Date: A Mr. Donal Brown Head, Global Funds Department Global Funds Department, 7N1 Department for International Development I Palace Street London, SWIE 5HE Amendment to the Memorandum of Understanding between the Government of the United Kingdom of Great Britain and Northern Ireland and the International Bank for Reconstruction and Development (IBRD), as Trustee of the Trust Fund for the Global Fund to Fight AIDS, Tuberculosis and Malaria (MTO 069001) Dear Mr. Brown: We refer to the Memorandum of Understanding between the Government of the United Kingdom of Great Britain and Northern Ireland ("the Government") and the International Bank for Reconstruction and Development (IBRD), as Trustee of the Trust Fund for the Global Fund to Fight AIDS, Tuberculosis and Malaria (the "Trust Fund"), dated June 7, 2007, as amended (the "MoU"). We are pleased to acknowledge on behalf of IBRD the intention of the Government acting through the Department for International Development ("DFID") to make available to the IBRD, as Trustee of the Trust Fund, an additional contribution of Sixty-Four Million British Pounds Sterling (GBP 64,000,000) ("the 2014 Transition Additional Contribution") as a grant for the Trust Fund. The 2014 Transition Additional Contribution shall be allocated to the Trust Fund's sub-account for the "Affordable Medicines Facility for malaria ("AMFm") Co-Payment Fund". DFID will deposit the 2014 Transition Additional Contribution in accordance with the following schedule, payable in cash, into such bank account designated by IBRD and following a submission of a deposit request by IBRD upon notification by the Global Fund that the conditions below have been met, and evidence of need as indicated by the forecast AMFm Funding Balance provided by the Global Fund. (i) GBP 32,000,000 before the end of December 2013 (ii) GBP 16,000,000 before the end of June 2014 (iii) GBP 16,000,000 before the end of September 2014 -2- * Confirm that supporting interventions will be funded through core Global Fund to Fight AIDS, Tuberculosis and Malaria (GFATM) grants in a timely manner in each transition country ahead of anti-malarial co- payment approvals; * Confirm before September 2014 (for Kenya, Nigeria and Uganda) how these AMFm pilot countries being supported through the 2014 Transition Additional Contribution will move to full integration of grant management and financial processes, should such countries wish to request the use of grant funds for a private sector subsidy to achieve their malaria case management targets and utilize supporting interventions, including a timetable reflecting full country consultation; and * Review across the current AMFm pilot countries the potential for further strengthening malaria regulatory and policy dialogue alongside this 2014 Transition Additional Contribution support, to maximize the impact of the new iterative country dialogue process (under GFATM's 'New Funding Model'). Regular monitoring, oversight and reporting by the Global Fund on the use of DFID funds will be maintained as per agreed under DFID's February 2012 Business Case. Logframe indicators will be tracked as part of the new DFID Global Fund Replenishment business case, with Health Action International (HAI) price and availability surveys commissioned by the Global Fund to be carried out three times over 2014 for these three countries. A cost consequences study of AMFm is currently underway commissioned by GFATM. This will be reported back and shared with AMFm donors in the second quarter of 2014. The payment schedule may be amended on request and with DFID's approval depending on actual need and expenditure. IBRD will disclose this Amendment and related information in connection with the Trust Fund in accordance with the World Bank Policy on Access to Information. By entering into this agreement, DFID consents to such disclosure. All other terms of the MoU shall remain the same. This letter shall, upon your confirmation in the manner indicated below, constitute a supplement and amendment to the MoU between DFID and IBRD effective as of the date first above written. -3 - This letter may be signed in counterpart and all counterparts shall be taken to be one and the same instrument.
