock Company) to be established to carry out the resettlement plan. These agencies are responsible for implementing the resettlement plan. During the phase of detailed design. the DPC' ofSa Pa will update the compensation cost at replacement cost for losses and subsidy adjusted with inflation rate. This update will be conducted with the consi~ltationof displaced persons and local authorities. 5 . The dispalced persons will be consulted additionally on the Resettlement Plan. Public Information Campaign will be carried out by ways consisting o f the face to face discussion with the displaced persons and the media to introduce the subproject. Moreover, the Resettlement Committee will assist in carrying oitt this campaign to all displaced persons and affected communities in the area o f subproject. It will be commenced after necessary approvals for the subproject are obtained. In order to facilitate the implementation o f Resettlement Plan, the subproject management board and local authorities will undertake to carry out the public information dissemination campaign and consultation with displaced persons. The details are as belows: Disclosing adequatly the information on subpro.ject, components and activities to displaced persons: Acquiring opinions and complaints o f displaced persons about proposed policies and activities: Receiving coorperation and participation of displaced persons and communities for activities required in the preparation and implementation phase o f Resettlement Plan; Disclosing plan tbr acquisition of land, relocation and rehabilitation. 5.6 Compensation procedures and implementation of other entitlement to displaced persons The District Resettlement Committee will be assigned by DPC o f Sa Pa to carry out the activities o f compensation and resettlement for displaced persons. They will be also supported by the District Department o f Finance. The District People Committee oVSa Pa decided that the Resettlement Committee and the Department o f Finance will update the compensation cost and entitlement for displaced persons after the census, measure and indentification o f types and scale o f impacts are completed. And then, the Resettlement Committee will value the lost assets and entitlement as well as issue the summary sheet on compensation to each displaced household. The summary o f impacts and entitlement's summarizing hidher assets lost and their entitlements for compensation and other assistance will be disclosed to all affected persons at office o f CPC. In case. it doesn't have any grievance redress. the displaced persons will be resolved in accordance with this policy presented in this resettlement plan. 5.7 Approval for Resettlement Plan The Resettlement Plan for the construction phase of Can Ho hydro power project is prepared in accordance with the RPF. Therefore, the resettlement policy will consist of objective, principle of compensation and assistance, allowance, legal framework, institutional model. resettlement plan, consultation with affected communities as well as internal and external monitoring as stipulated in the PFR. The Resettlement Plan will be approved by World Bank and DPC of Sa Pa (if be authorized) before getting construction. After obtaining the second approval for this document, the subproject developer will use this RP as legal base to implement the subproject. 5.8 Updare of con7pensalion co.vr und in7plen~enrurionof compensation and assisranck ucrivirir.~/?)r/he remclininp(1rc.a.vof.~l~hl)r(?jec~ In the phase of detailed design, the consultation to affected persons and local authorities will be provided. Basically, the DPC of Sa Pa will update the compensation cost at the replacement cost for all losses and adjust the allowance with the inflation. The payment of compensation and implementation of entitlement and other assistance to the remaining affected households continue to be made. 5.9 Internal morniloring The project irnpleinenting agencies are responsible for conducting the internal monitoring of Resettlement Plan. Nam Tien company will base on the regular schedule reports to mornitor the preparation and implementation of resettlement. The internal mornitoring indicators include: - Paying the compensation, assistance to affected persons equal to scale, types of different losses in compliance with the policy of compensation and assistance presented in tlie Resettlement Plan. - Technical assistance, relocation, subsidy and transportishifting allowance; - Income rehabilitation measures and entitlements of displaced persons; - Consultation and information disse~nination; - Grievance redress procedures and outstanding issues: - Priorit! of displaced persons un propused options; - Sched~~leof land acquisition 5.10 External Monitoring To ensure transparency. Rural Electrification and Renewable Energy Project Management Board (PWIB) undcr the Ministr) of' Industr) and Trade (MOIT) will carry out their own supervision or arrange an external monitoring consultant to carry out the supervision and evaluation. The objective of external monitoring is to provide evaluation, supervision of resettlement plan, changes on living standard and job, income rehabilitation and baseline socioeconomic characteristics of the displaced persons, effect, impact and stability of entitlements, necessary of mitigation IneasLlres if any. Basically, some lessons on developing policy and and plan will be provided. The external monitoring will be conducted after obtaining the approval for this Resettlement Plan. Quarterly external monitoring reports will be submitted to the relevant agencies. The indicators of the external monitoring consist of: a) Paying fully co~npensationto the displaced persons before acquisition o f land and being equivalent to the value of lost assets; b) Assisting the displaced persons in rebuilding their house in the remaining area of landholding or in the new relocation sites arranged by subpro-ject developers; c) Income rehabilitation measures; d) Consultation and public dissemination on compensation policy: (i) the displaced persons will be consulted fully on the acquisition of land, land lease and relocation; (ii) the external monitoring agency must attend at least a meeting of public consultation to follow up the public consultation procedures, additional issues in the meeting and recommend some solutions; (iii) awareness of communities on policy and entitlement of co~npensation; (iv) awareness on different options presented in the Resettlement Plan: e) ~onitoringfor the rehabilitation of business/production activities: f) All findings presented in the Resettlement Plan will be ~nonitoredand recorded. The grievance redress mechanism will be also supervised. g) The trend on living standard will be observed and investigated during the implementing phase. Any potential finding in the rehabilitation phase will be also reported. If the measure. calculation, pricing and resettlement are not complied with the regulations, all displaced persons will have the right to lodge complaints as the follwing legal basis: Step I: The displaced persons disagree with the policy of compensatiori and resettlement, the! ivoi~ldsubmit the complainrs to the C'PC' or Can Ho Hydro I'ower PMB. Where the complaints will be resolved within I month from the date of receipt of initial complaint. The decision of the District Resettlement Corn~nitteewill be issued within 15 days from the date o f receipt of such grievance. Step 3: Where a complainant disagrees with the decision on resolution by the DPC or the Representative o f Co~ninittee.or the CPC does't reply within 15 days. it shall have the right to lodge the further complaints with the Provincial People Committee. The Representative of Provincial Resettlement Committee will resolve within 30 days from the date of receipt of such the complaint. Step 4: Where a complainant disagrees with the decision on resolution o f the complaint issued by the PPC or Provincial Resettlement Committee, it shall have the right to complain to the People's Court in accordance with the regulations o f the law. The displaced persons will be esernpted from administrative abd legal fees. The fee for lodging the complaint with the Peopel's Court will be even exempted. Detailed procedures for grievance redress and specific steps will be published popularly. All grievance dossiers will be kept at the CPC of Ban Khoang and the office of Can Ho hydro power subpro-ject management board. Table 12.
