A recent successful multi-sector operation (SWAp for Parana Multi-sector Development Project – P126343) significantly reduced maternal and infant mortality, increased graduation rates in primary school, expanded access to clean water in poor rural areas, established a state-wide disaster risk management system and electronic management of water Jan 25, 2021 Page 2 of 14 The World Bank Parana Public Sector Modernization and Innovation for Service Delivery (P168634) use licenses, mapped state assets and strengthened tax administration. This Project will build on lessons from the SWAp and focus on strengthening institutions for evidence-based service delivery and expand digital services. This operation is a hybrid operation funded by a PforR loan and an investment project financing loan. This hybrid operation has two complementary components. The first component, which is financed by the PforR loan, will support the implementation of the key areas to improve public administration and delivery of public services with a focus the pandemic mitigation and recovery phases (“PforR component”). It will support five programs of the Borrower and budget lines existing in the Pluriannual Plan (2020 – 2023) and in the Annual Budget Law (LOA). The second component, which will be financed by an IPF loan, will provide instead technical assistance to strengthen the institutional capacity of different departments of the State of Parana government. The IPF component will support the following technical assistance activities: Environmental Management. Technical assistance will support the assessment of natural disaster and climate risks and vulnerabilities, including identification, modeling and monitoring rainfall spatial distribution, runoff formation and flood routing; and design of an information system and specifications for the acquisition of monitoring equipment. Public Investment Management. Technical assistance will support: an assessment of the PIM system, the investment portfolio and constraints in project preparation and implementation; development of a methodology and technical manuals for public investment management, including guidelines on project preparation, cost benefit analysis, environmental and social safeguards and management of climate change impacts; design of an electronic public Public Disclosure investment management system to allow for a structured way of following investment project proposals through preparation and implementation. It will also support the preparation of a monitoring and management platform of the regional development plans. Human Resources Management. Technical assistance will support the development of a strategic workforce plan, development of training and capacity building programs including coaching and mentoring, and a strategic review of the civil servant health insurance program (SAS) with the objective of ensuring continued coverage while identifying opportunities for cost reductions and savings. Digital Services. Technical assistance will support the implementation of a comprehensive mapping and in-depth analysis of digital services availability and use, including engagement with service users; and prepare an action plan for strengthening digital service availability and citizen’s access and uptake. D. Environmental and Social Overview D.1. Detailed project location(s) and salient physical characteristics relevant to the E&S assessment [geographic, environmental, social] The proposed IPF will be implemented in the State of Parana. Geographic and Environmental Features – Paraná is located in the South Region of Brazil, bound to the east by the Atlantic Oceans, on the south by the state of Santa Catarina, on the southwest by Argentina, on the west by Paraguay, on the northeast by the state of Mato Grosso do Sul and on the north and northeast by the state of São Paulo. It has a surface area of about 200.000 km2, 2.35% of Brazil’s territory. Geographically it covers close to 650 km on an east- Jan 25, 2021 Page 3 of 14 The World Bank Parana Public Sector Modernization and Innovation for Service Delivery (P168634) west axis (between the Atlantic Ocean and the border with Paraguay and Argentina), with a maximum distance between the north and the south of around 470 km (from the border with the State of Sao Paulo and that of Santa Catarina). Paraná is formed by different phytogeographical regions resulting from geomorphological and climate peculiarities of each region. The floristic composition is composed of the Atlantic Forest biome, which corresponds to different ecosystems, such as ombrophilous dense Atlantic forest, mixed ombrophilous forest, semideciduous seasonal forest, steppe, herbaceous vegetation, mangroves, "várzea" and rupestrian vegetation. There is also a remnant of the “cerrado” with savanna vegetation. The climatic conditions in Paraná range from tropical to sub-tropical and temperate zones, with temperatures ranging from 30°F to 80°F. The sub-tropical and temperate zones in Paraná get frost in the winter season (June-September). The state of Parana is well supplied by hydrological resources. A well-distributed river basin network makes Paraná one of the country's main hydroelectric suppliers. Parana's topography consists of a narrow coastal plain separated from the interior of the state by an abrupt wall: the Serra do Mar mountain range to the west of which are 3 successive plateaus. More than half of the state is above 2000 feet in altitude. The soils are generally fertile, although prone to erosion. Expansion of the agricultural frontier over the past decades has reduced the native vegetation. Socioeconomic Context - The state of Paraná shows good socioeconomic development figures compared to the national perspective, but inequality is high. With a population of approximately 11.5 million people (5% of the total Brazilian population). Its Human Development Index reaches 0.749 against 0.726 of Brazil. Parana also surpasses the national average regarding household per capita income with R$1,621.00 (around 300 USD) against R$1,438.00 in Brazil (around 265 USD). In June 2020, the unemployment rate of 9.6% was lower than in Brazil (13.3%). Nevertheless, Public Disclosure in 2018, 13.7% of the population was poor (living with less than 5.5 USD per day) and 2.7% was extremely poor (living with less than 1.9 USD per day). Economic inequality is high with the richest 1% accounting for 10.2% of the total mass of income, while the poorest 20% hold only 4.2% of the wealth. Around 3.5% of the state population lives in irregular urban settlements. The housing deficit in the state is 511,746 units, out of which 37,019 are rural or in traditional communities. Around 40,000 urban residencies are located in risk areas. In 2010, 15% of the state population was rural, mostly located in the central northern and central southern regions. Ethnically, the population is diverse comprising descendants of Europeans and Japanese; 26,559 indigenous peoples; 2,236 Quilombola families, 3,254,500 Afro-descendants (21.5 % live in the capital city Curitiba and 43% are homeless people). The illiteracy rate of people over 15 years of age is 4.6% (Brazilian rate is 6.6%). Data on connectivity (2016) shows that 85.5% of the population had access to the internet, and while 97.3% of those who have a university degree own a mobile phone, only 64.6% of those illiterate or have not completed elementary education. D. 2. Borrower’s Institutional Capacity The Paraná State has advanced environmental and water management laws, reflecting a political culture of strong environmental protection. However, there still room for improvements in operating procedures for environmental compliance and enforcement and a more proactive and preventive capacity. Bank-supported projects (Land Management Project, 1989-1997, Rural Poverty Alleviation and Natural Resources Management Project, 1998-2006; GEF grant for biodiversity 2003-2008) and Paraná SWAp (2014-2019) helped introduce sustainable agricultural practices and improved environmental and disaster risk management regulations Jan 25, 2021 Page 4 of 14 The World Bank Parana Public Sector Modernization and Innovation for Service Delivery (P168634) and systems. The Paraná has a disaster monitoring unit fully operational and provides ongoing real-time monitoring of disaster risks in the State. The overall activities supported by the last Bank-financed project (Parana SWAp) led to positive impacts on the environmental institutional capacity, such as improvement of environmental and water management, and disaster and risk management. Compliance with Bank environmental and social safeguard policies was assessed regularly by the IBRD team and reflected in the ISRs throughout the life of the Parana SWAp project. These ISRs consistently rated environmental safeguards compliance as Satisfactory and social safeguards compliance as Moderately Satisfactory. The institutional arrangement of the proposed IPF will be similar to the last WB financed Paraná SWAp Project (P126343), thus would include: (i) an environmental and social team at the Secretary of Planning that coordinates the whole project, and (ii) one focal point per each participating agency of the proposed IPF. Despite this will be the first ESF project for Parana State, the implementing agencies have substantial experience working with previous Bank- supported projects, and have a good track record of compliance with the Bank's environmental and social safeguard policies. Availability of human resources, knowledge of the ESF, the suitability of lines of communication and coordination mechanism between the different implementing agencies, needs of financial and logistical resources will be further assessed during Project's preparation, particularly in relation to the implementation of adequate stakeholder planning and implementation. This institutional assessment will also comprise external factors that could prevent the Borrower from carrying out the anticipated ES risk management tasks, e.g., coordination with institutions that have a Public Disclosure specific mandate on protecting the interests of Indigenous Peoples, on involuntary resettlement. Further to the assessment, mitigation measures, if needed, will be proposed and included in the ESCP, as necessary. II. SCREENING OF POTENTIAL ENVIRONMENTAL AND SOCIAL (ES) RISKS AND IMPACTS A. Environmental and Social Risk Classification (ESRC) Moderate Environmental Risk Rating Moderate Environmental risk rating for this Project is Moderate. The proposed IPF component is only supporting technical assistance (TA) activities. Downstream activities, flowing from the TA, will not be supported by the Bank-supported TA. The proposed IPF component will not support civil works either preparation of feasibility studies, technical, engineering design studies, and bid documents that may result in the construction of physical infrastructure. The proposed IPF technical assistance activities are: (i) Strengthening Public Investment Management (PIM) and regional development. It involves the following activities: (a) preparation of a methodology and technical manuals for public investment management, including guidelines on project preparation, cost-benefit analysis, environmental and social safeguards; (b) preparation of an electronic public investment management system to allow for a structured way of following investment project proposals throughout Jan 25, 2021 Page 5 of 14 The World Bank Parana Public Sector Modernization and Innovation for Service Delivery (P168634) the entire preparation process, including related studies (environmental and social risk management, cost-benefit analysis) until project readiness and final approval; (ii) Strategic and Efficient Human Resources Management and Capacity Building. Activities envisaged are a strategic review of the civil servant health insurance program (SAS) with the objective of ensuring continued coverage while identifying opportunities for cost reductions and savings. (iii) Environmental Innovation process: Activities envisaged would include the identification, modeling, and monitoring rainfall spatial distribution, runoff formation and flood routing. The activity would entail the purchase of equipment (radars, computers, etc.) to implement the physical and software structure needed, as well as consultancies to develop models and monitoring rainfall data and events. (iv) Expanding digital services. Activities envisaged include a comprehensive mapping and in-depth analysis of digital services availability and use in the State of Parana and the preparation of an action plan for strengthening digital service availability and citizen’s access as requested by the Federal government. (v) Monitoring and Management Platform of the Regional Development Plans. The platform will offer strategic information and project management tools to support the management of projects defined in the regional development plans and in the development of new initiatives. The proposed TA will comprise two main activities (a) elaboration of a guideline on the governance structure creation in the territories to support the finalization of the regional development plans and their monitoring, and training to relevant actors. The guidelines will foresee the Public Disclosure methodology of consolidating common goals and objectives, the feasibility of the proposed actions, joint coordination through the dialogue of relevant stakeholders; and (b) development and operationalization of the digital platform system and training workshops for the relevant stakeholders. Therefore, the proposed TA component will have statewide relevance and will focus on activities that will support the strengthening of GoP capacity. The proposed IPF focuses on institutional strengthening activities, development of artificial intelligence tools, analytical works and conceptual studies that may provide inputs for regulatory and political improvements. The component will not finance activities such as the preparation of feasibility studies, technical, engineering design studies and bid documents that may result in the construction of physical infrastructure. Considering the type of TA activities to be supported and expected outputs no environmental risk is envisaged either. Therefore, this Project is not complex and does not involve activities that have a high potential for harming the environment, and the GoP has a good regulatory framework and institutional capacity. As such, the proposed potential risks and impacts and issues is a Moderate risk. Social Risk Rating Moderate The Project is expected to have many positive social impacts on the population of Parana, including disadvantaged and vulnerable groups as its main objectives are intended to support the State government's efforts to improve public administration institutions to provide better public services and improve social and economic effects of the government COVID-19 recovery plan. The social risk rating is Moderate. The proposed IPF component will only support TA activities and the Bank will review and provide no objection to all the TA under the proposed IPF to ensure that it adequately reflects and Jan 25, 2021 Page 6 of 14 The World Bank Parana Public Sector Modernization and Innovation for Service Delivery (P168634) incorporates relevant requirements of the ESSs. Further, all the proposed TA will be consulted upon with relevant stakeholders, and pertinent stakeholder feedback will inform the finalization of the TA outputs. It should be noted that the implementation of the proposed TA is not part of the IPF. The outputs envisaged under the proposed TA are manuals, studies, guidelines, digital platforms, as further detailed in the previous section. This IPF will neither support civil works nor feasibility studies. The Borrower has a satisfactory capacity and performance track record on adequate social risk management, including stakeholder engagement planning and implementation, and such, the Social risk is deemed to be Moderate. The key potential social risks that need to be factored in the TA supported under the proposed IPF are the potential exclusion of most disadvantageous and vulnerable peoples from the planning processes and, therefore, the need to ensure inclusive and comprehensive stakeholder engagement throughout the TA development. The TA outputs to be developed will incorporate requirements for due diligence, assessment, and mitigation of environmental and social risks, in line with the ESSs, so that they are embedded, particularly in the electronic public investment management system being supported and the monitoring and management platform of the regional development plans and the regional technological plans. To avoid, minimize or mitigate potentially adverse social risks and impacts of the proposed TA activities being supported by the IPF component, the Borrower, with the support of the Bank shall, a) Ensure that the terms of reference for the preparation of the studies, plans, and other activities being supported by the IPF component incorporate the principles and requirements set out in the World Bank’s Public Disclosure Environmental and Social Standards ESSs 1-10. The Bank’s environmental and social specialists will review and provide no objection to such ToRs; b) Strengthen stakeholder engagement, through public disclosure and consultations, around the proposed activities supported by the IPF component. The Government will be required to prepare a draft Stakeholder Engagement Plan that shall be disclosed before the project's appraisal, in line with ESS10, that will pay particular attention to allow for opportunities to engage and get feedback from disadvantaged and vulnerable groups, such as women, IPs, and Afro-descendants. Strengthen environmental and social capacity through training to improve planning, monitoring, and reporting on the proposed TA activities. The Bank’s environmental and social specialists will provide support in this regard. B. Environment and Social Standards (ESSs) that Apply to the Activities Being Considered B.1. General Assessment ESS1 Assessment and Management of Environmental and Social Risks and Impacts Overview of the relevance of the Standard for the Project: The proposed Project will focus on strengthening institutions for evidence-based service delivery through technical assistance, as identified in Section C above. P, Thus, the proposed IPF component will not finance any civil works or feasibility studies, but rather Technical Assistance (TA) support for technological plans, digitalization of some public services, improvement of current procedures, programs and policies to improve GoP service delivery. Jan 25, 2021 Page 7 of 14 The World Bank Parana Public Sector Modernization and Innovation for Service Delivery (P168634) None of them foresee any infrastructure works or other on-the-ground activities. The proposed TA will not finance any downstream future investments. The technical assistance activities do not involve management of hazardous materials and substances. Considering the type of technical assistance activities to be supported and expected outputs no direct impacts on ecosystem services are envisaged. On the environmental front, the proposed activities are focusing on capacity building and will not involve any physical infrastructure. However, some of them are related to procurement of some ICT software and hardware to increase existing performance of government services system. Most of the ICT procurement is planned to be for virtual services or software. Therefore, the proposed IPF is not expected to generate significantly more e-waste than would be the case in the absence of the project. Even if the servers were to be physically installed, which is not the plan, they would augment existing capacity, not replace it. There is likely to have no large-scale, significant and irreversible adverse direct impacts and/or downstream implications on the environment. It is not expected to pose a risk of environmental pollution and degradation of natural resources (air, soil, water). It is not expected to affect biodiversity or habitats, either positively or negatively, directly or indirectly, or depend upon biodiversity for its success. The Project is not expected to have negative impacts on native forests. It is expected the state's capacity to manage natural resources and disaster risk prevention will be enhanced from project implementation. Potential social risks and impacts related to this proposed TA relate to the downstream use and implications of the Public Disclosure implementation of some of the foreseen activities such as the electronic public investment management and the monitoring and management platform of the regional development plans, the technological plan, digitalization of services. Potential downstream social risks include not fully inclusion of most disadvantageous and vulnerable people in the process of planning or implementation of the activities. Other potential downstream risks and impacts are analyzed under the social risk section and other relevant Environmental and Social Standards, including ESS7 and ESS10. These issues and risks will be considered when providing the TA by incorporating relevant requirements of the ESSs in the TORs and reviewing and approving the final TA outputs. This IPF will not support any downstream activities or use of the outputs being developed under the proposed IPF TA. Following the World Bank Environmental and Social Framework, when designing and implementing activities, the GoP will ensure: (i) identification and assessment of groups or individuals that may be affected by these activities that may be disadvantaged or vulnerable as well as identification of differentiated mitigation measures, as relevant will be included as part of the terms of reference of the relevant activities; (ii) promote broad stakeholder engagement and participation in a manner proportionate to the implications envisaged as potential outcomes of the activities; and (iii) review the terms of reference, work plans or other documents defining the scope and outputs of these activities, ensuring that they are drafted so that the advice and other support provided is consistent with ESSs 1-10. These guidelines will be included in the Project’s Environmental and Social Commitment Plan (ESCP). Areas where “Use of Borrower Framework” is being considered: The use of the Borrower Framework is not being considered in replacement of the mandatory environmental and social requirements of the Bank through investment project financing (IPF). Jan 25, 2021 Page 8 of 14 The World Bank Parana Public Sector Modernization and Innovation for Service Delivery (P168634) ESS10 Stakeholder Engagement and Information Disclosure ESS10 is relevant. At this stage of this TA preparation with the initially planned activities, the main stakeholders include employees at government secretariats and agencies involved; urban/rural families, and other parties that would be affected by the digital platforms for investment and monitoring and management of the regional development plans; users of the public services to be digitalized; and health sector professionals. Other interested parties are the press, non-governmental organizations, and the private sector. The SEP will incorporate a stakeholders mapping with suggested methods of engagement throughout the Project's life to guide the Borrower in the interactions with a wide range of affected and interested parties regarding the Project's activities. The SEP preparation will go through the following questions: a) Has there been meaningful public dialogue, engagement, consultation, and disclosure in the past about the Project and its associated ES risks and impacts? b) Are project stakeholders likely to exhibit widely divergent views on the need, objectives or activities defined under the Project? c) Is the Project likely to affect disadvantaged or vulnerable individuals or groups who would require specialized approaches to participation or consultation for the Project? Public Disclosure d) Is the Project likely to face any barriers to information disclosure, transparent sharing of project information among stakeholders, or other aspects that could affect meaningful consultations? e) Does the Borrower or implementing entity have a positive performance track record in engaging with stakeholders and the use of grievance mechanisms in similar projects? f) Is there a potential for prejudice or discrimination in accessing project benefits for those who may be disadvantaged or vulnerable? This SEP will aim to: a) facilitate timely access to information related to the Project and its environmental and social risks and impacts to affected and interested parties b) benefit from the Project's support for any communication activities. The project's SEP would include the elaboration and implementation of a communication strategy for vulnerable individuals and social groups with a gender-based approach, and reasonable accommodations for persons with disabilities and adaptation for low literacy for the case of the technical plans and other potentially affected parties by the digital platforms for investment and monitoring and management of the regional development plans. The approaches to be taken in the communications ensure that information is meaningful, timely, accessible to affected stakeholders; addresses cultural sensitivities and challenges deriving from gender, illiteracy, disability; and other cultural barriers. c) Facilitate broad, inclusive, and comprehensive public consultations with proposed project stakeholders, including vulnerable and marginalized groups. d) Access to a grievance mechanism for the project, in line with ESS10. B.2. Specific Risks and Impacts Jan 25, 2021 Page 9 of 14 The World Bank Parana Public Sector Modernization and Innovation for Service Delivery (P168634) A brief description of the potential environmental and social risks and impacts relevant to the Project. ESS2 Labor and Working Conditions ESS 2 is relevant. Project activities will require the hiring of full-time, part-time and temporary consultants, trainers and others (direct workers). The State Government will develop a Labor Management Procedures in accordance with the requirements of ESS 2. Some core functions of the Project will be executed by government civil servants and they will remain subject to the terms and conditions of their existing public sector employment agreement and, therefore, ESS 2 will not apply to them, except as set out in ESS2 para 8. As part of the LMP, a grievance mechanism accessible to Project Workers will be established that it is proportionate to the nature and scale of the proposed technical assistance activities and accessible for all Project Workers to raise workplace concerns. This grievance mechanism will be provided separately from the Grievance Mechanisms required under ESS10. The grievance mechanism will not impede access to other judicial or administrative remedies that might be available under the law or through existing arbitration procedures, or substitute for grievance mechanisms provided through collective agreements. ESS3 Resource Efficiency and Pollution Prevention and Management The ESS 3 is relevant. Public Disclosure Based on the initial environmental and social assessment, the expected activities will not involve construction works/service operations that may lead to adverse impacts related with pollution and resource efficiency. The project is not considered to be a major consumer of energy, water or other natural resources and its risks for GHG emissions are not considered substantial. It is recognized that increase existing government digital services and platforms, and electronic systems would generate electronic waste and consume finite natural resources, but it is no expected to generate significantly more e-waste than would be the case in absence of the Project. Nevertheless, the studies and terms of reference (ToR) for the projects and interventions resulting from these technical assistance activities shall consider issues such as use, disposal, and/or recycling of material related to the electronic systems. The ToR for public investment (PIM) system preparation, in line with international practice and the ESSs, will incorporate climate change considerations and the identification of principles of opportunities for cleaner government investments. The proposed system will keep track of public investment projects through the preparation cycle up to approval and through implementation, helping to monitor and prevent potential risks and impacts associated with these projects. ESS4 Community Health and Safety This standard is relevant. The IPF will not support any civil construction, new buildings, or structural elements. The technical assistance activities do not involve the management of hazardous materials and substances. Considering Jan 25, 2021 Page 10 of 14 The World Bank Parana Public Sector Modernization and Innovation for Service Delivery (P168634) the type of technical assistance activities to be supported and expected outputs no direct impacts on ecosystem services are envisaged. Nevertheless, the content of terms of reference (TOR) for the studies under the proposed IPF should include adequate assessment of environmental and social aspects to anticipate and minimize risks and impacts that reallocate assets and services may have on users, workers, and communities as well as to ensure universal access to them. ESS5 Land Acquisition, Restrictions on Land Use and Involuntary Resettlement ESS5 is relevant for this TA. Despite this TA will not finance any infrastructure works that would involve land acquisition, restrictions or uses neither directly lead to involuntary resettlement, the implementation of the digital platforms for investment and the monitoring and management of the regional development plans, can lead to downstream social implications that may eventually have impacts on people's livelihoods, including any type of resettlement either due to future investment works or preventative moving under the disaster risk management or involuntary. As such, the TORs for any TA that has such implications will incorporate the requirements of ESS5 and the outputs of the TA will be reviewed to ensure consistency with the ESSs. The proposed TA will not finance any downstream use or works flowing from the outputs of the proposed IPF TA. ESS6 Biodiversity Conservation and Sustainable Management of Living Natural Resources Public Disclosure ESS6 is relevant. This TA IPF component will not potentially directly affect biodiversity or habitats, either positively or negatively, directly or indirectly, or depend upon biodiversity for its success. The Project does not intend to invest in the forest sector, will not support any forest-related activities, or purchasing natural resources commodities. The Project does not intend to invest in the forest sector, will not support any forest-related activities, or purchasing natural resources commodities, including food, timber, and fiber that are known to originate from areas where there is a risk of significant conversion or significant degradation of natural or critical habitats, but using resources (like paper, energy, and public offices) more efficiently, the Project may have some direct benefits to living natural resources. The expected improvement of comprehensive digital government services, including PIM and the platform to monitor implementation of the regional plans would help to evaluate compliance with environmental regulations for sustainable management of living natural resources. TA's activities include indigenous peoples since they are present in the Parana State. The social impacts of the TA on indigenous peoples would be positive as it is expected for all Project’s beneficiaries. There are not any TA activities likely to be controversial or contentious with Indigenous Peoples groups. The majority of the indigenous people in Parana belong to the Kaingang ethnic group. According to the National Foundation (FUNAI), there are 26 indigenous lands spread over 19 municipalities of the state. They belong to the Guarani (Kaiowá, Mbya, and Nhandeva), Kaingang, and Xetá peoples. An assessment of the opportunities and barriers to ensure appropriateness of communications in outreach with Indigenous Peoples, adequate culturally indigenous people's participation, and tailored channels for grievances will be carried out during Project's preparation as part of the SEP development. These and other aspects of ESS6 will be incorporated in the ToRs. ESS8 Cultural Heritage The standard is relevant. The proposed technical activities are not expected to include site-specific activities and technical activities to be supported will not include, directly or indirectly, excavations, demolition, movement of earth, flooding, or other changes in the physical environment. Therefore, expected activities are not likely to have risks or impacts on tangible cultural heritage. However, the component would support the updating of a registry and information system for public assets, that Public Disclosure could include public monuments and historical buildings. Through the TOR for the information system and Environmental and Social Commitment Plan, the potential impacts of the information system and future use strategy to be developed by the proposed technical assistance activities on any public buildings of cultural or historical value will be determined and mitigated. The GoP will also implement documentation and protection of historical, architectural assets, in compliance with the requirements of this standard and in compliance with the guidelines defined by the National Institute for Historical and Cultural Heritage (IPHAN).
