The Open Access Entity (OAE), also known as the FSM Telecommunications Cable Corporation, has been established and is fully operational. The OAE is responsible for owning and operating the new cable system assets financed under the Project. The Yap cable successfully entered into service at the end of June 2018. The cable for Chuuk entered into service in April 2019. The Telecommunications Regulatory Authority (TRA) is established as the independent regulator of telecommunications. Regulations and rules dealing with licensing, spectrum, numbering, wholesale access and interconnection were finalized and promulgated in October 2019. The TRA is currently considering whether to declare submarine and terrestrial fiber optic communications facilities to be “bottleneck facilities” under the Act— 7/20/2021 Page 1 of 6 The World Bank Implementation Status & Results Report Pacific Regional Connectivity Program 2:FSM Connectivity Project (P130592) already declared as bottleneck facilities under the Act are towers and other supporting constructions for the provisions of radio communications services; poles, masts, ducts, conduits, inspection chambers, manholes and cabinets; and submarine cable landing stations. The public submission period closed on June 25, 2021 and a final decision is expected by September, 2021. The telecommunications market is newly competitive. Satellite provider Kacific has commenced operations via local resellers offering data services to subscribers in Chuuk, Pohnpei and Kosrae. An ISP has been licensed in Yap and is getting ready to offer retail services in the coming months. Another operator has also been licensed in Chuuk and plans to offer ISP services before the end of 2021.
