No I. PROJECT STATUS AND RATIONALE FOR RESTRUCTURING 1. Mozambique Mining and Gas Technical Assistance Project (MAGTAP) is a key tool for the Ministry of Mineral Resources and Energy (MIREME) to address key governance issues of the extractives sector. It is the only channel from the World Bank's perspective to remain engaged with the extractives sector in the country and help the country on managing safeguards challenges within a sound environmental and social framework, supporting financial advisory services to refinance the transactions which is key to help the country with debt sustainability and advancing knowledge on the mineral potential for promoting new investment mining projects. 2. Mining Governance Capacity Building and Reform. Component A aims to support second generation (post-year 2000) reforms in Mozambique’s mines and mineral sector to optimize its revenues. The component includes upgrades to mining cadaster systems, geodata collection and interpretation, tendering of mineral assets, reforms and capacity building for Artisanal and Small-scale Mining (ASM), reinforcement of state participation in mining concessions, and transaction advisory services for Large Scale Mining (LSM) operations and related infrastructure. These objectives continue to be relevant to the achievement of the PDO and have been performed in a satisfactory manner with the exception of the reforms and capacity building for ASM, which suffered a delay in 2017 due to having its funds earmarked for urgent needs in Liquefied natural gas (LNG) negotiations (Component B). The ASM strategy has been completed and presented to the MIREME council in 2019, and it is currently under implementation. 3. Natural Gas Capacity Building and Governance Reform. Component B endeavors to strengthen the development and governance capacity of major institutions engaged in the gas sector, allowing them to execute their mandates in a way that is conducive to investments, while ensuring that safeguards and safety criteria is met in accordance with international standards. The Directorate of Planning and Cooperation informed that the Liquefied natural gas adviser to MIREME was hired and is exercising his functions. Component B was instrumental in advising and furthering GoM’s negotiations under beneficial fiscal terms and conditions, especially in Areas 1 and 4. Otherwise, Component B continues to be relevant to PDO as it develops Mozambique´s oil and gas portfolio for Empresa Nacional de Hidrocarbonetos (ENH) and builds its capacity for effective and efficient negotiations. Furthermore, with the World Bank assistance, designing a unifying national extractives policy and roadmap to further the development of the sector, moving forward with aspects as important as i) implementation of the Strategic Environmental and Social Assessment (SESA) action plan, ii) a framework and capacity building on productive linkages and iii) upstream and downstream strategic planning, especially on the urgent topic of domestic gas use. Currently, the Project Management Unit (PMU) is hiring a financial advisor for Area 4 which would support ENH on negotiations of project financial arrangements including ENH’s debt. Support to ENH on strategic planning has been recently completed. Assistance to Instituto Nacional de Petroleo (INP) on negotiations (strategy, technical, legal, financial, marketing) for Area 1 and 4 is about to be completed. Support to INP on cost recovery audit is being implemented. 4. Cross-cutting areas Mining/Natural Gas Capacity Building and Reforms. Component C supports the Government’s cross-cutting mining and gas reforms to (a) strengthen the institutional and technical capacity of its agencies in revenue management and environmental and social management and (b) improve social accountability of the civil The World Bank Mozambique Mining and Gas Technical Assistance Project (P129847) society organizations (CSOs). A relevant activity, C232-C3 Extractive sector communication strategy, originally a responsibility of the Directorate for Planning and Coordination (DPC), is currently under elaboration by the Communication and Image Department. The component continues to be relevant to PDO success yet is still partly behind schedule. Most guidelines and tools are in place, including the Extractive Industries Transparency Initiative (EITI) action plan. There is a need for technical and legal support to facilitate effective and efficient dialogue amongst multi-stakeholder groups. The component has placed essential technical and infrastructural support to facilitate gas and mineral mine inspections, while improving communications amongst GoM agencies and with the extractive resource companies, which have shown significant and positive results in their technical reports. One such technical tool, under activity C230-C6, is the Cumulative Impact Assessment (CIA) guidelines currently being designed for implementation by the Ministry of Land, Environment and Rural Development (MITADER). The entity is hopeful that it will aid the GoM to realize interactive effects of existing projects in Tetê and develop and test CIA guideline methodologies in other areas affected by extractive sector projects. Furthermore, MITADER expects this will inform the formulation of legal instruments aiming to improve project sustainability management. Finally, environmental guidelines for Mining activities and Petroleum operations (Onshore and Offshore) were completed by MITADER, to assist and guide regulators to ensure that current Mozambican legislation is applied efficiently. These guidelines address environmental issues, as well as resettlement and compensation procedures that are part of the environmental licensing process for projects of this nature. Upgrade of the regulation for mining and gas involuntary resettlements is about to be finalized and the review of environmental quality standards, effluents and emissions is being contracted. 5. Cross-Sectoral Reforms. Component D supports the strengthening of the GoM’s capacity for integrating the mining and gas sectors into its broader economy through inter-ministerial coordination and developing strong economic links across sectors. Original activities have undergone much needed review during MAGTAP, redirecting them towards topics targeting domestic gas, with INP and ENH as lead entities. Nevertheless, being a cross-sectoral matter, domestic gas projects selection and management will be done jointly with MIREME and INP, with support from the Ministry of Economy and Finance , Ministry of Industry, the Ministry of Transport and Communications, and others. These changes are crucial for Mozambique´s growth, socially and economically, as they aim to establish a production and distribution system of affordable indigenously produced gas for the country. Making well-informed decisions in this matter will affect the next 40+ years of the development of Mozambique. Technical Assistance through MAGTAP could support and generate billions in revenues and development of new economic sectors through access to domestic gas. Further support is needed in updating the 2014 gas master plan and organizing a round-two tender for domestic gas allocation informed by best practices and lessons learned from other countries. Finally, facilitation for creating of a government-wide framework on productive linkages for both gas and mining sectors is still needed. Design of the national extractives local content program is ongoing and is expected to be completed by end of June 2021. Support to EITI implementation has been provided throughout the project implementation and currently the 10th EITI report has been contracted. Finally, implementation of both the updated communications strategy and the gender strategy are about to start. 6. MAGTAP has been one of the better performing projects in the portfolio since its effectiveness. The project remains on track to achieving all of its PDO and the extension to be processed will improve the government’s ability to negotiate major contracts. Several of the key institutions of MIREME (National Petroleum Institute/National Institute of Mines/National Directorate of Geology and Mines) staff have benefited from trainings in contract negotiations, both in gas and mining. 7. Overall implementation of MAGTAP is rated Satisfactory, and the project has achieved a number of its PDO and intermediate results indicators. Disbursement is currently at 68 percent and expected to be at 86 percent by December 31, 2021. There are no overdue audits for the credit and project implementation and progress ratings have been consistently satisfactory. The World Bank Mozambique Mining and Gas Technical Assistance Project (P129847) 8. The extension will allow MIREME to finalize ongoing activities as well as other tasks under procurement. The activities are very relevant to support improving key governance systems and capacity building on the extractive industries, especially on completing the processing of geological data, the regulatory capacity in relation to the gas projects and the action plan for ASM. It has been made clear with the GoM that all activities need to be completed within the proposed time, otherwise, the GoM will need to cover the expenses of pending activities after the closing date of the project. The key activities to be completed within the proposed time framework are outlined below. The World Bank task team has reviewed and supports the proposed project work plan until the end of 2022. The team is confident that it will be feasible to deliver the plan, recognizing current circumstances in Mozambique, in particular, the impact of COVID-19 on the ability to carry out project work in country. 10. The World Bank team proposes the following additional approach to ensure that the restructured project will keep the new timeline: a) Appointment of an international expert to enhance the MAGTAP supervisory team on a Short Term Consultancy basis. b) Obtain a commitment from the new Permanent Secretary at MIREME, who is the chairman of the MAGTAP project steering committee, that the MAGTAP´s Steering Committee will meet monthly going forward until the end of the Summer 2021 to supervise the final stage of the procurement plan. c) Obtain commitment from the Permanent Secretary on his personal involvement in the dialogue between the Project Management Unit (PMU) and the different beneficiaries on the procurement and execution of the different MAGTAP activities. II. DESCRIPTION OF PROPOSED CHANGES 11. The team seeks the approval of the Regional Vice President (RVP) to extend the project for 12 months from December 31, 2021 to December 31, 2022. The original project was approved by the Board on March 28, 2013 in the amount of US$50 million with an original closing date of May 31, 2020. An additional financing in the amount of US$28 million was approved on November 1, 2017 where the closing date of the original project was extended by 19 months to December 31, 2021. This additional financing of 12 months brings the total number of months extended to 31 months, thus requiring RVP approval. The World Bank Mozambique Mining and Gas Technical Assistance Project (P129847) 12. The proposed 12-month extension of the International Development Association (IDA) credit (IDA-51990) and IDA grant (IDA-D2390) was requested by the GoM on October 21, 2020 to help in the recovery of the delay as a result of the COVID-19 pandemic, which contributed to the inability to carry out most of the activities, thus compromising the timely achievement of MAGTAP’s objectives. 13. In parallel, the team is using this request from Mozambique to extend the end date of the project as an opportunity to review, discuss, and upgrade the results framework with the client. The need to review the results framework was identified as part of the effort to strengthen the monitoring and evaluation (M&E) capacity of the project management unit (PMU) undertaken by the task team that took over the supervision of the project two years ago. Since then, the team has hired an international M&E expert to strengthen the supervisory team and to coach and build capacity on M&E within the PMU. The World Bank has also agreed with MIREME, that they hire a local M&E expert to structurally strengthen the local M&E capacity of the PMU in this important final phase of the project. The international M&E expert has engaged with all the different beneficiaries to review the PDO level and intermediate result indicators relevant to each of them. This has led to the following proposed changes to the wording and the description of the interpretation of the PDO indicators. 14. The team is proposing to change the wording of certain indicators to better reflect how they have actually been monitored and evaluated over the years since the project became effective in 2013, and to document the exact interpretation of each of the indicators in the operations portal. These impacts in particular the following indicators: a) "Mines and quarries construction projects and gas project developments subject to technical inspections in line with international industry standards" - redefined to refer to industry best practice of checking compliance of new projects being developed with technical, environmental, and social regulations and standards and not, as the original wording suggested, regular inspection of such projects. b) "Mining and gas operations subject to annual cost and fiscal audits in compliance with the established fiscal regime" – redefined to reflect the extractive industries best practice of annual review of allowable cost deductions and tax calculations for concessionary projects. c) "Regular health and safety and environmental monitoring and control inspections to mines and gas projects in line with regulations for compliance and monitoring" – more precise wording as to what kind of inspections are carried out in the extractive industries. d) "ESIA and SIA guidelines published and disseminated for mining (LSM and ASM) and gas (if underway)" – the original wording was not grammatically correct. 15. The team also proposes to split the second original PDO level indicator with sub-indicators in two by adding a new indicator with sub-indicators: "Mines and quarries operations and gas project operations subject to regular technical inspections in line with international industry standards". This reflects the need to not just inspect projects under construction but also (regularly) inspect projects in operation. III.
