SFG1317 Abbreviated Resettlement Action Plan in a frame of fourth Grant of Global Partnership for Education sfYou (GPE-4) Project: «Construction of secondary school №56 in v. Sufiёn, Khalifa Hassan Jamoat of Pendjikent" 1. Introduction The Project Development Objective is to contribute to improving the learning conditions and quality in pre-school and general education Grant is developed for assistance in filling gaps of implementation of the National Strategy of Education Development (NSED), in particular with regard to the objectives on improving of infrastructure, material and technical aspects of education system, on improvement of management and work of education system in providing of quality educational services; and for ensuring the quality of educational services. Ministry of Education and Science (MoES) of the Republic of Tajikistan, with the support of local consultants, manages and implements Grant. Components of project GPE-4 will have four components, as described below. Each component works towards the development of child-friendly schools to ensure that the children of Tajikistan, especially the most marginalized including girls, ethnic minorities, rural children, and children with disabilities, are afforded the opportunity to achieve their education goals for future development and success. The child-friendly school is a conceptual framework by which various aspects of the education system are addressed to ensure that each child is afforded their basic right to education. Inclusive in this framework is provision of safe and adequate school structure; relevant curriculum and content; a child-centered pedagogical approach; and relevant resources. As such this component will finance: i) an analysis of the pre- school sector; ii) the reinforcement of state kindergartens and early learning centers; and iii) where possible, expansion of the latter. The Department of Pre-School and General Secondary Education (DPGS) is responsible for the component implementation. DPGS will work in close collaboration with Academy of Education (AOE) and Republican Institute for In-service Teacher Training (RIITT). The Project will finance technical assistance to support the DPGS to implement activities. Component Two: Enhancing Quality of Education (US$ 3.25 million; 20.1% of total project cost) The objective of this component is to improve the quality of education in the general education programme. There are three sub-components which build upon FTI-3 components and are in line with NSED 2020 goals and objectives to improve the quality of education at the primary and secondary levels. The Department of Pre-School and General Secondary Education (DPGS) is responsible for the component’s implementation. The DPGS will work in close collaboration with AOE and RIITT. It is expected that in enhancing the quality of education, learning outcomes will be improved. Sub-component 2.1: Upgrading Primary Education Curriculum and Pedagogy (US$ 2.15 million; 13.3% of the total project cost) Sub-component 2.2: Upgrading Secondary Education Curriculum and Pedagogy(US$ 0.35 million; 2.2% of total project cost) Sub-component 2.3: Promoting Inclusive Education (US$ 0.75 million; 4.6% of total project cost) Component Three: Improving child-friendly learning environments (US$ 8.00 million; 49.4% of total project cost) The objective of this component is to increase access to improved child-friendly learning environments in general secondary education through the provision of safe and secure schools. It is expected that this will contribute to an improvement in student completion, teacher motivation, and learning outcomes1. As such, this component will finance improvement and expansion of child-friendly learning environments in approximately 30 schools to the benefit of approximately 7,900 students2 through construction or rehabilitation of premises and provision of furniture. Sub-component 3.1: Increasing Access to Child-Friendly Schools (US$ 7.00 million; 43.2% of total project cost). Sub-component 3.2: Provision of Supplies to Develop Child-Friendly Schools (US$ 1.00 million; 6.2% of total project cost). Component Four: Strengthening System Capacity (US$2.4million; 14.8% of total project cost) The objective of this component is to strengthen the capacities at the central and local levels to manage the education system. 1 There is a large body of research documenting positive associations between the physical conditions of schools - including their quality and the availability of learning and other facilities and utilities – and student completion, teacher motivation and student learning. A summary of the researches in that area can be found in Annex Two.Refer to paragraph 23 and Annex 1 as to how learning outcomes will be measured as an impact of GPE-4. 2 Calculations are in Annex Six. Sub-component 4.1: Management Capacity Strengthening (US$ 0.12million; 0.7% of total project cost). Sub-component 4.2: Directors’ Training (US$ 0.80 million; 4.9% of total project cost). Sub-component 4.3: Per Capita Financing (US$ 0.19 million; 1.2% of total project cost). Sub-component 4.4: Education Management Information System (US$ 0.09 million; 0.6% of total project cost). Sub-component 4.5: Project Management, M&E (US$ 0.85 million; 7.4% of the total project cost). 2. Legal framework The problem of compensation for damage specified in a frame of action plan is regulated with following laws and regulations:  Constitution of the Republic of Tajikistan which establishes exclusive state property on land;  Land Code of the Republic of Tajikistan - most systematic set of rules regulating complex of legal relationship that occur in the process of ownership, use and disposal of land;  Civil Code of the Republic of Tajikistan, determining the legal status of participants of civil turnover, basis of emergence and procedure of implementation of the rights, contractual obligations, property and non-property relations;  Law of the Republic of Tajikistan dated May 12, 2001 "On Land Assessment", which establishes the legal basis of assessment of land;  Law of the Republic of Tajikistan dated May 14, 2004 “On local public authorities� establishing regulatory framework of allocation and redistribution of land;  Law of the Republic of Tajikistan on January 5, 2008 "On land management," regulating relations associated with the legal bases of activity on Land Management;  State Land Cadastre as a system of information and documents on the natural, economic and legal status of land, their categories, qualitative characteristics and economic value;  Regulation on the procedure of compensation of damages on land users and losses of agricultural production, approved by the Government of the Republic of Tajikistan dated December 30, 2000 № 515, establishing procedure of compensation of losses to land users;  Code of Civil Procedure of the Republic of Tajikistan, determines the procedure, rules and terms of judicial protection at occurrence of judicial disputes on involuntary resettlement.  For realization of Programme of Resettlement Policy also is used Regulations of the World Bank Policy on Involuntary Resettlement. 3. Impact of resettlement from project activities and compensation Concerningfarmland Secondary school № 56 is located in the village of Sufiёn Jamoat of Khalifa Hasan of Penjikent. For construction of new school is allocated land plot of 1.5 hectares in the western part of the village, 200 meters from the existing school, outside of settlement of Sufien village. The allocated land plot will result in the acquisition of a state dekhkan farm "Mehnatobod" which is included in public reserve fund of land of Pendjikent.Thislandplotof 1.5 hectaresisirrigatedagriculturalland. Affected people were informed already on 26.04.2014 on meeting with commission on visiting of pilot schools #56 and #18 of Pendjiken which included in list of objects of GPE-4 that passed under leadership of deputy minister of MoES RT- F.Ismonov. At given meeting by people of farm of Khalifa-Khasan djamoat was decided to build school for 10 classes on the territory of d\f Mehnatobod of Khalifa-Khasan djamoat. The acquired land plot is rented by farmers working on a dekhan farm. There is agreement of renters of dehkan farm on alienation of 1.5 hectares of land for construction of the school for 10 classes. On the basis of written request of MoES from 03.06.2014, Chairman of dehkan farm "Mehnatobod" by its decision №1 of 20.01.2015_ has allocated new land plot to renters of d / f Mehnatobod from irrigated arable land of the reserve fund of Pendjikent on the territory of the same Jamoat of Khalifa Hassan and on its features are identical to the previous land plots. Allrenters (affectedpersons) ofd\fMehnatobodwerefamiliarizedwithnewlandplotalreadyatthebeginning of October 2014 which was presented them as compensation and during 4 month up to decision of the Chairman was provided opportunity to affected people choose new land plot on territory of given farm. Allocated under construction of school №56 land plot 1.5 hectares after the fall and spring harvest by renters fully released. 27.06.2015 27.06.2015 27.06.2015 New land plot of 1,5 hectares allocated by renters. The new land plot of 1.5 hectares with characteristics is identical to previous one, land is irrigated and quality of soil is the same as the previous one, does not required cutting down of trees and shrubs. From March of this year on a new land plot by renters began planting of vegetables and agricultural products, and for today they have already gathered the first harvest of agricultural products and began planting of the second crop. Affected individuals and Compensation All land of this farm land is allocated to members of farm in rent for growing of crops. Land plots of renters AM, Sh.Kh., H.B., A.T., A.S., O.P. and M.R. with total area of 1.5 hectares falls under school construction. At withdrawal of land for construction of the school members of dehkan farm can lose; - Land for growing of crops -1,5ga; - Crops (vegetables); - Hay to feed cattle. Implementation of this project can not adversely impact on members of dehkan farm. Members of farm in 2014 without losses gathered harvest of crops (see photo). Physical movement of families from one place to another in this case is not expected. During the conversation on 21 May 2015 with members of dekhkan farm "Mehnatobod" A.M. Sh.Kh., H.B., A.T., A.S., O.P. and M.R. revealed that level of income of their families, including those which depends on the sale of harvested crop . 1. Potatoes – 6 tone х 2,2 somoni = 13200 somoni; 2. Carrots – 15 tone х 1,5 somoni = 22500 somoni; 3. Tomatoes – 0,3 tone х 3,5 somoni = 1050 somoni; 4. Cucumbers - 0,4 tone х 2,5 somoni = 1000 somoni; 5. Peppers – 1,5 tone= 3,0 somoni= 4500 somoni; 6. Onions – 2,5 tone = 1,2 somoni = 3000 somoni; 7. Hay for cattle – 1,5 -2,0 tone х 600 somoni = 1200 somoni. Total income of the above-mentioned members of d\f "Mehnatobod" is 46450 somoni. 26.11.2014 26.11.2014 Previous land plot allocated under construction of school # 56 after harvesting of vegetables and agricultural products, 2014. Before making of decision by Chairman of d/f Mehnatobod on providing of new land plots renters are familiarized with the new land plots. To renters were given opportunity to select the land plot and they are happy with their chosen new land plots. In the new land plot of 1.5 hectares is absent shrubs and trees, no need for additional land cultivation, land is fully irrigated and the soil is the same as in the previous land (see. photo from 27.06.2015). The allocated land plot with area of 1.5 hectares from irrigated arable land of the reserve fund of Pendjikent are located in the same Jamoat of Khalifa Hassan and on its features are identical to the previous land plots. In a frame of this project does not provide physical and economic resettlement of any household. Project also has no effect on living conditions of households that are far away from residential areas of these farms. All members of dehkan farm were informed and familiarized on the degree of impact, amount of compensation in the form of new land plot that identical to the previous one.It has already happened, on photos can be seen that renters are already fully accustomed on the new land plot, sowed their land with vegetables and agricultural products, and have gathered the first harvest of agricultural products this year. Renters of farm "Mehnatobod" consider compensation in the form of replacement of land provided and effective, in evidence of this were written by him written agreement (attached). During the conversation with renters of d / f "Mehnatobod" revealed that the average income of farm from the land plots of 1.5 ha (which falls under school construction) is: 1. Potatoes - 6 tons; 2. Carrots - 15 tons; 3. Tomato - 0.3 tons; 4. Cucumbers - 0.4 tons; 5. Pepper - 1.5 tons; 6. Onions - 2.5 tons; 7. Harvest losses will not be because renters fully have gathered whole harvest of agricultural crops on the old site and at the same time have started processing and sowing of crops on a new plot of land.Planting on a new land plot began in March of this year, has already gathered the first harvest of agricultural products in the new land plot and began to plant the second harvest of vegetables and other agricultural products (see. photo from 27.06.2015). 5.ResponsibleAuthority MoES RT is the controlling authority for implementation of RAP. Hukumat of Pendjikent will be responsible for timely provision of equivalent land plot as compensation. 6. The source of budget and estimated cost In this case assessed material and social risks connected with the loss of sources of income, creation of new infrastructure and physical displacement provided in such cases, OP 4.12. At inspection of new land allocated to renters of farm "Mehnatobod" as compensation determined that the new land plots are located on the territory of the same Jamoat of Hasan Khalifa, and on its features identical to the previous land (irrigated arable land). In this connection, on significant material and social losses - loss of sources of income, creation of new infrastructure on use of compensated land, and physical displacement (means transmission of residence - home, infield, etc.) is no question. It is question only on changing of place of cultivation on the same territory of settlement thatindicates minimal impact of the project on the previous land users. 7.Schedule of resettlement Since allocated as compensation land plots for the renters of farm "Mehnatobod" are located on the territory of the same Jamoat of Khalifa Hasan and on its features is identical to the previous land plot (irrigated arable land) has changed place of cultivation of the land on the same territory of settlement.There were no significant material and social losses in the form of loss of sources of income, creation of new infrastructure on use of compensated land orphysical relocation of members of dehkan farm. MonitoringandEvaluation/ Sequential implementation of activities MoES and Hukumat of Rudaki district are the main agencies which are responsible for the implementation of this action plan and at the same time representatives of local khukumats and heads of dehkan farms will follow to this RAP. Specialist on Monitoring of MoES and representative of the Hukumat of Pendjikent will verify that all work on the provision of compensation (in the form of new land plot) will be made up to permission for beginning of civil work. Specialist on Monitoring and independent consultant on monitoring will present report on the implementation of this action plan. Monitoring of the object will be made within 6 months and one year, when it will be possible to compare the incomes with the previous one and which received from the new land plot. Regular reports on the progress of resettlement of actions will be submitted to the World Bank as part of regular project reports. At the end of the project a final report will be submitted to the World Bank. Monitoring of resettlement and keeping of records will be done by MoES. Monitoring and Evaluation will take place from the beginning of the project until the completion of all actions on resettlement. It is necessary to note that renters on a new land plot planning to gather harvest of vegetables and agricultural products more than in the previous land plot. At the end of autumn, after the harvest of this year we will be able to compare the income from the new land plot with the previous and make final assessment of RAP project on this object. 9. Grievance redress order In the case of grievance or protest PAP (person affected by the project) can address to: 1. In case if disputed issues cannot be resolved between the MoES, Local Hukumat (Jamoat) and PAP (person affected by the project) then the last may apply to the judicial authorities or to the Chairman of Hukumat of Pendjikent and any disputed issues will be resolved in accordance with the current legislation of the Republic of Tajikistan. Communities and individuals who believe that they are adversely affected by a World Bank (WB) supported project may submit complaints to existing project-level grievance redress mechanisms or the WB’s Grievance Redress Service (GRS). The GRS ensures that complaints received are promptly reviewed in order to address project-related concerns. Project affected communities and individuals may submit their complaint to the WB’s independent Inspection Panel which determines whether harm occurred, or could occur, as a result of WB non- compliance with its policies and procedures. Complaints may be submitted at any time after concerns have been brought directly to the World Bank's attention, and Bank Management has been given an opportunity to respond.
