III .. · Socialist Republic of Vietnam The World Bank Energy of Vietnam (EVN) Rural Distribution Project, Soc Trang subproject DEFINITION OF TERMS Cut-of-date The date of starting of inventory of losses during preparation of the RP. Displaced Persons and local communities will be informed of the cut-off date for each Project component, and that anyone moving into the Project Area after that date will not be entitled to compensation and assistance under the Project. Eligibility Any person who at the cut-of-date was located within the area affected by the project, its SUb-components, or other subproject parts thereof, and would: (i) have formal legal rights to land (including customary and traditional rights recognized under the laws of the country); or (ii) not have formal legal rights to land at the time the census begins but have a claim to such land or assets - provided that such claims are recognized under the laws of the country or become recognized through process identified in the resettlement plan; (iii) not have legal nor recognizable by laws rights to the land they are occupying, they live or/and have properties/assets within the project areas before the cut-off date. Persons covered under (i) and (ii) are provided compensation for the land they lose and other assistance at full replacement cost. Persons covered under (iii) are provided resettlement assistance in lieu of compensation for the land they occupy, and other assistance, as necessary, to achieve the objectives set in this PF, if they occupy the project area prior to a cut off date. Persons who encroach on the area after the cut-off date are not entitled to compensation or any other form of resettlement assistance. Replacement cost Is the term used to determine the amount sufficient to replace lost assets and cover transaction costs. For loses that cannot easily be valued or compensated for in monetary terms (e.g. access to public services, customers, and supplies; or to fishing, grazing, or forest areas), attempts are made to establish access to equivalent and culturally acceptable resources and earning opportunities. When domestic laws do not meet the standard of compensation at full replacement cost, compensation under domestic law is supplemented by additional measures necessary to meet the replacement cost standards. Resettlement Is the general term related to land acquisition and compensation for loss of asset whether it involves actual relocation, loss of land, shelter, assets or other means of livelihood. . Soc Trang subproject EXECUTIVE SUMMARY 1.1. Introduction 1. The overall objective of the Rural Distribution project is to contribute to the GOV' poverty alleviation program in the rural areas by providing basic infrastructure services i.e. electricity: improve the reliability and quality of medium voltage service to targeted retail electriCity distribution systems. The project achieves this though investment in rehabilitating and increasing the capacity of existing distribution lines and substations and standardizing them to 22, 35 and 110 kilovolts (kV)'. It enables distribute systems to meet the growing demand more effiCiently, provides better quality and quantity of electric power for productive uses, and reduces power system losses. 2. PC2, on behalf of EVN, will develop the RD subproject in Soc Trang province that traverses 33 communes, and 3 townships belong to 6 districts. It comprises of: (i) Rehabilitation of 126.71 km MV distribution lines, and, (ii) Refurbishment/replacement of Single-Phase and Three-Phase transformer stations. 1.2. Impacts on Ethnic Minorities 3. The results of the Inventory of all Losses show that there are 3 districts with 5 communes will experience project's direct resettlement impacts on certain portion of its ethnic minority households (HHs). They will likely impose both direct, negative - resettlement - and positive social impacts on ethnic minority DPs and their communities. These districts include: My Tu, Vinh Chau and Nga Nam. Among them, district I\Iga Nam has only 1 Chinese ethnic HH to be impacted. 4. The subproject will only pose marginal resettlement impacts on the local communities, including ethnic minority DPs. The total number of ethic minority DPs impacted by Soc Trang subproject is marginal (127 HHsl DPs with 496 people). No one is severely impacted. The most of EM DPs are located in district My Tu. The subproject will acquire only 140 m2 of garden land of 35 EM's HHs in total. The remained acquired areas (8,240 m2) are temporarily impacted. The project will not pose any impacts on houses or secondary structures. ... 1.3. Ethnic minority Development Plan 5. Following the guidelines of OP 4.10., this EMP has been prepared for a/l the areas that involve ethnic minorities within the subproject to ensure that: ,..' (i) the development process fosters full respect for their dignity, human rights, and cultural uniqueness; Oi) the ethnic minorities do not suffer adverse effects during the development process, and (iii) the ethnic minorities receive culturally compatible social and economic benefits. 6. This EMP has prepared based on the project approved Strategy for Ethnic Minorities, "', which follows the WB's Policy on Indigenous People (OP 4.10) and GOV's Policies for EM. The guidelines seek to ensure that ethnic minorities are well informed, consulted and mobilized to . participate in the sub - projects to be supported by Rural Distribution. Their participation can either provide them benefits with more certainty, or protect them from any potential adverse impacts of sub - projects to be financed by the Project. ... Socialist Republic of Vietnam The World Bank Energy of Vietnam (EVN) Rural Distribution Project, Soc Trang subproject 1.4. Ethnic Minorities in the Soc Trang Subproject areas 7. Soc Trang is one of the two provinces with the largest number of Khmer ethnic minorities in the Mekong Delta region. The Khmer population's share is nearly 29% in Soc Trang province. Hoa (or Chinese) ranks the second in number among the local minorities groups following the Khmers in Soc Trang, comprising 5.7% of the provincial total population. In some affected areas, Hoa ethnic group dominates in district's total population Generally, the Khmers occupy more or less remote communes and villages than Kinhs, while Hoa either are tighten to Khmers group or tend to concentrate in urban places where they can better engage in commercial activities. 1.5. Socio-economic conditions of the Ethnic Minorities DPs 8. The household agricultural land holding of affected ethnic minority farmers is rather fair, compared to the local Kinhs, while, the project's land acquisition does not implicate any severe impacts on local farmers, including ethnic minorities. 9. Agriculture, fishery and hired works are the most important occupations and income sources for predominant part of local ethnic minorities. Trade and service mainly attract Hoa or Kinh groups than Khmers. 10. All the affected ethnic minority communes have access to electricity and other basic technical infrastructure. Most of the local ethnic minority population has access to safe water, electricity. Currently. in communes of ethnic minorities, housing development program for the poor and ethnic minorities, safe water and sanitation development projects, development of new, flood protecting, residential settlement sites for flood-prone areas are widely implemented, all contributing to improving living conditions of ethnic minorities in Mekong Delta as a whole and Soc Trang province as particular. 1.6. Legal Framework As mentioned above, this plan is developed based on OP 4.10 on Indigenous People of the World Bank and Policies for EM of GOV. 11. The World Bank's OP 4.10. on Indigenous People emphasizes that the strategy for addressing the issues pertaining to indigenous peoples must be based on informed participation of indigenous people themselves. Thus identifying local preferences through direct consultation and incorporating indigenous knowledge into project approaches are core activities for any project that affect indigenous people and their rights to natural and economic resources. Thus, starting at an early stage, a specialist experienced in ethnic minority issues will work to ensure that they are consulted throughout the project cycle. 12. Vietnam Law and Vietnam Constitution (1992) have clearly stipulated on Equality right of ethnic people. One of the most important policies in relation with ethnic groups is the Government Guidance NO.525ITTG on 02/11/1993 regarding in detail on implementation guiding of development in high land areas and ethnic areas with the main points (a) develop infrastructure especially transportation road system and fresh water supplying, (b) step by step overcome the lack of food and (c) consolidate of education system; adjust education program basing on characteristic of provinces; create favourable conditions and support the irregular education program and develop internal economic force. This EMP is based on the results an inventory of all potential losses caused by the Soc Trang Subproject and a household socioeconomic survey of 10% of the ethnic minority DPs, reviews of secondary literature related to ethnic minorities in the proposed project areas, and intensive stakeholders consultations, including interviews and group discussions with local authorities at different levels and with impacted ethnic minority DPs and their communities. 14. The information dissemination was made on the locations of the project and proposed policy, and participants were requested to assess project's possible adverse impacts, and propose mitigation measures and development programs. 15. Through consultations with and participation of local authorities and EM in the project affected areas, there were indentified potential adverse impacts by the project as below: Loss of land and attached properties Electric shocks and safety; Environmental pollution in the construction period; disturbance by the construction and construction workers to villages. 16. All of the feedback has been integrated in this EMP and RP (EMP and RP). 17. The EM DPs will be entitled to full compensation and relevant rehabilitation meas ures for all their losses in equitable manner as for other impacted groups. Special resettlement provisions for ethnic minorities will be taken to ensure consideration of impacted ethnic minority people's views on various issues and to represent their legal rights. 1.8. Development Activities 18. The Ethnic Minority Plan (EMP) is developed not only for DPs who are directly affected by land acquisition but also for the ethnic minorities who are living in the project affected areas. 19. Following development activities/programs are proposed to be implemented for EMs in the Project areas: 1. Project's information Dissemination ... 2. 3. Training on agricultural extension (cultivation and animal husbandry) Development activities will be carried out in languages suitable for local EMs. Specific . compensation and resettlement information dissemination will be given to EM DPs in accordance with the RP's information implementation schedule. .. 1.9. Institutional Arrangement .. 21. Institutions involved in RP implementation of Soc Trang subproject are also responsible for implementation of this EMP . Details of institutional arrangement are described in Chapter 6 of the RP. 22. To implement this EMP smoothly, PC2, PMB and Soc Trang PPMU will: Power Company 2 Final Report. December 2008. Power Engineering & Consulting Center Socialist Republic of Vietnam The World Bank Energy of Vietnam (EVN) Rural Distribution Project, Soc Trang subproject - Assigning adequate number of staff for EMP implementation and supervision - Hiring qualified personnel for implementing EMP . - Establishing field offices for smoothly EMP implementation. - Periodical monitoring the EMP implementation. - Maintain transparency in implementation through information campaign. - Ensure that EM leaders are represented in local RP and EMP committees. 23. Implementation of the EMP s will be carried out in close collaboration with ethnic minorities and local authorities (local Committee for Ethnic Minorities and Mountainous Areas, Resettlement Committees, the Land Departments etc.,) and local mass organizations. The Project social scientist (anthropologist! sociologist) will be responsible for assisting in planning, coordinating and supervising EMP implementation. He/she will also be responsible for training PMB and Soctrang PPMU, and local authorities involved in implementation of the EMP . 1.10. Monitoring and Evaluation 24. The implementation of RP/EMP shall be constantly supervised and monitored by PC2 PMB in co-ordination with local Peoples' Committees. 25. An independent consulting agency contracted by PC2, with no W8's objection, for external monitoring of the RP'and EMP implementation. 26. The selected independent external monitoring agency shall begin supervision and monitoring activities from the beginning of the implementation phase. Details on supervision and monitoring responsibilities and indicators are described in this EMP and the RP of this subproject. 1.11. Cost and Budget Plan 27. Cost estimate for some special programs/actions of EMP is VND 323,500,000 (equivalent 20,000 U$D) with the budget from the counterpart of EVN. 1.12. Implementation Schedule: 28. The EMP implementation schedule will be coordinated with the subproject implementation. A complete implementation schedule will be detailed in the EMP. All social impact assessment (SIA) and consultation meetings will be undertaken before subproject deSigns are prepared. Compensation for land acquisition will be satisfactory completed at least one month prior to start of civil works. The overall objective of the Rural Distribution project is to contribute to the GOY' poverty alleviation program in the rural areas by providing basic infrastructure services i.e. electricity: improve the reliability and quality of medium voltage service to targeted retail electricity distribution systems. The project achieves this though investment in rehabilitating and increasing the capacity of existing distribution lines and substations and standardizing them to 22, 35 and 110 kilovolts (kV)'. It enables distribute systems to meet the growing demand more efficiently, provides better quality and quantity of electric power for productive uses, and reduces power system losses. Technical assistance will complement the physical investment by supporting the development of the PCs into modern power distribution utilities. 2. The project has seven components, six of which are aimed at improvement of MV service in the territory of a participating Power Company (PC). Each of the six components may contain two types of subproject involving new construction, rehabilitation, strengthening or a combination of any of the three, of: (i) a 11 of the 22 or 35 kV system requiring improvements within a single province falling within the territory of a participating PC; or (ii) a single substation or line at the 110 kV level feeding the 22135 kV systems in rural areas within a province or provinces falling in the territory of a participating PC. A seventh component will support the corporate development of selected PCs through technical assistance. 3. The project is implemented under the control of EVN, to which responsibility has been delegated by the Ministry of Industry and Trade (MolT), EVN's supervising ministry. Within each participating PC, the responsibility for implementation lies with one or more Project Management Boards (PMBs) or specialized investment departments. In the larger PCs, which have territories covering several provinces, the PCs' PSDs will be involved. 4. The proposed Soc Trang RD Subproject covers 33 communes, and 3 townships belong to 6 districts of Soc Trang province. An Inventory of all Losses and a Socioeconomic survey of DPs were conducted to identify and quantify resettlement impacts, which serves as the basis for developing a RP for the subproject. The results of the IOL show that there are 3 districts with 5 communes will experience project's direct resettlement impacts on certain portion of its ethnic minority households (HHs). They will likely impose both direct, negative resettlement - and positive social impacts on ethnic minority DPs and their communities. These districts include: My Tu, Vinh Chau and Nga Nam. Among them, district Nga Nam has only 1 Chinese ethnic HH to be impacted. 5. The subproject will mainly. pose marginal resettlement impacts on the local communities, including ethnic minority DPs, the total number of ethic minority DPs impacted by Soc Trang subproject is marginal (127 HHsl DPs with 496 people). The most of them are located in district My Tu. A number of special efforts were made during the project preparation, which should be continued during the implementation stage through improved designs, ... construction measures, and appropriate civil work implementation schedules in order to avoid unnecessary negative impacts. However, certain negative, land acquisition impacts are unavoidable. .. 6. In such a case, the WB policy on Ethnic Minorities (OP 4.10.) requires a preparation of an EMP for the project. This EMP is based on the results an inventory of all potential losses caused by the Soc Trang Subproject and a household socioeconomic survey of 10% of the ethnic minority DPs, reviews of secondary literature related to ethnic minorities in the proposed project areas, and intensive stakeholders consultations, including interviews and group discussions with local authorities at different levels and with ethnic minorities. . 2 Project Impacts on Ethnic Minorities 2.1 Land Acquisition and Resettlement Impacts The RD subproject in Soctrang province will traverse 33 communes, and 3 townships belong to 6 districts. (Pis. see Map of Project Areas). The efficiency improvement of the 22 kV power distribution networks: in the project areas of Soc Trang province comprises of: I. Rehabilitation of MV distribution lines: Replacement 126.71 km MV transmission lines, including: (i) Refurbishment/Replacement: 47.3 km of 3-phase D/L. (ii) Upgrading/Replacement: 62.51 km from Single-phase to 3-phase D/L (iii) Refurbishment/Replacement: 7.6 km of 1-phase D/L; (iv) Replacement of 2.1 km of 3-phase XDM (v) Replacement of 7.2 km of 1-phase XDM Average distance of poles varies from 70 to 80 m, depending on local topography II. Refurbishment/replacement of transformer stations: (i) Single - phase Transformer station: 04 stations/145 kVA; (ii) 3 - phase Transformer station: 01 stations/45 kVA The Soc Trang RD subproject does not cause severe resettlement impacts on ethnic minorities: The total number of ethnic minority DPs is 127 HHs, making 27.1% of the Subproject total APs number. Affected ethnic minority are from 5 out of total 17 subproject communes, belonged to 3 districts out of total 6 subproject districts. The impacts on them all are marginal as most of impacts on their land will be temporary, some HHs of Ethnic Minorities will lose a minor area of. garden land permanently for constructing of towers/poles and substations. The rest area is lost temporarily in ROW or occupied during construction works. Therefore, the SUbproject would not cause any culturally specific impact on the affected ethnic minority households and the nature of impacts does not result in community-wide socio-economic effects. 8. Of these, there only 35 DPs (with 139 persons) will be adversely impacted through permanent loss of garden land. meanwhile temporary land acquisition involves 113 EMs' DPs. The number of EM HHs losing crops and trees are 127. No any EMs' DPs experience loss of house and/or structures. All the EMs DPs of the subproject are marginally affected. The project doesn't implicate impact on house or secondary structures on EMs. 2.1.4 Impacts on Crops and Trees 12. There are 127 ethnic minority HHs whose trees (515 trees of different types) and crops (8,240 m2) will be lost due to the project development. (See Table 2.4 4). According to the results of the consultation and focus group discussions, most of the local ethnic minorities fully support the project investment, even if they have to give up some of their land. Most of the PAPs think that the proposed Rural Power Redistribution Soc Trang Subproject will bring them mainly benefits rather than negative impacts; they think· the project will positively impact their living and economic conditions, and the negative impacts will be reasonably non-remarkable for the most part. Soc Trang subproject supply service will rather bring benefits to them, than pose negative impacts. They hope the project will improve the power supply service, improving lighting and conditions for socialization in the community. Efficient and reliable power supply at lower cost would reduce extra expenditure for power, increase saving for other vital needs. 14. Besides of common benefits that the project may bring to all citizens, according to the ethnic women, they can also benefit more and differently: a reliable power service may make easier for the women to fulfill their house works, family responsibilities According to the EM women consulted, many burden of works currently lay on their shoulder, for example the most works related to harvesting, drying and storing agricultural products used to be the tasks of women. Available electriCity can allow to use mechanical tools, machines to reduce their, women's, workload and hardness, meanwhile releasing times for women to rest, to socialize and participate in community activities. In general, it can contribute to improve the living, social and economical status of EM women in family and in society. 3 Legal Framework 15. This plan is developed based on OP 4.10. on Indigenous People of the World Bank and Policies for ethnic minorities of the Government of Vietnam (GOV). 3.1 World Bank Policy 16. According to the WB's definition, ehnic minorities (or Indigenous People) are social groups with a social and cultural identity distinct from the dominant society that may make them vulnerable to being disadvantaged in the development process. Their main speCific features are: (a) a close attachment to ancestral territories and to the natural resources in these areas; (b) self-identification and identification by others as members of a distinct cultural group; (c) an indigenous language, often different from the national language; (d) presence of customary social and political institutions; and (e) primarily subsistence-oriented production 17. The World Bank's OP 4.10. on Indigenous People emphasizes that the strategy for addressing the issues pertaining to indigenous peoples must be based on informed partiCipation of indigenous people themselves. Thus identifying local preferences through direct consultation and incorporating indigenous knowledge into project approaches are core activities for any project that affect indigenous people and their rights to natural and economic resources. Thus, starting at an early stage, a specialist experienced in ethnic minority issues will work to ensure that they are consulted throughout the project cycle. 3.2 Vietnam's Laws 18. The most important government pOlicies in relation to ethnic minorities includes: .. The Constitution of the Socialist Republic of Vietnam of 1992. iii. Article 5 of the Constitution of the Socialist Republic of Vietnam of 1992 stipulates a policy of no discrimination and equality for ethnic minorities: ". Power Company 2 Final Report. Soc Trang subproject "The Socialist Republic of Vietnam is a united nation having many nationalities. The State implements a policy of equality and unity and supports the cultures of a/l nationalities and prohibits discrimination and separation. Each nationality has the right to use its own language and characters to preserve their culture and to improve its own traditions and customs. The State carries out a policy to develop thoroughly and gradually improve the quality of life of ethnic minorities in Vietnam physically and culturally. " Article 94 in the Constitution states that the Ethnic Minorities Committee has the right to submit proposals, plans or related issues of indigenous peoples to the Assembly, monitor, control the implementation of national policies, development programs on various areas such as, education, health care, etc. 19. The Government Guidance NO.525mG issued by Prime Minister on 2/11/1993, guiding implementation of development in the highland and ethnic areas. Its main points were: · Develop infrastructure especially transportation road system and fresh water supply; · Increase food security; · Consolidate the education system, adjust education program based on the characteristics of provinces, create favorable conditions, and support the non-formal education programs; and · Develop the internal economy. 20. In 1994, the Committee for Ethnic Minorities and Mountainous Areas (CEMMA), an agency directly under the office of the Prime Minister, was assigned as the coordinator for Instruction 525, which significantly increased the role of CEMMA in the development of ethnic minorities. 21. In November 1995, the Framework for External Assistance to Ethnic Minority Development was enacted. Based on previous experience, the Framework suggested a new strategy for ethnic minority development within the government policy objectives of stability. sustainable growth and equity, and poverty alleviation. Among the operational implications of this new strategy were: (i) a need for an integrated policy and planning framework, which is participatory; (ii) a concern to strengthen the management capacities of CEMMA and existing agents; (iii) a recognition of cultural, linguistic and social differences; (iv) an emphasiS on balancing investments in human resources and physical infrastructure; (v) a participatory approach which employs consultation with ethnic minorities; and (vi) a need to improve the flow of resources to identify poverty groups. 22. Decision No. 135/1998/QD-TTg of the Prime.Minister, dated 31 July 1998 approving Socioeconomic Development Program for mountainous and remote communes of special difficulties (Program 135) had enclosed this Framework for External Assistance to Ethnic Minority Development into the Policy and paid special attention to poverty reduction for ethnic minorities. The general objectives were to: (i) rapidly improve the life of ethnic minority groups in extremely poor villages in mountainous and remote areas; (ii) create better conditions for these rural areas in order to surmount poverty and backward and slow development, (iii) integrate ethnic minority groups into the general development of the whole country; and (iii) contribute to security, safety, and natural defense. Among the goals from 1998-2005 were: (i) eliminating hunger and reducing poverty by 4-5% annually (and 25% by 2005); (ii) supporting infrastructure (domestic water supply, building vehicle roads to commune centers, and promoting rural market development); (iii) encouraging children to go to school in right age, providing training to the majority of ethnic minority groups, enriching them with knowledge and skills of production, and Power Company 2 Final Report. Soc Trang subproject (iv) controlling dangerous diseases. 23. Decision No. 237/1998/QD-TTg to approve National Goal Program on clean water and rural environmental hygiene (period 1999 - 2005), where ethnic minorities are among the targeted groups. 24. Decision No. 07/2006/QD-TTg, dated 10 January 2006, approving Socioeconomic Development Program for mountainous and remote communes of special difficulties (Program 135 - stage II). 25. Decision No. 20/1998/ND-CP dated 31 March 1998 of the Government dealing with commercial development in mountainous areas, islands and ethnic minority areas, and Decision No. 02/2002lND-CP of the Government amending and supplementing some articles of Decision No. 20/1 998/ND-CP. 26. Decision of the Government No 78/2002lND-CP dated 04 October 2002 dealing with credit for the poor and other policied subjects. 27. Decision No. 134/2004/QD-TTg of the Prime Minister, dated on 20 July 2004, promulgating some assistant policies on production land, residential land, houses and safe water for poor ethnic minorities. Together with the implementation of socioeconomic programs. this Decision aimed to provide direct State support to poor ethnic minority people, facilitate production development, improve living quality and lift them out of poverty. Subjects to be entitled to the assistance policies as regulated in this Decision were the ethnic minority households who have permanently resided in the area; poor households who lived on agriculture and forestry did not have or did not have sufficient production land, dwelling land and had difficulties in dwelling house and living water issues. 28. Decision No. 135/2005/QD-BNV, issued by Minister of Ministry of Internal Affairs on 29 December 2005, regulating education procedure applied to heads of hamlet and village, heads of population groups etc to provide them with basic knowledge of the State and Law that are directly related to their work as well as necessary support knowledge and working skills to assist them in fulfilling their work in locality. 29. To realize the GOV's policies and to implement development programs on Ethnic minorities, DEMAs have been established at the provincial and district's levels within PPC/DPCs, where ethnic minorities live in groups, in order to consolidate and coordinate all common efforts and initiatives at local levels for development and improvement of living standards of ethnic minorities, fostering their dignitY,and protecting their cultural uniqueness. 30. Thus, Vietnam's legally stated policy concerning ethnic minorities is similar in content to the World Bank policy on Indigenous Peoples OP 4.10. The poliCies of the Government regarding ethnic minorities do not contradict to any of the provisions of OP 4.10.and do not prevent them from being implemented under Rural Dist ribution Project. 4 Socioeconomic Conditions of Ethnic Minorities in Project Areas 4.1 Population and Ethnic Composition 4.1.1 In Soc Trang province 31. Soc Trang is one of the two provinces, along with and after Tra Vinh, with the largest · number of Khmer ethnic minorities in the Mekong Delta region. Hoa (or Chinese) ranks the second in number among the local minorities groups following the Khmers in Soc Trang, comprising 5.7% of the provincial total population (See Table 4.1 a). 32. According to anthropologists, the Khmers settled into the Mekong Delta and project provinces as early as in the ih century. The greatest influx of Hoa migrating from China into the region occurred in the 1ih century. Table 4.1 below provides selected figures, derived from the Census of 1999, on ethnic composition of population of the subproject's affected districts. There exists certain relationship between shares of Khmers and Hoa group and their geographic location. Generally, the Khmers occupy more or less remote communes and villages than Kinhs, while Hoa either are tighten to Khmers group or tend to concentrate in urban places where they can better engage in commercial activities. 4.1.2 Demographic Features of Ethnic Minority DPs 34. The average HH size of ethnic minority DPs in most cases varies between 5.0 and 3.6 persons/HH. Less than two thirds of affected ethic minority's HHs has 4 members or fewer. No any HHs with more than 8 persons per HH among ethnic minority DPs. Generally, the Khmers have a larger family than the local Kinh and Hoa groups do: 59.2% of the affected Khmer's HHs have 4 members or fewer and the balanced 40.8% have from 5 to 7 members per HH, while the respective HH's size of Hoa's group account for 76.0% and 24% of the total number of Hoa's HHs The sex composition of the EMs population surveyed indicates a balanced ratio between males over females of the subproject, but the ratio of male-headed DPs are overwhelling, making up almost three fourth (74.8%) of the total affected EM population (See Table 4.2). Thanks to the policy of no discrimination and equality for ethnic minorities pursued by the Vietnam Government and its nation, the great assistances and prioritized investments have been given to the poorest and remotest communes, ethnic minorities, especially Khmer ethnic group, in the Mekong Delta in general, and in Soc Trang as particular, and other ethnic minorities have enjoyed benefits of development and an increasingly improved quality of life. Their standards of living have been continuously upgraded with poverty rate rapidly decreasing. 37. In addition to the common development programs provided to all, the ethnic minorities in project-affected provinces have been particularly benefited from the followings: Program 135/CP Phase 2, developing infrastructure in remote and difficult communes. thanks to the program, all communes have access road at least to their commune center, access to electricity, and health care station, and are connected to the common telecommunication network The programs realizing Decision N0134/2004/QD-TTg, promoting assistance policies on production land, residential land, houses and safe water for poor ethnic minorities. Within these programs, many poor ethnic minority HHs in the project's provinces have been allocated with land for residential purpose, or were offered new houses. According to the reports of Soc Trang PPC, 85-96% of the population currently has access to safe water. The number of old, dilapidated, houses among ethnic minorities group are being continuously reduced, replaced with new ones funded by the Gov. or social budgets. A number of mutual-assisting cooperatives were formed in the provinces to assist landless farmers to redeem land or borrow it for cultivation; consolidate common endeavors for improving farming techniques, and production effectiveness. The poverty alleviation programs promoting livestock development given to ethnic minorities, such as cow breeding, shrimp raising, or introduction of cash crops like mushrooms, and projects of improving fruit garden with special attention, have helped many ethnic minorities escape from poverty, and some have even joined above-average income group. Preferential education treatment to ethnic minorities, with exemption of education fees in schools and preferential admission to higher education. Khmer language is being taught along with Vietnamese in primary schools, where are ethnic minority members are attending, and in Khmer temples. Page: EMP - 14 I,'lj Power Engineering & Consulting Center Socialist Republic of Vietnam The World Bank Energy of Vietnam (EVN) Rural Distribution Project, Soc Trang subproject Establishment of communal center for community education and culture at the commune level, where many agricultural extension activities, exchange of production experiences, and law education were and are continued to be held, especially helpful for ethnic minorities. Ethnic minorities have presentation in all local governmental and local organizations. EM traditions and culture are protected and promoted. 38. Regardless of these, a great part of ethnic minorities in project provinces still lag behind the Kinhs due to various reasons, including their generally lower levels of education and social awareness, greater dependence on natural resource base, lack of capital for investment, more mouths to feed, and lower economic start point/level. Thos is why special attention for ethnic minorities need to be taken to ensure that they will be treated fairly and that they will benefit from the project development compatible with their social and economic structures. 4.3 Land Holding 39. The Mekong Delta is well known as a region with the highest incidence of landlessness in Vietnam. Moreover, it is also known that the landlessness rate is much higher among the local Khmer ethnic group than the average for the whole region. The phenomenon seems to continue and, as consequences, new landless farmers become to hired workers in agricultural and non-agricultural sectors. Nevertheless, results of IOL and SES of the Subproject show that the household agricultural land holding of affected ethnic minority farmers is rather fair, compared to the local Kinhs. Meanwhile, the land acquisition caused by the subprQect does not implicate any severe impacts on local farmers, including those of local ethnic minorities. Agriculture remains to be the most important source of income for the main part of local Khmer HHs and for a considerable number of the Hoa group. The main agricultural activities in the Mekong Delta in general, and ethnic minorities-related districts as particular, include different types of activities, such as rice production, cultivation of certain stable upland crops, some cash upland and industrial crops. Catching aquaculture products in fresh nd brackish water are also traditional for many locals of the Khmer ethnic group. The recent development of shrimp raising in brackish water is a new occupation where likely only a selective part, mostly ... more or less affordable, Khmers could join in. Socialist Republic of Vietnam The World Bank Energy of Vietnam (EVN) Rural Distribution Project, Soc Trang subproject secondary information, the cow (ox) raising is traditional activities of many Khmer HHs in Soc Trang province. 41. Due to economic difficulties and market failure or due to HH-specific problems, many local Khmer's HHs have to mortgage or sell off their land for to cover HHs expenditures, becoming landless farmers. As a consequence, shifting to hired labor in agricultural or non agricultural sectors within or outside province was the way that the landless farmers tried to adapt to earn living. It was reflected in reports of many local communes' authorities on increasing number of Khmers engaged in off-farm sectors and the tendency of out-mign observed among the local Khmer ethnic minority group. 42. Tables 4.5 and 4.6 below provide summarized data on main occupations of the DPs' HHHs and the DPs surveyed population. Results of the survey showed some difference in occupation between Hoa and Khmer group where Khmers do not engage in trade activities while this occupation involved up to 7.9% of the total Hoa ethnic's HHHs. This is in line with the common picture, where Hoa people tend to be engaged in trade and service sectors, while Khmers are mostly concentrated in different agricultural activities. The figure from Table 4.7 indicates the lowest among the affected EMs per capita income in My Thuan commune (329,000 VND/pers.lmonth). of My Tu district which is followed by Lac Hoa commune (575,000VND/pers./month) of Vinh Chau district. Nga Nam distrid with its My Quoi commune has the highest average per capita income, equal 1,000,000 VND/pers.lmonth. The per capita income level also somewhat reflects the occupation structure of the DPs, where trade and non-farm activities as a rule provide higher income than agricultural ones.. As mentioned above, all the affected ethnic minority communes have access to electricity and other basic technical infrastructure. Most of the local ethnic minority population has access to safe water, electricity. Currently, in communes of ethnic minorities, housing development program for the poor and ethnic minorities, safe water and sanitation development projects, development of new, flood protecting, residential settlement sites for flood-prone areas are widely implemented, all contributing to improving living conditions of ethnic minorities. However, the use of open toilet installed on water surface without sanitation standards still is very popular among the local population, including the ethnic minority DPs. Vietnam has completed instituting compulsory primary education program, and compulsory basic secondary education program are presently being completed for all its population including the ethnic minorities. Ethnic minorities have benefited from preferential treatment in education systems, including exemption from education fees in schools and preferential admission to college. Nowadays, illiteracy can be found only among the groups aged older than 55-60, and mostly among females. The results of surveys show a clear improvement in the levels of education of young generation compared to the aged ones. The average schooling years for the total DP communities are in all cases higher than that of the DPs HHHs. Respectively, the portion of DPs having higher education levels are higher for the total population surveyed than that average for the DPs HHHs. (See Table 4.9a and 4.9b). The results of community consultations have revealed that the ethnic minorities of the project areas have been in the process of full integn with the Kinh majority. Ethnic minorities wear the same daily dress as Kinhs, live in the same type of houses, and speak Vietnamese. The ethnic minority languages are mostly used within families and at temples only, while EMs widely wears formal Vietnamese in community. The intermarriages are common, and according to opinions all people consulted, there are no barriers preventing this. 47. Equally to Kinhs group, ethnic minorities actively participate in all local social, cultural and economical activities. They have representation in all political, governmental organizations, and participate in local decision-making process equally to Kinh people. 48. The common education system and preferential treatment for .ethnic minorities in education and communication all favor improving social, economical and political awareness and capacity of ethnic minorities, enabling and integrating them into Vietnam's national society and its common development process. . ... 49. All the local ethnic minority people consulted recognized that their education and awareness levels, as well as living standards are often lower than that of local Kinhs. Reasons for that are not only generally lower education, but also the more disadvantaged location of their I w village, with less developed infrastructure and further distance from main centre of communication. 5 Public Consultation and Participation , . 50. A number of discussions and consultations with authorities and local ethnic minority people of impacted ethnic minority communes have been conducted during the project prepan , . In ethnic minority communities, the Buddhist priests or village elders who used to be the most respected, play the vital role in public consultations. Meetings included indigenous peoples, the authority of village/commune, and women's association. The presentation was made by consultants on the locations of the project and proposed policy, and participants were requested to assess project's possible adverse impacts, and propose mitigation measures and development programs. 51. The local authorities, among them were many ethnic minority officials, actively engaged in assessing possible impacts on ethnic minoritiess. 52. Full support of ethnic minorities in all affected communes has been attained to the subproject. Both local authorities and ethnic minority people actively participated in discussions on their needs, problems and priorities, which may be integrated into the subproject to extend and make use of its benefits for improving their, ethnic minorities', incomes and upgrading their social, economical and cultural lives. Thus, all consulted communes expressed the needs for small credits to develop farm-based and non-farm activities. Attention was given to consultations with ethnic minorities on their proposed measures to improve existing agricultural production. Feedbacks from the ethnic minorities and their authorities have been incorporated into their development plans, which are described below. 6 Mitigation Measures and Development Plans 53. The Ethnic Minority Plan (EMP) is not only for DPs who are directly affected by land acquisition but also for the ethnic minorities who are living in the project-affected areas. As mentioned in the RP, this EMP is developed based on the results of conSUltations with and participation of ethnic minorities and their local authorities. 54. Special resettlement provisions for ethnic minorities are to ensure considen of impacted ethnic minority people's views on various issues and to represent their legal rights. 55. Through consultations with and participation of local authorities and EM in the project affected areas, they gave feedback on the potential adverse impacts by the project as below: IIIi Loss of land and attached properties Risk of electric shocks and safety ; Accident and environmental pollution in the construction period; Disturbance by the. construction and construction workers to villages. Addiction and social evils 56. All of the feedback is integrated in this EMP and Environmental Mitigation Measures (EMP of EA report). ". 6.1 Policy for DPs Losing Land 1. All of these DPs are entitled to compensation and rehabilitation programs as described in the RP. At this state there no any severe impacts on ethnic minorities. However, in the next stage of the subproject implementation, if there any severe impacts, causing loss of more than 10 0/G of HH's productive land ho!ding, on EM HHs will be anticipated, the severely affected EM household will be provided with additional assistances, including Power Company 2 Final Report. Page: EMP - 21 Power Engineering & Consulting Center Socialist Republic of Vietnam The World Bank Energy of Vietnam (EVN) Rural Distribution Project, Soc Trang subproject allowance of 1,500,000VND for fertilizer and seeds, and included in development program in order to restore/rehabilitate their income. 2. All DPs affected on land will be granted with LURC for their remained land holdings and for land they purchase without any payment. 3. Severely affected farmers will be assisted in accessing loan from the Bank for Social Policies (BSP) with the amount of loan ranging from 3,000,000 to 5 million VND per HH in the short and/or medium terms (from one to three years respectively). Proper technical guidance will be provided so that the people will know how to use and manage credit properly. According to BSP policy, ethnic minorities will get loan with lower interest rate (lower from 10% to 15%). 6.2 Development Plans for All Ethnic Minorities in Project Areas 57. A special program is prepared for ethnic minority people who are displaced by the project and/or living in the project areas. It includes the followings: 1. Project Information dissemination: 58. General Resettlement Information dissemination is carried out as part of the RP implementation for all project's DPs, including the impacted ethnic minority members. However, to avoid any possible language barrier and ensure full respect to ethnic minorities, the project information campaign may need to be done in the concerned local ethnic minority languages wherever applicable. Moreover, it also needs to inform the ethnic minorities about the EMP . To implement this activity, the Public Information Booklet (PIB) and other disseminated materials for ethnic minorities will be translated into and held in the respective ethnic minoirty language and posted at places adequate to specifics of their cultural and living conditions. The project information dissemination for the ethnic minorities will be carried out in parallel with the described in the RP schedule for general resettleme of PCs and Soc Trang PPMU will cooperate with the concerned communes to fulfill these tasks. The cost for this activity is taken from the Counterpart budget. 2. Training for electric safety: 59. The most population in the project area are supplied with electricity from local network. However, for electrical safety, it's necessary to provide training on electrical safety for Ethnic Minorities. Thus, based on the results of public consultation with ethnic minorities, certain training on electrical safety needs to be carried out for ethnic minorities. For effective organization, the PMB will cooperate with Soc Trang PPMU and local authorities or mass organizations to idenUfy specific training needs on electric safety and organize training for all the local EM HHs. ' 60. The electric safety education should include followings: Leaflet to introduce the regulation electric safety measures and guidance for giving first aid in the case of electric shock. The leaflet, prepared by PMB, will be disseminated to a/l families in the project areas. Training on electric safety and first aid for electric shock in each commune for local people and pupil in primary and secondary schools. 61. As it was mentioned that at this FS stage of the subproject preparation, there no any permanent land acquisition impacts of the subproject has been anticipated. However, in its implementation stage, if any change of technical design will implicate severe impacts on land of local Ethnic minority, then this proposed program would be applied. The ethnic minority households whose income is severely affected may especially need technical assistance to restore their productive capacity. Since they almost base their income on agricultural, activities, first of all cultivation, technical assistance in the form of agricultural extension would be highly appropriate. Concrete or specific topics and content of agricultural extension programs will be defined during the project implementation stage, based on close consultations with, and participation of, ethnic minorities, their representatives, and the local authorities. Besides, once the need for credits and agricultural extension for severely affected DPs are identified, it would be preferable if the latter could also be provided to other, non-affected, but in-need, ethnic minority audience of the project communes. Special priority would also be given to female headed ethnic minority HHs to include them into this training program. 63. The PMB of PC2 and PPMU will work closely with commune authorities, relevant local mass organization (Farmers Association, Women's Union ... ) to investigate the need, then together with the DARD and AEC of respective communes to prepare a detailed training implementation program for these activities. 64. This program consists the following activities: Activity 1: Evaluating the demand of agricultural development 65. After carrying out the detail measurement survey, Project Management Board and Local Authorities will draw up list of names of affected Ethnic minority households who will receive assistance on the program of agricultural development (if necessary). Commune Authority will helps these Units in organizing consultations with serious displaced persons on the subjects, time of training and counting up the partiCipated people. Activity 2: Preparing plans for project 66. BaSing on the number of program participated Ethnic Minorities, Project Management Board with the conSUltations of Local Authorities will prepare plans for training program (if necessary) and present it to PC2 as well as to Provincial People's Committee for approval and receipt of budget. The plans consist of:' 1. Program objectives. 2. Program benefits. 3. Consulting displaced persons and counting up the partiCipated people for each subject. 4. Supervision and evaluation. 'J Activity 3: Program implementation ... 67. After project plan approval, Project Management Board will send training budget to Agricultural Development Centre for training the peasants who have registered. The program will be carried out once or several times during the period of project implementation, it's up to the loss level and demand of displaced persons. Training on Household saving and economic planning: 68. Poor capacity to save and plan household economy remains to be the most serious weakness among the ethnic minorities, especially for Khmer group. It is a factor hampering them from improving their production systems, to be more resist to internal and external risks, and more flexible to changing market conditions. It is obviously the education tha would play the crucial role in improving the ethnic minorities' overall awareness, including that towards their household economic planning and management. However, the present common status of many local ethnic minority HHs would indicate the great need for and importance of training assistance in household saving and economic planning and management, assistance in creating saving groups... The PMB and PPMU will closely cooperate with local authorities and local women's unions to investigate the needs, then with the department of finance or banks of respective provinces to prepare detailed programs and their implementation on these issues. 6.3 Mitigation Measures 1. Construction times will be implemented after harvesting crops (reasonable construction scheduling). 2. Compensation will be given in cash for land marginally affected and for attached affected assets as preffered options of the EM's DPs. 3. Signal! warning Boards at the dangerous places 4. To implement this EMP smoothly, PC2 with the PMB and Soctrang PPMU may discuss on cooperation or each will work independently to: Assign adequate number of staff for safeguard implementation of the subproject. Hire qualified experts for implementing EMP . Periodical monitoring by internal and external monitoring organizations. Ensure transparency in implementation through information campaign Ensure that EM leaders are represented in local RP and EMP committees. 71. Implementation of the EMP s will be carried out in close collabon with ethnic minorities and local authorities (local Committee for Ethnic Minorities and Mountainous Areas, Resettlement Committees, the Land Departments etc.,) and local mass organizations. Implementation of the EMP will be regularly supervised and monitored internally by PMBfPC2 of EVN in coordination with the respective Committees for Ethnic Minorities and Mountainous Areas at grassroots level in each subproject area. The findings and recommendations will be recorded in quarterly reports and be forwarded to EVN and the World Bank Office in Vietnam. 73. An independent agency, which will be hired by PMB/PC2 of EVN to undertake external monitoring and evaluation of the resettlement action plan (RP), will also be responsible for M&E of the EMP implementation. When the external monitoring agency will visit a sample of project affected households for resettlement in each subproject area on an annual basis, the agency will also visit a sample of at least 10% of ethnic minority households in the subproject areas. 9 Cost Estimates 9.1 Cost Estimates Some items of EMP are estimated in the RP (implementation cost, compensation and rehabilitation etc.). The detail costs of trainings will be prepared in each proposal later. To save costs, combination between meetings, trainings will be organized by PMBI PC2 and all relevant institutions for RP and EMP . Costs for mitigation measures will be included in the construction contracts for contractors. Contingency is estimated in RP. 74. The borrower will pay the cost for EMP implementation. 10 Implementation Schedule 76. The EMP implementation schedule will be coordinated with the subproject implementation. A complete implementation schedule will be detailed in the EMP. All social impact assessment (SIA) and consultation meetings will be undertaken before subproject designs are prepared. Compensation for land acquisition will be satisfactory completed at least one month prior to start of civil works. Monitoring and evaluation should take place at the recommended times during and after civil works. 11 Reporting I Documentation 77. Soc Trang Power Company will implement sub-projects, including construction and installation of medium voltage electricity distribution lines and transformer stations for the province. Construction investment · Soc Trang Power Company builds and install distribution stations and lowlmedium voltage electricity distribution lines · Provincial People's Committee makes agreements on the Resettlement plan (RP)I ethnic minority development policy (EMDP) Household related households 1. Who are the projects affected households (PAHs)? Households, organizations and individuals whose land or other assets such as house, structure, trees and crops are situated in the safety corridor of the electricity network (lines and transformer stations) or recovered for construction and installation of the projects. 2. Which agency will determine the affected area and assets? · The PMB of the electricity network system of Binh Thuan Province will provide a drawing on th position of transformer station and direction of the line route to Councils of Compensation Resettlement of the districts and communes. · The Councils of Compensation and Resettlement of the districts and communes are responsible for localizing the area of impacts and conducting surveys as well as statistics on the affected assets. · The area of impacts is the area lying in the safety corridor of tile lines. 1 The safety corridor is stipulated in Decree No. 106/2005/NI)-CP by the Government dated 17/8/2005 (the width of safety corridor is 6m equivalent to the line of22 kV). I. 3. Types o/impacts o/the project? · Permanent impacts: Land, house, structure, other assets and trees , " I (higher than 4m) in right of way (ROW) of the saiety corridor of the line route and the transformer station area. Is the land in the safety corridor ofthe project recovered? No. But the purposes of land use are affected because only crops and trees with the height ofless than 4m are permitted. 5. Who are compensated and who are not compensated? · All families, organizations and individuals whose assets (land, house, structure, trees, crops) are affected by the project and with lawful papers or clear evidence of their ownership over the assets before the compensation lawful date/ cut-off date will be compensated and subsidized. · The households, who occupy land or build houses/ structure in the project affected area after the cut-off date, will not be compensated. These households will be requested to move their assets out of the project affected area. 6. Compensation price unit? A compensation price unit will be set up by the Provincial Compensation and Resettlement Council with reference to the market price in the locality. The price unit will be approved by the Province People's Committee. All PAPs will be compensated at replacement price - market price at the time of compensation for their affected assets, without deduction for salvable materials. ,. The affected land will be compensated with land ofthe same quality or in cash. 7. PARs with their houses to be partially affected? · In the case that the demolished part of house does not affect structure and purposes of use of the remaining part of house, the PAHs will be compensated for this demolished part. · In the case that the demolished part of house affects structure of the house or the remaining part of house is unusable, the PAHs will be compensated for their whole house. 8. Apartfrom compensation, do the resettled PAPs have any other interests? Yes. Apart from compensation for land and other assets, the displaced PAPs will enjoy allowances! subsidies for evacuation, life rehabilitation,... All allowances and assistance will be clearly presented in the RP. 10. Will the PAPs be requested for evacuation and site clearance when they still have not received compensation and other allowances? The PAPs only transfer their land and conduct land clearance when they receive full compensation and other interests. 11. When receiving compensation, are the PAPs requested to contribute to any organization or any number of impacts hidden by Compensation and Resettlement Council? Noone has the right to extract any quantity from compensation or other entitlements of the PAPs. If that is the case, the PAPs need to directly report to the district Compensation and Resettlement Council, the PMB or local authority for resolution. 12.
