ToR for Batch 3 ESMP Preparation TERMS OF REFERENCE (TOR) PREPARATION OF ENVIRONMENTAL AND SOCIAL MANAGEMENT PLAN (ESMP) FOR BATCH THREE (3) OF THE GREATER ACCRA METROPOLITAN AREA SANITATION AND WATER PROJECT (GAMA-SWP) COMPONENT TWO (2) GHANA WATER COMPANY LIMITED (GWCL) IMMEDIATE INTERVENTIONS TO EXTEND WATER SUPPLY PIPELINES BATCH 3) TO SIXTEEN (16) LOW INCOME COMMUNITIES IN GA SOUTH, NORTH, EAST, WEST, ASHAIMAN AND TEMA WEST, MUNICIPAL ASSEMBLIES 1.0 BACKGROUND The Government of Ghana (GoG) has received financing from the World Bank towards the cost of the Greater Accra Metropolitan area (GAMA) sanitation and Water Project (GAMA S&W Project). The objective of the Project is to increase access to improved sanitation and improved water supply in the GAMA, with emphasis on low income communities and to strengthen environmental sanitation in the GAMA. The project supports eleven Municipal and Metropolitan (MMAs) spread across the Greater Accra Region of Ghana. The project has four (4): Component 1- Provision of water and environmental sanitation services to priority low income areas of GAMA; Component 2- Improvement and expansion of water distribution network in the GAMA; Component 3- Improvement and expansion of waste water and faecal sludge collection, transportation and treatment in GAMA; and Component 4- Institutional strengthening. As part of the GAMA Sanitation and Water World Bank funded project, the Ghana Water Company Limited (GWCL) is undertaking to provide water supply systems to a number of Low Income communities (LICs) in GAMA. The GWCL intends to lay water supply pipelines made up of PVC and HDPE pipes of diameter ranging from OD 110mm to OD 630mm in sixteen (16) low-income communities in Ga South, Ga North, Ga East, Ga West, Tema West, Adentan and Ashaiman Municipal Assemblies. In all, a total of about 87.37 km of pipelines will be laid in the 10 communities. The communities are as follows: Taifa (18.54km), Ashiyie (4.38km), Amanfro (2.63km), Amrahia (2.27km), Ogbojo (7.61km), Dzen Ayor (3.53km), Botwe Old Town (5.61km), Otanor (0.67km), Nii Boi Town (2.95km), Sarpeiman (8.61km), Tetegu (5.18km), Asofan, Ofankor (6.19km), Adjei Kojo (6.93km), Gbetsile (7.51km) and Zenu (4.76km). The activities of the interventions will involve among others, generation of noise, emitting of dust, removal of top soil, excavation and replacement of the old existing pipes in the ground; and excavation and laying of new pipelines; site clearing; and trench digging, back filling, generation of both solid and liquid wastes, temporary blocking of access roads, dewatering, cutting through existing roads, creation of conditions for the occurrence of accidents. There will be total or partial demolition of permanent structures to give way for the laying of the pipes. The structures to be affected include bathrooms, walls, houses, verandas, fence walls, toilets, school facilities, paved and unpaved roads areas, spread across the 10 communities. Other moveable structures including kiosks, wooden structures and metal containers are also likely to be affected. Other activities include back filling; and collection and disposal of old pipes and spent PVC and HDPE pipes of diameter ranging from OD 110mm to OD 630mm. The activities have the potential to generate safeguards concerns including noise and dust generation; loss of vegetation; soil impacts and sediment transport; solid and liquid waste generation; obstruction of mobility of people in the project communities; occupational health and safety; public safety and traffic issues; displacement and/or relocation of people; and loss of property loss of livelihoods. Update of GWCL Water Supply Master Plan for GAMA Draft Environmental and Social Management Plan: Batch 3 Ghana’s Environmental Assessment Regulations, 1999(LI1652) requires that for any start-up project which has potential to impact negatively on the environment and people, the undertaking should be assessed for its environmental and social impacts, and the appropriate mitigation measures identified and planned prior to the implementation of the project. On the side the of the World Bank, the GAMA Project has triggered two of its safeguards policies namely the Environmental Assessment Policy (OP4.01) and the Involuntary Resettlement Policy (OP 4.12), requiring that any potential environmental and social issues arising from the project implementation should be mitigated. The management of the Environmental and social issues of the GAMA Project is guided by the Project’s Environmental and Social Management Framework ESMF) and Resettlement Policy Framework (RPF). The purpose of the ESMF and RPF is to prevent, where possible avoid and effectively mitigate the environmental and social issues arising from the project implementation. Consequently, and in the light of the potential environmental and social impacts identified during the Environmental and Social screening conducted on the proposed interventions in the sixteen (16) communities, the Ghana Water Company Limited, is committed to undertake the pipelaying activities in an environmentally and socially friendly manner, and in accordance with the Environmental laws of Ghana; the World Bank’s Policy on Environmental Assessment (OP4.01); and the GAMA project Environmental and Social management framework (ESMF). 2.0 OBJECTIVES OF THE TERMS OF REFERENCE The objectives of this Terms of Reference (TOR) is for the Consultant to use the scope of services provided below to prepare an Environmental and Social Management Plan (ESMP) to guide effective avoidance, mitigation and management of potential environmental and social issues of the proposed pipelaying activities and their operation. 3.0 SCOPE OF SERVICES The assignment will take place in project intervention communities Taifa (18.54km), Ashiyie (4.38km), Amanfro (2.63km), Amrahia (2.27km), Ogbojo (7.61km), Dzen Ayor (3.53km), Botwe Old Town (5.61km), Otanor (0.67km), Nii Boi Town (2.95km), Sarpeiman (8.61km), Tetegu (5.18km), Asofan, Ofankor (6.19km), Adjei Kojo (6.93km), Gbetsile (7.51km) and Zenu (4.76km) all in the Greater Accra Metropolitan Area (GAMA). Scope of services for this assignment is to effectively prepare an Environmental and Social Management Plan (ESMP) consisting of environmentally and socially identified project impacts and sets of mitigating, monitoring, and institutional measures to be undertaken before, during implementation and operation to eliminate adverse environmental and social impacts in accordance with appropriate Safeguards Policies such as Operational Policy 4.01 and the Ghana Environmental Protection Agency LI 1652 amongst others. The activities shall include but not limited to: • Description of physical location of each project intervention and identification of the project category. • Description of the proposed subproject activities and physical works to be done for each community water supply pipe intervention including drawings where appropriate. • Description and detailing of public and institutions’ consultation processes. Detailing of all processes and documentations involved in the transactions with possible pictures and correspondence of engagement. • Description of baseline characteristics of each of the community project intervention areas including air, noise, biological resources, drainage, wetlands, trees and other natural habitat. Land us, socio-economic and cultural settings. • Determine the project’s social impacts on health and social well-being; quality of the living environment; economic material well-being; Family and community; and gender relations • Review policy, legal and institutional framework related to environmental management of the project Update of GWCL Water Supply Master Plan for GAMA Draft Environmental and Social Management Plan: Batch 3 • Identification of environmental and social impacts associated with the project construction and operation in each community. For environment include waste management considerations, natural habitat impacted including trees, rivers, streams and so on, soil erosion, dust and other considerations (include social issues such as public safety and traffic issues, occupational health and safety of workers, obstruction of walkways of community and people, the risk of pipe bursts that might influence flooding in communities, and employment, etc., which might not get addressed in the RAP or ARAP); the magnitude, distribution, duration, and significance of the impacts and who will be affected. • Assessment and evaluation of the potential impacts of the project on environment and people. • Determine the project’s environmental social impacts on health and social well- being; quality of the living environment; economic material well-being; family and community; and gender relations. • Particular attention should be paid to impacts of the project on vulnerable and marginalised individuals and groups including but not limited to mobility impaired individuals and people living with disability. • Propose environmentally and socially sustainable mitigation measures for addressing the potential adverse environmental and social impacts. • The information on impacts and mitigation measures should be summarised in tabular form for clear reading. • Provide information on whose responsibility it will be to ensure that these mitigation measures are done. • Assess the social impacts identified during the public consultation process and those that, based on consultant’s experience, are also likely to occur. In some instances the affected communities may not be aware of or be in a position to identify all the social impacts that may occur. However, this does not mean that they will not occur. In such cases the consultant should use his/her experience to identify additional social impacts that have not been raised by the public. A summary of the views of the population including vulnerable groups, determined through thoroughly documented discussions with local communities. These meetings and discussions must be documented and should show how issues and problems raised are or will be resolved; • Pay particular attention to the impacts of the project on vulnerable and marginalized individuals and groups (including but not limited to mobility impaired individuals and groups and People Living with Disability) Detail measures that will need to be taken to mitigate the negative social impacts identified and the procedures for their implementation; Identifying key uncertainties and risks: Identify and communicate any key uncertainties and risks associated with the accuracy of the findings of the social assessment, as well as of the proposed project. Some sources of uncertainty and risk commonly associated with projects are linked to: (a) Lack of adequate information at the community level; (b) The influx of job seekers and construction workers to the area and the impact on services; etc. • Proposed environmental and social management plan (ESMP) which summarises A) mitigation measures for each negative impact; B) appropriate indicators for monitoring and frequency of monitoring as well as reporting; C) persons and institutions responsible for proper implementation of the mitigation measures; D) implementation costs, including the cost of training contractors in how to manage environmental and social risks; • Annexes: Record on people and institutions consulted (include photos and minutes), issues discussed, responses given by the MMAs, GWCL and other key stakeholders; pictures of sites of subprojects, should be incorporated into the ESMP. 4.0 METHOD OF ASSIGNMENT Update of GWCL Water Supply Master Plan for GAMA Draft Environmental and Social Management Plan: Batch 3 The method to be adopted for carrying out the preparation of the ESMP, which must be participatory include the following: Consultation for data gathering including guided questions, focussed group discussions and stakeholder map showing the different stakeholders interested and affected by the project. Consultation of various interested individuals and groups especially the project affected persons. 5.0 TIME SCHEDULE FOR THE IMPLEMENTATION OF THE ASSIGNMENT The time schedule for the completion of the assignment is ten (10) weeks including the submission of a final ESMP report. The Consultant shall be expected to work in close collaboration with the GWCL GAMA Project Coordinator and the Safeguards Specialist. 6.0 DELIVERABLES AND TIMING Inception Report: The Consultant shall submit Inception Report in ten (10) hard copies, two (2) weeks from contract signature of work to Ghana Water Company Limited (GWCL). Draft ESMP Report: To be submitted in ten (10) hard copies to GWCL for comments; six (6) weeks after contract signature. It shall cover all areas in the scope of the assignment, including a matrix of compensation and other resettlement assistance to be provided the PAPs. Draft Final ESMP Report: To be submitted in ten (10) hard copies to GWCL eight (8) weeks after contract signature. The draft final report shall take into accounts all comments. Final ESMP: To be submitted in Soft copy on a CD-ROM and ten (10) hard copies to GWCL ten (10) weeks after contract signature. In the Technical Proposal, the Consultant’s main team shall consist of the following expertise of a minimum academic qualification of BSc/BA in the relevant discipline with minimum relevant experience of ten (10) years. CODE OF CONDUCT REQUIREMENTS A satisfactory bidder’s code of conduct shall contain obligations on all project staff (including sub- contractors and day workers) that are suitable to address the following issues, as a minimum. Additional obligations may be added to respond to particular concerns of the region, the community and the project. The issues to be addressed include: 1. Compliance with applicable laws, rules, and regulations of Ghana and applicable World Bank Policies; 2. Compliance with applicable health and safety requirements (including wearing prescribed personal protective equipment, preventing avoidable accidents and a duty to report conditions or practices that pose a safety hazard or threaten the environment); 3. The use of illegal substances; 4. Non-Discrimination (for example on the basis of family status, ethnicity, race, gender, religion, language, marital status, birth, age, disability, or political conviction); 5. Interactions with community members (for example to convey an attitude of respect and non-discrimination); 6. Sexual harassment (for example to prohibit use of language or behaviour, in particular towards women or children, that is inappropriate, harassing, abusive, sexually provocative, demeaning or culturally inappropriate); 7. Violence or exploitation (for example the prohibition of the exchange of money, employment, goods, or services for sex, including sexual favours or other forms of humiliating, degrading or exploitative behaviour); 8. Protection of children (including prohibitions against abuse, defilement, or otherwise unacceptable behavior with children, limiting interactions with children, and ensuring their safety in project areas); 9. Sanitation requirements (for example, to ensure workers use specified sanitary facilities provided by their employer and not open areas) 10. Avoidance of conflicts of interest (such that benefits, contracts, or employment, or any sort of preferential treatment or favours, are not provided to any person with whom there is a financial, family, or personal connection); 11. Respecting reasonable work instructions (including regarding environmental and social norms); 12. Protection and proper use of property (for example, to prohibit theft, carelessness or waste); 13. Duty to report violations of this Code; 14. Non-retaliation against workers who report violations of the Code, if that report is made in good faith. The Code of Conduct should be written in plain language and signed by each worker (both permanent and temporary) to indicate that they have: 9.0 Received a copy of the code; 10.0 Had the code explained to them; 11.0 Acknowledged that adherence to this Code of Conduct is a condition of employment, and 12.0 Understood that violations of the Code can result in serious consequences, up to and including dismissal, or referral to legal authorities. Update of GWCL Water Supply Master Plan for GAMA Draft Environmental and Social Management Plan: Batch 3 SAMPLE COMPANY CODE OF CONDUCT PREVENTING GENDER BASED VIOLENCE AND VIOLENCE AGAINST CHILDREN The company is committed to creating and maintaining an environment in which gender based violence (GBV) and violence against children (VAC) have no place, and where they will not be tolerated by any employee, associate, or representative of the company. Therefore, in order to ensure that all those engaged in the project are aware of this commitment, and in order to prevent, be aware of, and respond to any allegations of GBV and VAC, the company commits to the following core principles and minimum standards of behavior that will apply to all company employees, associates, and representatives including sub-contractors, without exception: 1. The company—and therefore all employees, associates, and representatives—commit to treating women, children (persons under the age of 18), and men with respect regardless of race, color, language, religion, political or other opinion, national, ethnic or social origin, property, disability, birth or other status. Acts of GBV and VAC are in violation of this commitment. 2. Demeaning, threatening, harassing, abusive, culturally inappropriate, or sexually provocative language and behavior are prohibited among all company employees, associates, and its representatives. 3. Acts of GBV or VAC constitute gross misconduct and are therefore grounds for sanctions, which may include penalties and/or termination of employment. All forms of GBV and VAC, including grooming are unacceptable, regardless of whether they take place on the work site, the work site surroundings, at worker’s camps or at worker’s homes. 4. In addition to company sanctions, legal prosecution of those who commit acts of GBV or VAC will be pursued if appropriate. 5. Sexual contact or activity with children under 18—including through digital media—is prohibited. Mistaken belief regarding the age of a child is not a defense. Consent from the child is also not a defense or excuse. 6. Sexual favors—for instance, making promises or favorable treatment dependent on sexual acts—or other forms of humiliating, degrading or exploitative behavior are prohibited. 7. Unless there is full consent1 by all parties involved in the sexual act, sexual interactions between the company’s employees (at any level) and members of the communities surrounding the work place are prohibited. This includes relationships involving the withholding/promise of actual provision of benefit (monetary or non-monetary) to community members in exchange for sex—such sexual activity is considered “non- consensual� within the scope of this Code. 8. All employees, including volunteers and sub-contractors are highly encouraged to report suspected or actual acts of GBV and/or VAC by a fellow worker, whether in the same company or not. Reports must be made in accordance with GBV and VAC Allegation Procedures. 1 Consent is defined as the informed choice underlying an individual’s free and voluntary intention, acceptance or agreement to do some thing. No consent can be found when such acceptance or agreement is obtained through the use of threats, force or other forms of coercion, abduction, fraud, deception, or misrepresentation. In accordance with the United Nations Convention on the Rights of the Child, the World Bank considers that consent cannot be given by children under the age of 18, even in the event that national legislation of the country into which the Code of Conduct is introduced has a lower age. Managers are required to report suspected or actual acts of GBV and/or VAC as they have a responsibility to uphold company commitments and hold their direct reports responsible. To ensure that the above principles are implemented effectively the company commits to ensuring that: 10. All managers sign the ‘Manager’s Code of Conduct’ detailing their responsibilities for implementing the company’s commitments and enforcing the responsibilities in the ‘Individual Code of Conduct’. 11. All employees sign the project’s ‘Individual Code of Conduct’ confirming their agreement not to engage in activities resulting in GBV or VAC. 12. Displaying the Company and Individual Codes of Conduct prominently and in clear view at workers’ camps, offices, and in in public areas of the work space. Examples of areas include waiting, rest and lobby areas of sites, canteen areas, health clinics. 13. Ensure that posted and distributed copies of the Company and Individual Codes of Conduct are translated into the appropriate language of use in the work site areas as well as for any international staff in their native language. 14. An appropriate person is nominated as the company’s ‘Focal Point’ for addressing GBV and VAC issues, including representing the company on the GBV and VAC Compliance Team (GCCT) which is comprised of representatives from the client, contractor(s), the supervision consultant, and local service provider(s). 15. Ensuring that an effective Action Plan is developed in consultation with the GCCT which includes as a minimum: a. GBV and VAC Allegation Procedure to report GBV and VAC issues through the project Grievance Redress Mechanism (GRM); b. Accountability Measures to protect confidentiality of all involved; and, c. Response Protocol applicable to GBV and VAC survivors and perpetrators. 16. That the company effectively implements the Action Plan, providing feedback to the GCCT for improvements and updates as appropriate. 17. All employees attend an induction training course prior to commencing work on site to ensure they are familiar with the company’s commitments and the project’s GBV and VAC Codes of Conduct. 18. All employees attend a mandatory training course once a month for the duration of the contract starting from the first induction training prior to commencement of work to reinforce the understanding of the project’s GBV and VAC Code of Conduct. This means that managers have an acute responsibility to create and maintain an environment that prevents GBV and VAC. Managers need to support and promote the implementation of the Company Code of Conduct. To that end, managers must adhere this Manager’s Code of Conduct and also sign the Individual Code of Conduct. This commits them to supporting and developing systems that facilitate the implementation of the Action Plan and maintain a GBV-free and VAC-free environment at the workplace and in the local community. These responsibilities include but are not limited to: 14.0 Implementation 1. To ensure maximum effectiveness of the Company and Individual Codes of Conduct: a. Prominently displaying the Company and Individual Codes of Conduct in clear view at workers’ camps, offices, and in in public areas of the work space. Examples of areas include waiting, rest and lobby areas of sites, canteen areas, health clinics. b. Ensuring all posted and distributed copies of the Company and Individual Codes of Conduct are translated into the appropriate language of use in the work site areas as well as for any international staff in their native language. 2. Verbally and in writing explain the Company and Individual Codes of Conduct to all staff. 3. Ensure that: a. All direct reports sign the ‘Individual Code of Conduct’, including acknowledgment that they have read and agree with the Code of Conduct. b. Staff lists and signed copies of the Individual Code of Conduct are provided to the GCCT and the client. c. Participate in training and ensure that staff also participate as outlined below. d. Staff are familiar with the Grievance Redress Mechanism (GRM) and that they can use it to anonymously report concerns of GBV or VAC incidents. e. Staff are encouraged to report suspected or actual GBV or VAC through the GRM by raising awareness about GBV and VAC issues, emphasizing the staff’s responsibility to the Company and the country hosting their employment, and emphasizing the respect for confidentiality. 4. In compliance with applicable laws and to the best of your abilities, prevent perpetrators of sexual exploitation and abuse from being hired, re-hired or deployed. Use background and criminal reference checks for all employees. 5. Ensure that when engaging in partnership, sub-contractor or similar agreements, these agreements: a. Incorporate the GBV and VAC Codes of Conduct as an attachment. b. Include the appropriate language requiring such contracting entities and individuals, and their employees and volunteers, to comply with the Individual Codes of Conduct. c. expressly state that the failure of those entities or individuals, as appropriate, to take preventive measures against GBV and VAC, to investigate allegations thereof, or to take corrective actions when GBV or VAC has occurred, shall constitute grounds for sanctions and penalties in accordance with the Individual Codes of Conduct. 6. Provide support and resources to the GCCT to create and disseminate internal sensitization initiatives through the awareness-raising strategy under the Action Plan. Ensure that any GBV or VAC issue warranting police action is reported to the client and the World Bank immediately. 15.0 Training 8. All managers are required to attend an induction manager training course prior to commencing work on site to ensure that they are familiar with their roles and responsibilities in upholding the GBV and VAC Codes of Conduct. This training will be separate from the induction training course required of all employees and will provide managers with the necessary understanding and technical support needed to begin to develop the Action Plan for addressing GBV and VAC issues. 9. Ensure that time is provided during work hours and that staff attend the mandatory project facilitated induction training on GBV and VAC required of all employees prior to commencing work on site. 10. Ensure that staff attend the monthly mandatory refresher training course required of all employees to combat increased risk of GBV and VAC during civil works. 11. Managers are required to attend and assist with the project facilitated monthly training courses for all employees. Managers will be required to introduce the trainings and announce the self-evaluations. 12. Collect satisfaction surveys to evaluate training experiences and provide advice on improving the effectiveness of training. 16.0 Response 13. Managers will be required to provide input to the GBV and VAC Allegation Procedures and Response Protocol developed by the GCCT as part of the final cleared Action Plan. 14. Once adopted by the Company, managers will uphold the Accountability Measures set forth in the Action Plan to maintain the confidentiality of all employees who report or (allegedly) perpetrate incidences of GBV and VAC (unless a breach of confidentiality is required to protect persons or property from serious harm or where required by law). 15. If a manager develops concerns or suspicions regarding any form of GBV or VAC by one of his/her direct reports, or by an employee working for another contractor on the same work site, s/he is required to report the case using the GRM. 16. Once a sanction has been determined, the relevant manager(s) is/are expected to be personally responsible for ensuring that the measure is effectively enforced, within a maximum timeframe of 14 days from the date on which the decision to sanction was made. 17. Managers failing to report or comply with such provision can in turn be subject to disciplinary measures, to be determined and enacted by the company’s CEO, Managing Director or equivalent highest-ranking manager. Those measures may include: a. Informal warning. b. Formal warning. c. Additional Training. d. Loss of up to one week's salary. e. Suspension of employment (without payment of salary), for a minimum period of 1 month up to a maximum of 6 months. f. Termination of employment. 18. Ultimately, failure to effectively respond to GBV and VAC cases on the work site by the company’s managers or CEO may provide grounds for legal actions by authorities. Children should be adequately clothed and not in poses that could be seen as sexually suggestive. • Ensure images are honest representations of the context and the facts. • Ensure file labels do not reveal identifying information about a child when sending images electronically. Provide other means of transport to avoid public transport e.g. cycling 2. Provide hand cleaning facilities at entrances and exits of the site. This should include soap and water wherever possible and/or hand alcohol-based sanitizer if water is not available 3. Provide means of transport for ill persons and taken home or health facility Site access points 1. Stop all non-essential visitors from visiting or trespassing the site 2. Introduce staggered start and finish times to reduce congestion and contact at all times 3. Monitor site access points to facilitate social distancing – you may need to change the number of access points, either increase to reduce congestion or decrease to enable monitoring 4. Provide soap and running water at strategic points at the site 5. Require all workers to wash their hands with soap under running water before entering or leaving the site. Handwashing must be enforced and all recalcitrant persons should not allowed to enter construction sites. 6. Allow plenty of space two meters (6 feet) between people waiting to enter site 7. Regularly clean common contact surfaces in camp offices, access control and delivery areas e.g. telephone handsets, desks, door handles particularly during peak flow times 8. Drivers should remain in their vehicles if the load will allow it and must wash their hands before unloading goods and materials. 9. Daily attendance records of all workers entering and exiting the site should be taken Self Isolation Contractor should procure a temperature gun for measuring temperature of workers and visitors before they enter the sites. Anyone who meets one of the following criteria should not come to site or allowed at the site: 1. Anyone who has a high temperature or a persistent cough - follow the guidance on self-isolation 2. Anyone who is a vulnerable person (by virtue of their age, has an underlying health condition, clinical condition or is pregnant) 3. Anyone who is living with someone in self-isolation or a vulnerable person. Procedure if someone falls sick If a worker develops a high temperature or a persistent cough while at work, they should: 1. Return home immediately or visit the hospital/clinic 2. Avoid touching anything 3. Cough or sneeze into a tissue and put it in a bin, or if they do not have tissue, cough and sneeze into the crook of their elbow. 4. They must then follow the guidance on self-isolation and not return to work until their period of self-isolation has been completed (often 2 weeks). Wear Personal Protection Equipment (PPE) at all times 1. Ensure soap and fresh water is readily available and replenished/refilled at all times 3. Provide hand sanitizer where hand washing facilities are unavailable 4. Regularly clean the hand washing facilities and check soap and sanitizer levels are adequate 5. Provide suitable and sufficient rubbish bins for hand towels with regular removal and appropriate disposal. 6. Sites will need extra supplies of soap, hand sanitizer and paper towels and these should be securely stored. Toilet facilities 1. Restrict the number of people using toilet facilities at any one time i.e. nominate a welfare attendant to manage this activity 2. Wash hands before and after using the toilet facilities 3. Enhance the cleaning regimes for toilet facilities particularly toilet bowls, door handles, locks and the toilet flush mechanisms 4. Portable toilets should be avoided wherever possible, but where in use these should be cleaned and emptied more frequently 5. Provide suitable and sufficient rubbish bins for hand towels with regular emptying and appropriate disposal. Food and water arrangements In order to avoid workers going in and our of the site in search of food and water with food vendors and chop bars not operating normally, there is a requirement for construction sites to have means of food and water for workers. The workforce should also be required to stay on site once they have entered and not use local shops or walk around in project communities. ✓ Dedicated eating areas should be identified on site to reduce food waste and contamination ✓ Break times should always be staggered to reduce congestion and human-to-human contact ✓ Hand washing facilities or hand sanitizers should be available at the entrance of any room where people eat and should be used by workers when entering and leaving the area ✓ The workforce should be asked to bring pre-prepared meals and refillable drinking bottles from home or limit contact with food vendors if they must buy from vendors. ✓ Workers should sit 2 metres apart from each other whilst eating and avoid all contact ✓ Where catering is provided on site, it should provide pre-prepared and wrapped food only ✓ Payments should be taken by contactless card wherever possible Update of GWCL Water Supply Master Plan for GAMA Draft Environmental and Social Management Plan: Batch 3 ✓ Safe drinking water should always be provided ✓ Tables should be cleaned with soap and water between each use ✓ All rubbish should be put straight in the bin and not left for someone else to clear up ✓ All areas used for eating must be thoroughly cleaned at the end of each break and shift, including chairs and door handles. Maintain a list of workers on site and update it daily. 2. Post signage that limits the number of people at the site 3. Work requiring skin to skin contact should not be carried out 4. Plan all other work to minimize contact between workers 5. Re-usable PPEs should be thoroughly cleaned after use and not shared between workers 6. Single use PPEs should be disposed of so that it cannot be reused 7. Ensure regular cleaning of touch points, doors, buttons etc. 8. Increase ventilation in enclosed spaces 9. Ensure regular cleaning of equipment and between use by different operators. 10. A site-specific COVID-19 Officer (who may also be the Health and Safety Officer) shall be designated for every site. 11. The COVID-19 Officer shall certify that the contractor and all subcontractors are in full compliance with these guidelines. Site Meetings 1. Only absolutely necessary meeting participants should attend 2. Attendees should be seated two metres apart from each other 3. Rooms should be well ventilated or windows opened to allow fresh air circulation if the meetings are going to be held in rooms 4. Consider holding meetings in open areas where possible. If you are exhibiting any of the COVID-19 symptoms , you are to report this to your supervisor (via phone, text or email) right away, and head home from the job site or stay home if already there. 2. If you notice a co-worker showing signs or complaining about such symptoms, he or she should be directed to their supervisor (via phone, text or email) and asked to leave the project site immediately. Self-Certify Prior to Shift Prior to starting a shift, each employee will self-certify to their supervisor that they: 1. Have no signs of a fever or a measured temperature above 37 degrees celcius or greater, a cough or trouble breathing within the past 24 hours. 2. Have not had "close contact" with an individual diagnosed with COVID-19. “Close contact� means living in the same household as a person who has tested positive for COVID-19, caring for a person who has tested positive for COVID-19, being within 6 feet of a person who has tested positive for COVID-19 for about 15 minutes, or coming in direct contact with secretions (e.g., sharing utensils, being coughed on) from a person who has tested positive for COVID-19, while that person was symptomatic. 3. Have not been asked to self-isolate or quarantine by their doctor or a local public health official. Observations ✓ Avoid touching eyes, nose, and mouth with your hands ✓ To avoid sharing the virus, DO NOT make others responsible for moving, unpacking and packing up your personal belongings ✓ If you or a family member is feeling ill, stay home! ✓ When entering a machine or vehicle which you are not sure you were the last person to enter, make sure that you wipe down the interior and door handles with disinfectant prior to entry. ✓ Do all you can to maintain your good health by: • getting adequate sleep; • eating a balanced, • healthy diet, • avoid alcohol; • and consume plenty of fluids (water). Disinfection will be conducted with personnel, equipment, and material approved for COVID-19 sanitization or disinfection. 3. Identified areas should remain isolated from workers until sanitation process has been completed and area is deemed safe for use. Taps and washing facilities 2. Toilet flush and seats 3. Door handles and push plates 4. Handrails on staircases and corridors 5. Machinery and equipment controls 6. Construction equipment and tools 7. Food preparation and eating surfaces 8. Telephone equipment 9. Keyboards, photocopiers, and other office equipment 10. Rubbish collection and storage points should be increased and emptied regularly throughout and at the end. Cleaners should ensure they wear the required PPEs (gloves, mask etc) to undertake cleaning activities Sanitation Requirements 1. Conclusion: For all construction projects to be undertaken, the Guideline shall be enforced for compliance by the GWCL PPD, Supervising Consultants, and the Metropolitan and Municipal Assembly where the project is located. The MSWR/GWCL/PPD has the lead responsibility for compliance and enforcement including frequent on-site inspections by the Officers and with the authority to shut down work at the site if violations are found. Appendix N WORLD BANK TECHNICAL NOTE: PUBLIC CONSULTATIONS AND STAKEHOLDER ENGAGEMENT IN WB-SUPPORTED OPERATIONS WHEN THERE ARE CONSTRAINTS ON CONDUCTING PUBLIC MEETINGS With the outbreak and spread of COVID-19, people have been advised, or may be mandated by national or local law, to exercise social distancing, and specifically to avoid public gatherings to prevent and reduce the risk of the virus transmission. Countries have taken various restrictive Update of GWCL Water Supply Master Plan for GAMA Draft Environmental and Social Management Plan: Batch 3 measures, some imposing strict restrictions on public gatherings, meetings and people’s movement, and others advising against public group events. At the same time, the general public has become increasingly aware and concerned about the risks of transmission, particularly through social interactions at large gatherings. These restrictions have implications for World Bank-supported operations. In particular, they will affect Bank requirements for public consultation and stakeholder engagement in projects, both under implementation and preparation. WHO has issued technical guidance in dealing with COVID-19, including: (i) Risk Communication and Community Engagement (RCCE) Action Plan Guidance Preparedness and Response; (ii) Risk Communication and Community engagement (RCCE) readiness and response; (iii) COVID-19 risk communication package for healthcare facilities; (iv) Getting your workplace ready for COVID-19; and (v) (v) a guide to preventing and addressing social stigma associated with COVID-19. All these documents are available on the WHO website through the following link: https://www.who.int/emergencies/diseases/novel-coronavirus-2019/technical-guidance. This Note offers suggestions to World Bank task teams for advising counterpart agencies on managing public consultation and stakeholder engagement in their projects, with the recognition that the situation is developing rapidly and careful regard needs to be given to national requirements and any updated guidance issued by WHO. It is important that the alternative ways of managing consultation and stakeholder engagement discussed with clients are in accordance with the local applicable laws and policies, especially those related to media and communication. The suggestions set out below are subject to confirmation that they are in accordance with existing laws and regulations applying to the project. Investment projects under implementation. All projects under implementation are likely to have public consultation and stakeholder engagement activities planned and committed as part of project design. These activities may be described in different project documents, and will involve a variety of stakeholders. Commonly planned avenues of such engagement are public hearings, community meetings, focus group discussions, field surveys and individual interviews. With growing concern about the risk of virus spread, there is an urgent need to adjust the approach and methodology for continuing stakeholder consultation and engagement. Taking into account their importance of confirming compliance with national law requirements, below are some suggestions for task teams’ consideration while advising their clients: Task teams will need to review their project, jointly with the PMUs, and should: • Identify and review planned activities under the project requiring stakeholder engagement and public consultations. • Assess the level of proposed direct engagement with stakeholders, including location and size of proposed gatherings, frequency of engagement, categories of stakeholders (international, national, local) etc. • Assess the level of risks of the virus transmission for these engagements, and how restrictions that are in effect in the country / project area would affect these engagements. • Identify project activities for which consultation/engagement is critical and cannot be postponed without having significant impact on project timelines. For example, selection of resettlement options by affected people during project implementation. Reflecting the specific activity, consider viable means of achieving the necessary input from stakeholders (see further below). • Assess the level of ICT penetration among key stakeholder groups, to identify the type of communication channels that can be effectively used in the project context. Based on the Update of GWCL Water Supply Master Plan for GAMA Draft Environmental and Social Management Plan: Batch 3 above, task teams should discuss and agree with PMUs the specific channels of communication that should be used while conducting stakeholder consultation and engagement activities. The following are some considerations while selecting channels of communication, in light of the current COVID-19 situation: • Avoid public gatherings (taking into account national restrictions), including public hearings, workshops and community meetings. • If smaller meetings are permitted, conduct consultations in small-group sessions, such as focus group meetings. If not permitted, make all reasonable efforts to conduct meetings through online channels, including Webex, zoom and skype. • Diversify means of communication and rely more on social media and online channels. Where possible and appropriate, create dedicated online platforms and chatgroups appropriate for the purpose, based on the type and category of stakeholders. • Employ traditional channels of communications (TV, newspaper, radio, dedicated phone-lines, and mail) when stakeholders to do not have access to online channels or do not use them frequently. Traditional channels can also be highly effective in conveying relevant information to stakeholders, and allow them to provide their feedback and suggestions. • Where direct engagement with project affected people or beneficiaries is necessary, such as would be the case for Resettlement Action Plans or Indigenous Peoples Plans preparation and implementation, identify channels for direct communication with each affected household via a context specific combination of email messages, mail, online platforms, dedicated phone lines with knowledgeable operators. • Each of the proposed channels of engagement should clearly specify how feedback and suggestions can be provided by stakeholders. • An appropriate approach to conducting stakeholder engagement can be developed in most contexts and situations. However, in situations where none of the above means of communication are considered adequate for required consultations with stakeholders, the team should discuss with the PMU whether the project activity can be rescheduled to a later time, when meaningful stakeholder engagement is possible. Where it is not possible to postpone the activity or where the postponement is likely to be for more than a few weeks, the task team should consult with the OESRC to obtain advice and guidance. Investment projects under preparation. Where projects are under preparation and stakeholder engagement is about to commence or is ongoing, such as in the project E&S planning process, stakeholder consultation and engagement activities should not be deferred, but rather designed to be fit for purpose to ensure effective and meaningful consultations to meet project and stakeholder needs. Some suggestions for advising clients on stakeholder engagement in such situations are given below. These suggestions are subject to the coronavirus situation in country, and restrictions put in place by governments. The task team and the PMU should: • Review the country COVID-19 spread situation in the project area, and the restrictions put in place by the government to contain virus spread. • Review the draft Stakeholder Engagement Plan (SEP, if it exists) or other agreed stakeholder engagement arrangements, particularly the approach, methods and forms of Update of GWCL Water Supply Master Plan for GAMA Draft Environmental and Social Management Plan: Batch 3 engagement proposed, and assess the associated potential risks of virus transmission in conducting various engagement activities. • Be sure that all task team and PIU members articulate and express their understandings on social behavior and good hygiene practices, and that any stakeholder engagement events be preceded with the procedure of articulating such hygienic practices. • Avoid public gatherings (taking into account national restrictions), including public hearings, workshops and community meetings, and minimize direct interaction between project agencies and beneficiaries / affected people. • If smaller meetings are permitted, conduct consultations in small-group sessions, such as focus group meetings. If not permitted, make all reasonable efforts to conduct meetings through online channels, including Webex, zoom and skype meetings. • Diversify means of communication and rely more on social media and online channels. Where possible and appropriate, create dedicated online platforms and chatgroups appropriate for the purpose, based on the type and category of stakeholders. • Employ traditional channels of communications (TV, newspaper, radio, dedicated phone-lines, public announcements and mail) when stakeholders do not have access to online channels or do not use them frequently. Such channels can also be highly effective in conveying relevant information to stakeholders, and allow them to provide their feedback and suggestions. • Employ online communication tools to design virtual workshops in situations where large meetings and workshops are essential, given the preparatory stage of the project. Webex, Skype, and in low ICT capacity situations, audio meetings, can be effective tools to design virtual workshops. The format of such workshops could include the following steps: • Virtual registration of participants: Participants can register online through a dedicated platform. • Distribution of workshop materials to participants, including agenda, project documents, presentations, questionnaires and discussion topics: These can be distributed online to participants. • Review of distributed information materials: Participants are given a scheduled duration for this, prior to scheduling a discussion on the information provided. • Discussion, feedback collection and sharing: • Participants can be organized and assigned to different topic groups, teams or virtual “tables� provided they agree to this. • Group, team and table discussions can be organized through social media means, such as Webex, skype or zoom, or through written feedback in the form of an electronic questionnaire or feedback forms that can be emailed back. • Conclusion and summary: The chair of the workshop will summarize the virtual workshop discussion, formulate conclusions and share electronically with all participants. • In situations where online interaction is challenging, information can be disseminated through digital platform (where available) like Facebook, Twitter, WhatsApp groups, Project weblinks/ websites, and traditional means of communications (TV, newspaper, radio, phone calls and mails with clear description of mechanisms for providing feedback via mail and / or dedicated telephone lines. All channels of communication need to clearly specify how stakeholders can provide their feedback and suggestions. Update of GWCL Water Supply Master Plan for GAMA Draft Environmental and Social Management Plan: Batch 3 • Engagement with direct stakeholders for household surveys: There may be planning activities that require direct stakeholder engagement, particularly in the field. One example is resettlement planning where surveys need to be conducted to ascertain socioeconomic status of affected people, take inventory of their affected assets, and facilitate discussions related to relocation and livelihood planning. Such survey activities require active participation of local stakeholders, particularly the potentially adversely affected communities. However, there may be situations involving indigenous communities, or other communities that may not have access to the digital platforms or means of communication, teams should develop specially tailored stakeholder engagement approaches that will be appropriate in the specific setting. The teams should reach out to the regional PMs for ENB and Social Development or to the ESSA for the respective region, in case they need additional support to develop such tailored approaches. • In situations where it is determined that meaningful consultations that are critical to the conduct of a specific project activity cannot be conducted in spite of all reasonable efforts on the part of the client supported by the Bank, the task team should discuss with the client whether the proposed project activities can be postponed by a few weeks in view of the virus spread risks. This would depend on the COVID-19 situation in the country, and the government policy requirements to contain the virus spread. Where it is not possible to postpone the activity or where the postponement is likely to be for more than a few weeks, the task team should consult with the OESRC to obtain advice and guidance. Update of GWCL Water Supply Master Plan for GAMA Draft Environmental and Social Management Plan: Batch 3 APPENDIX O: GENERAL ENVIRONMENTAL AND SOCIAL CLAUSES FOR CONSTRUCTION CONTRACTS In order to ensure the proposed mitigation measures are implemented by the Contractor as well as other responsible parties, the following Contractual Clauses are to be inserted into the Works Contract for the Contractors executing the works: General 1. In addition to these general conditions, the Contractor shall comply with any specific Environmental and Social Management Plan (ESMP) for the works for which he/she is responsible. The Contractor shall inform himself about such an ESMP, and prepare his work strategy and plan to fully incorporate relevant provisions of that ESMP. If the Contractor fails to implement the approved ESMP after written instruction by the Supervising Engineer (SE) of the Project Consultant to fulfil his obligation within the requested time, the client reserves the right to arrange through the SE for execution of the missing action by a third party on account of the Contractor. 2. Notwithstanding the Contractor's obligation under the above clause, the Contractor shall implement all measures necessary to avoid undesirable adverse environmental and social impacts wherever possible, restore work sites to acceptable standards, and abide by any environmental performance requirements specified in an ESMP. In general, these measures shall include but not be limited to: i. Minimize the effect of dust on the surrounding environment resulting from earth mixing sites, vibrating equipment, temporary access roads, etc to ensure safety, health and the protection of workers and communities living in the vicinity dust producing activities. ii. Ensure that noise levels emanating from machinery, vehicles, and noisy construction activities (e.g. excavation) are kept at a minimum for the safety, health, and protection of workers within the vicinity of high noise levels and nearby communities. iii. Prevent oils, lubricants and waste water used or produced during the execution of works from entering rivers, streams, and other natural water bodies/reservoirs, and also ensures that stagnant water in uncovered trenches is treated in the best way to avoid creating possible breeding grounds for mosquitoes. iv. Upon discovery of ancient heritage, relics or anything that might or believed to be of archaeological or historical importance during the execution of works,' immediately report such findings to the Site Engineer so that the appropriate authorities may be expeditiously contacted for fulfilment of the measures aimed at protecting such historical or archaeological resources. v. Implement soil erosion control measures in order to avoid surface run off and prevents siltation, etc. vi. Ensure that garbage, sanitation and drinking water facilities are provided for construction workers. vii. Ensure that, in as much as possible, local materials are used to avoid importation of foreign material and long-distance transportation. viii. Ensure public safety and meet traffic safety requirements for the operation of work to avoid accidents. ix. Ensure contractor workers do not involve themselves in sexual activities with the girls or women in the project communities. Update of GWCL Water Supply Master Plan for GAMA Draft Environmental and Social Management Plan: Batch 3 3. The Contractor shall indicate the period within which he/she shall maintain status on site after completion of civil works to ensure that significant adverse impacts arising from such works have been appropriately addressed. 4. The Contractor shall adhere to the proposed activity implementation schedule and the monitoring plan/strategy to ensure effective feedback of monitoring information to project management so that impact management can be implemented properly, and if necessary, adapt to changing and unforeseen conditions. 5. Besides the regular inspection of the sites by the SE for adherence to the contract conditions and specifications, the client may appoint an Inspector to oversee the compliance with these environmental conditions and any proposed mitigation measures. State environmental authorities may carry out similar inspection duties. In all cases, as directed by the SE, the Contractor shall comply with directives from such as inspectors to implement measures required to ensure the adequacy of rehabilitation measures carried out on the biophysical environment and compensation for socio-economic disruption resulting from implementation of any works. Water Resources Management 6. No construction material containing spoils or site effluent, especially cement and oil, shall be allowed to flow into natural water drainage courses. 7. Wash water from washing equipment shall not be discharged into road drains 8. Site spoils and temporary stockpiles shall be located away from the drainage system and surface run off shall be directed away from stockpiles to prevent erosion. Traffic Management 9. Location of access roads/detours shall be done in consultation with the local community especially in important or sensitive environments. Access roads shall not traverse wetland areas. 10. Upon the completion of civil works, all access roads shall be ripped and rehabilitated. 11. Access roads shall be sprinkled with water at least five times a day in settled areas, and three times in unsettled areas, to suppress dust emissions. 12. The Contractor will be required to prepare a traffic management plan detailing out diversions and other measure to minimise traffic congestion and human-vehicular conflicts for approval by the SE. Disposal of Unusable Elements 13. Unusable materials and construction elements such as electro-mechanical equipment, pipes, accessories and demolished structures will be disposed of in a manner approved by the EPA and supervised by the SE of the project consultant. The Contractor has to agree with the SE which elements are to be surrendered to the Client’s premises, which will be recycled or reused, and which will be disposed of at approved landfill sites. 14. As far as possible, abandoned pipelines shall remain in place. Where for any reason no alternative alignment for the new pipeline is possible, the old pipes shall be safely removed by a specialised team in the manner prescribed by GIIP and disposed in a safe manner at a safe place to be agreed upon with the SE and the local authorities concerned. 15. AC-pipes as well as broken parts thereof have to be treated as hazardous material and disposed of as specified above. 16. Unsuitable and demolished elements shall be dismantled to a size fitting on ordinary trucks for transport. 17. Left over materials will be collected and used for other purposes. Update of GWCL Water Supply Master Plan for GAMA Draft Environmental and Social Management Plan: Batch 3 Health and Safety 18. In advance of the construction work, the Contractor shall mount an awareness and hygiene campaign. Workers and local residents shall be sensitized on health risks particularly of AIDS. 19. Adequate road signs to warn pedestrians and motorists of construction activities, diversions, etc shall be provided at appropriate points. 20. Construction vehicles shall not exceed maximum speed limit of 20km per hour. 21. Construction vehicles shall not exceed maximum speed limit of 20km per hour in the LIUCs Gender Based Violence, Illicit Sexual Affairs, HIV/AIDs and STI Awareness 22. The Contractor shall prepare a Gender Based Violence Action Plan to be approved by the PIU prior to commencement of works and implement same during the construction phase 23. to The Contractor shall undertake HIV/AIDs awareness in the beneficiary communities targeting young women/girls as well as his own employees and present accompanying reports to the SE and Ghana Water Company Limited. 24. Contractors shall clearly state in their contracts with employees and third-party suppliers that they do not condone rape, defilement, and illicit sexual behaviour - together with sanctions for breaching these provisions. 25. Works Foreman shall report any incidence of rape, defilement or other illicit sexual affairs to the SE and the nearest police station. Contractor's Health, Safety, and Environment Management Plan (HSE-MP) 26. Within 6 weeks of signing the Contract, the Contractor shall prepare an EHS-MP to ensure the adequate management of the health, safety, environmental and social aspects of the works, including implementation of the requirements of these general conditions and any specific requirements of an EMP for the works. The Contractor's EHS-MP will serve two main purposes: i. For the Contractor, for internal purposes, to ensure that all measures are in place for adequate HSE management, and as an operational manual for his staff. ii. For the Client, supported where necessary by a SE, to ensure that the Contractor is fully prepared for the adequate management of the HSE aspects of the project, and as a basis for monitoring of the Contractor's HSE performance. 27. The Contractor’s EHS-MP shall provide at least: i. A description of procedures and methods for complying with these general environmental management conditions, and any specific conditions specified in the ESMP; ii. A description of specific mitigation measures that will be implemented in order to minimize adverse impacts; iii. A description of all planned monitoring activities (e.g. sediment discharges from borrow areas) and the reporting thereof; and iv. The internal organizational, management and reporting mechanisms put in place for such. 28. The Contractor’s EHS-MP will be reviewed and approved by the PMU before start of the works. This review should demonstrate if the Contractor’s EHS-MP covers all the identified impacts, and has defined appropriate measures to counteract any potential impacts. HSE Reporting 29. The Contractor shall prepare bi-weekly progress reports to the SE on compliance with these general conditions, the project EMP if any, and his own EHS-MP. An example format for a Update of GWCL Water Supply Master Plan for GAMA Draft Environmental and Social Management Plan: Batch 3 Contractor HSE report is given below. It is expected that the Contractor’s reports will include information on: i. HSE management actions/measures taken, including approvals sought from local or national authorities; ii. Problems encountered in relation to HSE aspects (incidents, including delays, cost consequences, etc. as a result thereof) iii. Changes of assumptions, conditions, measures, designs, and actual works in relation to HSE aspects; and iv. Observations, concerns raised and/or decisions taken with regard to HSE management during site meetings 30. It is advisable that reporting of significant HSE incidents be done “as soon as practicable". Such incident reporting shall therefore be done individually. Also, it is advisable that the Contractor keeps his own records on health, safety and welfare of persons, and damage to property. It is advisable to include such records, as well as copies of incident reports, as appendices to the bi- weekly reports. An Example formats for an incident notification and detailed report are given below. Details of HSE performance will be reported to the Client through the SE’s reports to the Client. Labour Relations 31. The Contractor shall prepare a site specific labour influx management plan for approval by the PIU and implement same prior to the commencement of works. 32. The contractor shall not employ minors (below 18 years) as part of his casual of permanent employees 33. The contractor shall not engage in forced labour of kind including forcing employees to work on statutory holidays 34. The contractor shall not procure good or services from third party suppliers that that engage child or forced labour 35. The contractor in his recruitment shall not discriminate by gender, religion and ethnicity. 36. The contractor shall set up a fair and transparent work-based grievance redress system headed by a management member and protect aggrieved employees against discrimination and persecution. Training of Contractor's Personnel 37. The Contractor shall provide sufficient training to his own personnel to ensure that they are all aware of the relevant aspects of these general conditions, any project ESMP and his own EHS- MP and are able to fulfil their expected roles and functions. Specific training should be provided to those employees that have particular responsibilities associated with the implementation of the EHS-MP. General-topics should be: i. HSE in general (working procedures); ii. Emergency procedures; and iii. Social and cultural aspects (awareness creation on social issues). Cost of Compliance 38. It is expected that compliance with these conditions is already part of standard good workmanship and state of art as generally required under this Contract. The item “Compliance with Environmental Management Conditions" in the Bill of Quantities covers these costs. No other payments will be made to the Contractor for compliance with any request to avoid and/or mitigate an avoidable HSE impact.
