Annex 8 Participatory Irrigation Development Project (PIDP; Ln. 7709-PH) 13th Implementation Support Mission May 23-June 7, 2016 Social Safeguards 1. As of this mission, seven (7) RAPs have been completed while six (6) are in different stages of implementation. The mission noted significant progress in RAP implementation particularly in the payment of compensation for PAPs in Region 2 systems, as shown in Table 1 below. (Table 2 provides additional details.) The positive change occured after DBM released the funds for all but one RAP and NIA Central Office immediately downloaded the funds to the relevant Field Offices to pay the project-affected persons (PAPs). 2. Good RAP implementation and documentation was also observed in THIRIS, Lupon IS and Batutu RIS where strong coordination with LGUs resulted in the improvement of shelter of PAPs. Particularly in Lupon RIS, the NIA team worked closely with the PAPs and the barangay LGU to provide better housing and location for PAPs and keeping their livelihood activities. (See Annex A for the photo documentation of RAP Implementation in Lupon.) 3. However, the mission also noted a number of implementation issues. During the field visit in Batutu RIS, the mission learned that the IMO made changes in the canal route in one section with about one kilometer length without informing the Bank and the PMO. The change resulted in avoiding 11 PAPs but also affecting a new set of PAPs whose exact identities and numbers, as well as the extent of impact, are yet to be established by the IMO. The civil works have been completed but only 199 PAPs have been paid. The remaining number of PAPs either belong to those whose papers are being processed or to the new set of PAPs. The Bank and the PMO called the attention of the IMO on this lapse. It was agreed that the IMO, with the assistance of the PMO and RO, immediately conduct an inventory of the new PAPs (and impacts) and submit request for payment to the PMO by July 15, 2016. Payment should be made within two weeks after PMO approval. Payments for the remaining PAPs should also be processed immediately, with the IMO exhausting all possible means to help PAPs comply with the requirements. 4. In the field visit in Maranding RIS, the mission learned that no payment has been made yet as the IMO is conscious about possible negative reactions if some PAPs get paid ahead of others. The IMO decided to withhold the payments for PAPs with affected crops and/or structures until the settlement for land acquisition is completed. While recognizing such a scenario has its own risks, the mission advised the IMO staff to immediately effect the payment for PAPs with affected crops and structures while at the same time work more proactively on the processing of payments for lands. Specifically, it was agreed that with the assistance of PMO Safeguards staff, Safeguards staff of Maranding RIS should immediately (not later than July 15, 2016) settle the payments of PAPs especially those whose crops and structures are affected. For PAPs whose lands were acquired by the project, IMO should seek further clarification from COA, Register of Deeds, Department of 1 Annex 8 Agrarian Reform (DAR) concerned staff (MARO, PARO, DAR-RO) on their status and seek legal advice thereafter on the requirements to ensure that only those required by law are asked from the farmers and unlock the bottlenecks for payment. 5. Livelihood restoration and livelihood assistance is an essential component of the RAP. As of this mission, a livelihood program is being implemented in THIRIS while two livelihood plans have been submitted to the PMO. The rest are still in the process of preparation or finalization. The mission called the attention of the PMO in expediting the remaining Livelihood Plan preparation. 6. The mission suggested in previous ISMs, particularly in the last (November 2015) ISM, the hiring of external monitor to evaluate RAP implementation. The Bank recommended the hiring of an external monitor to help the PMO improve its overall supervision and implementation, given its limited staff on Safeguards. The mission notes the slow progress in this activity as the PMO intends to start the hiring process only in June 2016 and enjoins the PMO to expedite this activity. 7. As there is a need to ensure completion of RAP implementation before project closing, it was agreed that the Bank and the PMO will conduct technical missions starting in August 2016. 8. Social Safeguards implementation was rated moderately unsatisfactory (MU) during the 12 th Implementation Support Mission due to slow progress in both RAP preparation and implementation and some non-compliance issues. While recognizing the significant improvements in RAP implementation in general, this mission retains the MU rating primarily because of the violation in the Batutu RIS RAP implementation. The Gender and Development (GAD) Framework for PIDP continues to guide staff from the PMO, regional offices and IMOs in implementing the project in a gender-sensitive manner. In the recent gender rating of Bank-assisted projects as required by the government, the project received a rating of 17.8/20 rating, indicating it is a gender-responsive project. Gender and Development training continues especially for IA members and officers.
