However the overall implementation has slowed down during the review period. The most significant delays are related to provision of project support on child deinstitutionalization to the additional five selected regions under Component 3. Given delays and the limited time before project closure, in August 2018 the World Bank team and the MoSP agreed to cancel geographical expansion of activities under Component 3 of the Project to these five oblasts. Thus, support will be provided to three regions, namely to Kyivska, Chernihivska, and city of Kyiv. While disbursements were low during the review period, due to progress on the development of the MIS E-Social, commitments under Component 2 have increased by almost USD$10 million. In addition, the MoSP has completed the inspection of 80% of all GMI beneficiaries’ cases, thus achieving DLI 9, which will trigger a disbursement of USD$10 million before the end of 2018. Considering the slower than average implementation and the risks to achieving the PDO because of delay in establishing of Social Inspectorate, the Project rating is downgraded to Moderately Satisfactory. The PDI 2 is measuring the increase in the GMI budget in nominal terms with a targeted value of at least three-fold increase. In 2017, the GMI budget was twice as big as it was in 2014. The most recent data on GMI budget spending in 2018 showed that the GMI budget is 2.6 times bigger than it was in 2014. Thus, two IDIs show progress toward achieving the PDO. In particular, it envisages that lacking efforts on the part of unemployed able-bodied members of such families aimed at their employment shall be a ground for termination of the state social assistance to low- income families payment. Such an approach is aimed at overcoming consumer's attitude to getting the assistance, increasing motivation of the unemployed persons, who receive the state social assistance to low- income families, to finding a job or other sources of subsistence, and at ensuring targeted use of budget funds assigned for these purposes. 2. The Cabinet of Ministers of Ukraine Resolution "On Amendments to certain Resolutions of the Cabinet of Ministers of Ukraine" dated November 30, 2016, # 890 that envisages accrual of the dummy-income to physical persons-entrepreneurs having chosen the simplified taxation system that are members of families participating in GMI program (irrespective of their real income/lack of income) in the following amounts: two able-bodied subsistence minimums for the entrepreneurs of Simplified Taxation Group I, three subsistence minimums for the entrepreneurs of Group II, and four subsistence minimums for the entrepreneurs of Group III. This means that the dummy-income will be accrued even if the person does not work. This provision eliminates factor of non-accounting unofficial income when granting the social assistance. In addition, it was simplified the procedure of citizens' addresses for residents of united territorial communities, Comments: when they apply for social assistance to low-income families, to families with children, to persons taking care for a disabled person of 1st or 2nd group due to mental disorder, etc. At present, the citizens have no need to apply directly to their raion office for social protection of the population to submit documents for social assistance. An authorized person in the united territorial community shall provide consultations, receive documents for granting all types of social assistance and transfer them to a local body for social protection of the population (local welfare office). The local welfare office having received the documents shall form personal files for each beneficiary of the assistance, grant all types of social assistance, form applications for their payment and submit to them to the Treasury Service. It shall pay the benefits to recipients through offices of authorized banks or post-offices; 3. The joint Order of the Ministry of Social Policy, the Ministry of Finance, and the State fiscal service on approval of the procedure for delivery of information from the State register of natural persons–tax payers regarding income (lack of income) got by individuals who have applied for the state social assistance (Order No. 1287/926 dated November 04, 2016 registered in Ministry of Justice on December 01, 2016 under No. 1558/29688). The order will promote the interagency data exchange for checking the declared information about a person's income, and therefore, will increase targeting accuracy of the program; 4. The Order of the Ministry of social policy "On approval of the Procedure for delivery in electronic form the information from the register of insured persons at the state register of compulsory state social insurance to bodies of labor and social protection of the population" (Order No. 252 dated February 20, 2017). The Cabinet of Ministers of Ukraine Resolution dated August 9, 2017 # 576 "Om amendment of the Typical regulation on a commission for protection of a child's rights and the Regulation on a general educational institution" that set forth restraints for children's placement into residential institutions upon request from their parents. In particular, it is provided for that enrollment of educatees in a general educational residential institution of degree I–III may take place only upon condition that upbringing and care of the child is complicated for health reasons or because of unusual working hours of the child's parents or persons in loco parentis (prolonged hospitalization, traveling nature of work, shiftwork, rotation based work) or if at the time of taking the decision there is no possibility for placement the orphan or the child without parental care in family based forms of care. The approach is aimed at preventing children's placement in residential institutions and preserving the possibility of upbringing the child in family environment. In addition, it was approved the Regulation on the interagency consulting and advisory group on reform of children's residential institutions (facilities) responsible for ensuring interagency cooperation in the process of reforming the institutional care system for children in the child's best interests (MOSP's order dated May 11, 2017 No. 759. The State standard of the social service "Social support of families upbringing orphans and children without parental care" (MOSP’s order dated August 11, 2017 #1307, registered in the Ministry of Justice of Ukraine on October10, 2016 under #1367/29497) that defines content, scope, conditions, and procedure for delivery the social service "Social support of families upbringing orphans and children without parental care" and parameters of its quality. Use of the social standard will ensure better quality of the social service "Social support of families upbringing orphans and children without parental care" delivery to ensure their best interests and will contribute to readiness of the children to live independently outside the family. Moreover, there has been adopted a number of regulatory and legal acts that will contribute to the expansion of family based forms of care for orphans and children without parental care, and to the reform of children's residential institutions. In particular: • A new edition of the Typical regulation on a children's residential-type care facility (MOSP) (Resolution of the Cabinet of Ministers of Ukraine dated December 14, 2016 No. 978) that envisages establishment of various innovative units/departments at the residential institutions - for day care, for 5/7 inpatient treatment, for transitional stay, supported living, or palliative care. This will provide a possibility of upbringing children with disabilities in families and integrating educatees of the facilities into the local community. Such innovations will contribute to a gradual transition to delivery of social services in non-institutional forms; • The Procedure for creation and performance of the patronage tutor's family, placement and staying the child in the patronage tutor family (resolution of the Cabinet of Ministers of Ukraine dated March 16, 2017 No. 148) that defines a mechanism for the creation and organization of activity of the patronage tutor's family, placement and staying a child in the family. This is a tool that provides a possibility of protecting rights of a child, that temporary cannot stay with his/her parents/legal representatives because of difficult life circumstances, of delivering services (to the child and his/her family) aimed at returning the child to the family and preventing placement of the child into an institutional facility; • The Regulation on mentorship (Resolution of the Cabinet of Ministers of Ukraine dated July 4, 2017 No. 465) that defines a mechanism for organization, implementation and maintenance of mentorship over the child staying in an institution for orphans and children without parental care, or other facility for children, which provides individual support and assistance to the child, particularly in preparing for independent life. It should also be mentioned that the Government has approved the National strategy of reforming the system of institutional care and upbringing of children for 2017-2026 and the Action Plan for the Step I implementation (Regulation of the Cabinet of Ministers of Ukraine dated August 9, 2017 No. 526-R), the purpose of which is to replace the system of institutional care and children's upbringing with a system that ensures care and upbringing of any child in family-based or family-like environment. It is envisaged to implement goals and assignments defined in the Strategy in three steps. At the first (preparatory) step (2017- 2018), it is envisaged to develop and adopt the regulatory and legal acts required for implementation of the institutional care and upbringing of children, and organize methodological support; to analyze the existing network of institutional care units for children in order to assess observance of the right of a child for upbringing in a family and approve regional plans for reforming the system of institutional care and upbringing of children; to form and train regional teams on the Strategy implementation; to develop programs for training and retraining of specialists, particularly those working with disabled children; to develop criteria for monitoring of the institutional care and upbringing of children system reform process. At the second step (2019-2024), there shall be implementation of the reform: implementation of the regional plans for reforming the system of children's institutional care; reform of institutions care facilities for children, in particular, by way of their liquidation or transformation into day care facilities for children; reducing the number of children in institutional care facilities and discontinuation of the practice of placing children under three years of age therein; ensuring availability of services for children and families with children in accordance with their needs at the territorial community level. At the third (final) step (2025-2026) there will be carried out a comprehensive analysis of the situation with observance the right of any child for upbringing in the family (by regions); analysis of efficiency for activities of central and local government bodies, local authorities aimed at the Strategy implementation: analysis of expected results achievement as provided in the Strategy (by regions); definition of strategic areas for further development of the system used for ensuring and protection of children's rights in Ukraine Also we would like to inform you regarding amendment to the Law of Ukraine "On the state budget for 2017" that envisages a subvention from the state budget to local budgets for construction, civil works, and reconstruction of small family-type homes, supported living homes, construction/purchase of housing for small family-type homes, social housing for orphans, children without parental care, and persons from among them, production of construction and design documentation. Practical use of the subvention funds will ensure a possibility of transferring children from institutional forms of care to the family based forms, to provide housing for children, graduates of residential institutions, small family-type homes and persons from among them.
