˘ . ; , -s*; - of C,I LAND ACQUISTION AND REMN PLAN Ri'jjAREA OF XIJIANG INLAND WATERWAY MULTIPURPOSE PROJECT GUANGXI, PEOPLES REPUBLIC OF CHINA Guangxi Communications Departnent May11995 to. *v Land AcEisition & Re-allocation Plan in Darn Area of Ggaia MliHang IWW Multipurpose Proiect I. Desaiiption The acquired land in dm area of Guigang Navigaton Complex refers to the land used for the permanem structres construction and temporary facilities for the projecL the ship lock on dam and channel, power station building, switch station and buildings for living an management. For part of land used for the project, the land acqisitton and removal uns be completed m the course of the project preparaion so as to guaramee the project to be started at the end of 1994 as per the schedule. In the first half of the year 1993, Gugang Government establisled the offtce for the preparaton of Guigang Navigation Complex. 14 cadres with rich experience are assined to work on land acquisition, removal and re-allocation of the project. In July 1993. Guangxi Waterway Consmrction Adminis on has set up a group working on land requisition to cooperae with Guigang Government to proceed the Land acquisiton, removal and re-allocation. After the investgaion at sie, the checking of half a year and the sufficient persuasion to the farmers, the farmers and the depaqments concerned in Shika Town, Xitang Town Govern-m Luhun Vlllage, Dazheng Village and Shanbian Village have given a lot of help to ihe project, so the land has been supplied in tum by the farmers for the project construcion in accordance widh the working progress. The land acquisition in dam area has been conmpleted. 11. The ar of acquired land, removal, and re-ailocation The peranmt acquired land in dam area totals 1509.458 mu including 157.73 mu of paddy Lnd and 1351.728 mu of sugar-cane land. Land acquisition under the dam includes acquisition for the following other civd works ichled in the projectz Shiplock 620 mu; Dam 35 mu; Power Plant 60 mu, Access road 155 mu; Bridge 40 nm; Admirnstratio office 150 nm; Temporqy facility for constuctin 380 mu; Other 69.45 mu. Ihe land acquisition affected 3934 pesons from 21 production brigades of 3 villages from Shika Town and Xintang Town, including 1560 pesn' households registration to be tramferred fronm agriculral to urban. There will be 914 laborers for re-allocation and 7 residences for removal with the area of 1508.76 sq.m. (includine 1051.98 sq.m. of residences anti 456.78 sq.m. of warehouse)- Th- area of buildings affected by the dam is given in Table 1. The details are on Table 3 (1) - (3). Iln. Land acqusition fee and removal fee The cost of rebuilding.the affected structure is given in Table 1. The informaon on compensation rates and the total compensation for the farmlands affected is given in Table 2. Land acquisition fee has been paid to the farners. Based on the regulatons in the documens 'Land Administration& Implementation Acts of Guangxi People's Republic of China" and TLand Administaton & Implementation Acts of Guangxi - (i) Land comensaEion fee: The land acquisition started at the end of August. 1993. Before proceeding land acquisition. under the help of Guigang People's Government, Lhe joint survey panel was organized from Guigang Construction Commmee, Guigang Land Administration, Guigang Auit. Admitration, and Guigang Cormnodity Price Administraon. Spending nearly 3 months frm June to August, the detailed survey for crops & producion value for 6 -2- villages & townships of Slika, Xintang, Qiaoxu. Watani, Fucheng and Daling has been completed. The year-end reports submitted by the local villages and town-ships govermment were referred again by the land acquisition executive agent before 3 years of land acquisition (1991, 1992, & 1993). The year-end reports were cbecked, consulted by/with the relevant departments of villages & town-ships, and falized officially by documents after submitting to Guigang Goverment. (a) Paddy land acquisition: 6 times of anmnal average out value 3 years before the land acquisition. (b) Dry land acqision: 4 tmes of amnual average output value 3 years before the acquisition. (ii) Subsidy fee for reallocation: The subsidy fee for re-allocation will be paid as 3 tmes of average annual output per mu 3 years before the land acquistion. (iii) Land for urgent use, on which the young crops must be cleanrd off, wiUl be compensad ias per a crop per uit on the land to be required. The land compensation fee & subsidy fee for re-allocation mentioned above totals up to 13.1711 million yuan RUB. (iv) The compensation fee for other objects on the laid: (a) Plants on the acquired land; (b) Canals, road, and other facilities to be destroyed; and (c) Graves tD be removed. The compensaion for the mentioned above totals up to 1.71685 million yuan RMB. The details are on Table 4 (M)-2). Fee for buildings removal and reconstruction In dam area of Guigang Navigation Complex. there axe 7 families' residences with the area of 1508.76 sq-m to be removed and reonstucted. Up to November 1994, all the residences have been removzeand rebuilt within 200m inside their own bngade. The mvestment for the residence rebuilding is 0.29416 milion vuan RMB. The details are on Table 1. IV. The re-allocation plan The land acquisition in dam area covers 21 production brigade belong to 3 vilages of 2 towns. Besides, some labores can stil cultivate on the remaining land after land requisition (cultivatig area not less than that of the ongial). The Consuction Preparanon Department for Guigang Shupping Complex has been proceeding the reallocation actively for the surplus laborers after land acquisition. A satistic panel formed by the deparmnent specially and -3- the -village cadres with acquired land checked thoroughly the local produicton brigades' surplus laborers after land acquisition. A statistic panel formed by the department speciaUly and the village cadres with acquired land checked thoroughly the local production brigades' residence cards, then completed the household-by-household registration. Combming with the related regulaton of Land Law, it was calculated that there are still 914 laborers to be reallocated so as to maintain or raise their living quality [See Table 3 (3)]. Paying more atntion to the re- allocation of the farmers from acquired lands in dam area of Guigang Navigation Complex, Guigang Government has been preparing the unpienentation plan of the re-allocation after a sufficiem mvestigation. The re-allocation plan for 9 brigades is shown on Table 3 and 4. The preparation work is currenly underway for project constaucon, thus certain amount of temporary laborers are needed to work on the site, and the farmers whoe land is acquired, can have priority to be anranged on these jobs. Constuton brigades have been set up respectively in Shika Town and Xitang town to cooperate with the consrucion unit m the constrcton work. The arrangement and income of laborers are shown on Table 5. At the same time, the preparaion for arranging the surpls laborers working in related enterpises has been undertken simultaneously. According to the regulation Clause 31 of Chapter 4 from Land Administration Law of People's Republic of China, it is considered to arrange the laborers working in the village and townships' enterprises. If all the laborers cannot be arranged in these they will be arranged in urcipal enterprises. Based on this guiding ideology, consultato were made by Construction Preparation Department of Guigang Shipping Complex, unis whose land was acquird, the unmts who wdil use the land and the enterprise which will provide jobs to laborers. A reallocanon 'Leter of ntnion' was signed beEween the Constucio Preparain Department of Guigang Shipping Complex and the laborer aranging umis (dt nmmbers of sigmng inenton units & laborers arranged are shown m Table 4.) PAPs older dt 35 years will be offered m township and village enterprises or work on the dam site. Those too old to work will be offered a monthly stipend. Before proceeding the practical reallocation, the Construcion Preparation Department of Guigang Shipping Complex assigned their staff to get the knowledge of management & effectiveness of enterprises, to collect & analyze the information, when it is sure that the enterprises have the ability to ensure the reallocated laborers having a better life than before. then Construction Preparation Department started to proceed their work practicaly. The reallocation fee will be set according to the current related standard for reallocation fee. With the consultation with the enterprises and signg the realocaton intention, the reailoc3ion for the surplus laborers will be proceeded preferentialy. The reallocation subsidy for thie enterprises will be bom by the project. The realocated laborers does not need o pay. The procedure of reallocation is shown as follows: statistics for laborers-consulting with the enterprises-signing the intention-classinfyig the laborers-consuling with the reaHocated laborers- assigning to enterprises batch by batch. Based on the above 6 procedures for reallocation, the schedale is planned as: from May to June of 1994, the survey & statistics of the reallocated laborers; from July to October of 1994, consultation for reallec'-tion & getting knowledge of enterprises' manageiment frm -4-. NGvember to December of 1994, assigning the reallocation inteition with relevant enterprises; in January of 1995, classifying the laborers by ages as per the requirement of the inention; in Februay of 1995, geting puolic opinions from the reallocated laborers; after March of 1995, proceeding the realocation gradually. V. Tota investment for land acquisiton and removal in dam area (i) The investment for land acquiston and removal in dam area mchldes the land acquisition fee of 13-1711 millior. yuan RMB (including land acquisition fee, reallocation fee and young crops compensation. The total amount of the said 3 items for the individual village is shown in Table 6.), compensation fee for houses rebuilt of 0.29416 million yuan RMB and compensation fee for other objects on the land of 1.71685 million RMB. The investm3nt for the above mentioned is 15.18211 million yuan RMB. (ii) The compensation fee for farmers' realocation is 4.258 million yuan RMB. Ihe tot amount for the two items is 19.4401 million yuan RMB. VI. (ii) After land acquisition, farmers who are up to the standard of the employment will get the jobs, at the same time, Guangxi Waterway Construction Administrations and Guigang Government will sign an itention book with the employing units. The reallocanon work can be completed in 1995-1997. Before they get the jobs, the farmers will be arranged by Guangxi Waterway Construcon Administration to work in the project site. Currenly, the eligible farmers have been offered 3-year fixed contuacs for work on the job site. (iii) The individual income after land aMuisition: (a) After land acquisition, Zhe cutivation will be done by those whose household registation is not charged from the agicultural to urban population. The capita income in culivated area wil not be lower than the level before land acquisition. (b) After land acquisition, those whose household registration has been changed from agricultural to urban population will be paid with one-time subsidy of living expense; besides, they wil be engaged at family processing and commercial acvity in the commercial market to be built by the local government. According to the forecast, their annual average individuals income will be up to 230O-7500 yuan RME. (c) For those fiting for the employment condition whose household registration changed om agricultural to urban population. according to the income level of the present Guigang micipal enterprises and the employing units, the their annual average capita nome will be up to 3800-7400 yuan RMB, far higher than the income level before land acquisition. (d) With the compensation as per the regulatons concerned, the farmers, whose residences will be removed and rebuilt, can get a favor condition from Guangxi Waterway Construction Administration in residence rebuilding, such as helping with making the foundation level, constuction material transportation, etc. Review of standards of Living: Thr project will underake a review of the standards of living of the people affected by the damn and submit a report to the Bank by February 29, 1996. The condition of persons who residence registration will be changed from agricultnue to non-agricultre will receive particular attention during this review. Should the standards of living of any of these persons be lower than before the project, the prmiect will propose special rehabilitation measures. VI. Annex: 1. The Report and Handlmg for the Issues about Lnd Acquisition, Removal and Reallocation. -- MEASURES FOR GUARANTEEING THE INCOME OF FARMERS IN RESERVOIR FLOODED AREA DURING THE TRANSITION COURSE FROM PLANTING GRAIN TO FRUIT TREES Inside the reservoir area of Guigang Navigation Complex, 3800 farmers whose land wil be flooded have to trasit their work from grain pltig to &fit trees They will on seffing fiuts. We are planning to pay the compensanon fee for the land to the farmers at the end of 1995; m the meantime, cooperated wih the local govermnent, we will arrange the farmers to fiish the work of planting ft trees before the sprmg in 1996. Since the fruit ries to be pianted are of speeded- productive (such as Longan) and they yields in 3 years and highty yields in 5 years, the farmers can earn from the friits in the second half of the year of 1998 (according to the information from Fnint Development Office of Guigang City: a high quality Longan tree can yield 4.5 kg after it bemg plantted or two years that converts approxnmately 3000 yuan RMB per mu). In the second half of the year 2000, the farmers wil get a remarkable income from the highly yielded trees. Accordig to workig progress of the proposed project, the project will be strted il October 1994. On March 1, 1998, the first unit will be put nto operatn- It genrates elecrity by cofferdam water storage with the level of 39.4m, at this time, only part of cultiated land is to be flooded. Till the time of March 1, 1999, the last unit will be put into operation when the normal storage water level is 43.1 and the land acqdired in the reservoir area is flooded. It means that the culivated land will begin to be flooded at least thr-e years later, and one year later after that, all the acquired land wil be flooded. Therefore, in this thee years and a half, the farmers can cultvae their land lilke what they did before wthout any impas; besides, at the end of 1995, frnm the project cient-Gungxi Communications Deament, they will get the mfee for the ld acquisition, which can be used for planting fit trees; meanwhile they will aLso get the assistnce and guide for plntng fruit rees from the deparment concerned of the local goverment. During the period from March 1998 to March 1999, part of acquired cultivated land flooding will become all acquired cultivated land flooding. In this period. part of acquired cultivated land can be used, farmers can also make profit from planting fruit trees in the second half of the year 1998; however, the income might not make up for a loss caused by the cultivated land being flooded. Although the gains and losses in the whole reservoir area could be balanced, the gains might not meet the loss for socme individual farmers. The most serious is that all the acquured cultivated lanl will be flooded from March 1999 on, and fruit trees will highly yield in the second half of the year 2000. In order to ensure th6 normal income of the farmers in the transition period from grain planting to fruit trees planing (especially in the period from the year 1999 to 2000), we are going to let the farmers to interplant corns, cassava, etc. with fruit atees, so that they can increase their income and raise their exising living standard. The cost for this item will be borne by the project client and listed ir. the generaing cost of the power station- The re-allocation measure above mentioned to be adopted is detrmined after the site investigation and our review with the local government. With a fertile land and rich rainfall, this region is abounded in grain. subtropical fruits (Longan. Leechi, and banana) and economic crops (corns. cassava, etc.). In this region, there is a longer history and richer expenence for phlating -7- grain and economic crops. It is feasible to mterplant corns and cassava, etc. with fruik tees because the crotch of a fruit tree Ls smaller and the gap of trees is bigger; besides, coms and cassava have a stronger adaptability, especialy, cassava is a kind of high-yield crop with less investment. There is a Agncultre Insurance Company set by the local govermneme which gives the technical advice on plantng frit rees and economc crops, provides the isurnce for harvest and shows the information for sale in other areas. iGeneraBly speaking, the condition is ripe for the farmers to transit the grai planng to fmuit tees planing. Although the income is influenced m the transition period, the living stadard will be surely raised by imterplantg corns and cassava with fruit tres. ,~~~ -8- THE REPORT AND HANTDLING FOR THE ISSUES ABOUT LAND ACOUISIMON. REMOVAL. AND RE-ALLOCATION To cooperate with the project construction, the local goverment will sE up an Office of Land Acquisition. Removal and Re-allocation, which consists of the conscientious and actrve cade. This office will be responsible for the implementation of land acquisition removal, and reallocaton. The isses and other concenzed problems occurred, can be reported and handled by this office; it can be also reported to the Division of Appeal Reception set in the two counties (municipal) in reservoir area fr and then to Guangxi Comuications Departmenz. Guangxi Communication Department and Guigang Multipurpose Na viga- tion Planning and Prospecting lJstitute organized survey and investigation parties OI over 200 person time from the aerial survey team of Guangxi Survey and Drawing Bu- reau to make a site -isit to the reservoir area. With the support-and cooperation of the locai government and people. they m-nade complete surveys and investigations into rhe 12 affecrec' villages and small towns with 73 brigades (51 in Guigang City; 22 in -Hengxian County) and Xijiang Farmr.. After about two years of work, they completed the investigation on the potentially inundated objects based on the preliminary design of the Guigang Multipurpose Navigation Project. They completed ten drawings (1 10000) of reservoir inundation range w-ith a total area of 768. 90X lWtm(covering .. - 07cX% of the total planned area). of wh-icl. there are l1C field survey topographic drawings (1:2000). ( 16.70X106rn2). These drawings helped toclanrfy thereservclr headpond and defined potentially impacted resources. 1.
