However, in spite of these delays, the project is still on track to meets its development objectives and targets as identified in the Results Framework by the Closing Date, i.e. July 31, 2016. The PIU is strongly encouraged to initiate legal action against the ICB2 and ICB3 Contractors in accordance with the relevant contract provisions. If legal action is initiated, both ICB-2 and ICB-3 contracts would be terminated, and the Bank proposes to include these contracts in a follow- up FVWRMP-II. Hence there will be no need to extend the project's Closing Date for one year, as it was proposed in the previous ISR. To date, some of the key PDO indicators have been either exceeded (e.g. “increase in yields for major crops, cotton and wheat”), or are close to be achieved (such as “decreased groundwater level”, “decreasing area with high GW mineralization”, and “reduced flooded settlement areas”). For example, while cotton production marginally reached target value, all other crops exceeded target values. The flooded area has been reduced from initial 67.4% to 33.2%, and is expected to considerably decline further until the end of the project. There is good progress reported on achievement of intermediate indicators as well. See details in the Results Framework. In view of the continued delays in the implementation of important contracts, the PIU was advised to exercise tight contract management and monitoring in the months ahead when contracts will reach their deadlines for completion. In addition, good progress needs to happen during the last full construction season before the project Closing Date in July 2016 – to ensure completion by the project Closing Date. As reported in the Implementation Support Missions (ISMs) of November 2013 and December 2014, implementation of contract ICB/2 continues to suffer from insufficient plant and staff, and the contractor has not fully mobilized. As a result, very limited work has been done. During the ISM of December 2014 the PIU had already been advised to seek legal advice to undertake legal action against the contractor if the situation remained unchanged by January 2015. The mission has confirmed that as of June 30, 2015, the contractor continues to be not fully mobilized. Contracts ICB-3 Lot 1 and Lot 2 have been awarded to the same contractor and have also suffered from an uncommitted Contractor who has demonstrated time and again no real intention to implement the works under the contract. The Contract end dates were 17 March 2015. Under contract ICB1, it was found that a number of people have been affected by project investments and have lost assets. While these project affected people have been compensated, this was not done on the basis of an approved Resettlement Action Plan. It was therefore agreed that the project needs to conduct an audit of these resettlement cases to make sure that adequate compensation has been paid to all project affected people. As a result, safeguard performance has been rated moderately unsatisfactory.
