Project Background The proposed Guiyang-Guangzhou Railway Project (Gui-Guang Line) is a new 857 km double track railway line starting from the city of Guiyang in Guizhou Province, running through the Guangxi Zhuang Autonomous Region, and ending at Guangzhou in Guangdong province, south China. The total investment of the entire project is RMB 79.97 million Yuan (US$ 11.75 billion), including a World Bank loan of US $300 million. The construction period is expected to last six years, commencing in late 2008. Commissioning of the line is proposed by early 2015. According to World Bank Operational Policy OP 4.01 Environmental Assessment, the proposed project is classed as a Category A project, due to the scale of potential environmental and social impacts and environmental sensitivities. As a result, the Bank required a full environmental impact assessment report. Chinese environmental assessment laws and regulations also required preparation of a full environmental assessment report. MOR retained China Railway Second Survey and Design Institute (SSDI) and China Railway Fourth Survey and Design Institute (FSDI) for EA preparation. Both institutes have Class A environmental impact assessment accreditation by Ministry of Environmental Protection (MEP). SSDI was responsible for EA preparation for the section from Guiyang to Hezhou (CK0+000- CK597+650), and FSDI was responsible for EA preparation for the section from Hezhou to Guangzhou (CK567+200-CK823+513). Two separate EIA reports were prepared in accordance with relevant provisions specified in Chinese EA laws/regulations and technical guidelines, as well as consideration of World Bank safeguard policies. A Consolidated EIA was then prepared by SSDI to synthesize the two separate EIA reports into one comprehensive summary and submitted to the World Bank. A stand-alone Environmental Management Plan (this document) was also prepared as a requirement of the World Bank. The EMP specifies project activities, potential impacts, mitigation measures, implementation and monitoring responsibilities, budget allocation, monitoring indicators, as well as environmental management and supervision, institutional strengthening and training. This EMP will be form part of contractual documents for contractors and supervision personnel. The mitigation measures developed in this EMP will be incorporated into preliminary design and detail design, and will be fully implemented by contractors under contractual obligations. Applicable Standards The applicable environmental standards referred in the Environmental Impact Assessment and Environmental Management Plan are summarized in Table 1-3. 1.4. Key Environmentally Sensitive Areas There are a number of key environmental sensitive areas identified in the environmental impact assessment, which would be directly impacted by the project construction and operation, including one nature reserve, three scenic areas, two forest parks and four water source protection areas. In addition, there are also 304 and 206 villages/schools/hospitals subject to noise and vibration impact; such impacts are addressed in the EIA, and adequate mitigation measures developed in this EMP. These sites are summarized in Table 1-4. During operation, the environmental management responsibilities will rest with Guiyang-Guangzhou Railway Corporation. The main environmental management responsibilities of these stakeholders are: Project Office of Guiyang-Guangzhou Railway Corporation The Project Office of Guiyang-Guangzhou Railway Corporation is responsible for overall environmental management during construction. An environmental protection division (EPD) is to be established and managed by dedicated environmental staff. There will be 1-2 dedicated person(s) in the environmental protection division established under the Project Office of Guiyang-Guangzhou Railway Corporation. Their responsibilities are as follows: 1) Under administration of the Project Office and supervision and guidance from the provincial, local (municipal) environmental protection bureau, forestry bureau, and water resources bureau, the EPD are responsible for overall management of environmental management, submitting the monthly reports on environmental management and preparing the environmental monitoring statement during the construction period; 2) Entrust the environmental monitoring institutes to carry out environmental monitoring during the construction period. Supervise the construction unit to carry out pollution prevention measures. Inform the construction team of any violation of these regulations immediately and report this violation to the project office. In case of a pollution incident, assist the construction team in clean up and remediation; 4) Ensure that the Environmental Management Plan is included in the Bidding Documents and the contracts of Supervision Engineer. Supervise and participate in environmental supervision of the project; and 5) Recruit the Environmental Consultant to offer technical support for environmental protection during the construction period, provide the contractor with technical guidance on environmental protection, and support on-the-job training on environmental protection for the project managerial personnel, supervision personnel and contractor. Contractors Contractors are responsible for implementing the environmental mitigation measures as specified in the EMP and contract documents including the following: developing a contractor specific environmental protection plan as part of contract provisions, reporting to Supervision Engineer new environmental issues or chance-finds of any cultural relics encountered during construction and carrying out continued public consultations throughout construction. Each Contractor will be required to appoint one to two full time environmental staff responsible for environmental management under its contract. Environmental Supervision Engineers (ESE) Each Supervision Engineer company will be required by contract to assign one Environmental Supervision Engineer to the project. The Environmental Supervision Engineers will: 1) Review and assess on behalf of the Project Office whether the construction design meets the requirements of the EIA and EMP, particularly with regard to site environmental management and impact mitigation measures required; 2) Supervise site environmental management system of contractors including their performance, experience and handling of site environmental issues, and provide corrective instructions; 3) Review the EMP implementation by the contractors, verify and confirm environmental supervision procedures, parameters, monitoring locations, equipment and results; 4) Report EMP implementation status to Project Office; and 5) Approve invoices or payments with consideration of EMP performance. Environmental Consultant (ES) The Project Office of the Guiyang-Guangzhou Railway Corporation will recruit an Environmental Consultant to offer technical support for environmental protection and EMP implementation during the construction period. The Environmental Consultant will provide the contractor with technical guidance on environmental protection, and support on-the-job training on environmental protection for the project managerial personnel, supervision personnel and contractors. Page 39 Environmental Management Plan Guiyang Guangzhou Railway Project Page Environmental Monitoring Stations The Project Office of Guiyang-Guangzhou Railway Corporation will entrust environmental monitoring stations to carry out the environmental monitoring plan as developed in EMP. 3.2 Environmental Supervision Environmental supervision is an important instrument to ensure effective implementation of Environmental Management Plan commitments. In line with contract management, each Supervision Engineering company will be required by contract to assign at least one professional Environmental Supervision Engineer, to supervise, on a daily basis, contractor environmental performance. 3.2.1 Environmental Supervision Plan The Environmental Supervision Engineer (ESE) shall prepare the project environmental supervision plan prior to environmental supervision, according to the codes and standards for environmental protection, design documents, construction contracts and supervision contracts and EMP, etc. The supervision plan shall mainly include the following content: Scope, stage and time limit of environmental supervision ƒ Scope of environmental supervision: the area of the project and the area impacted by the project; ƒ Scope of work: construction sites, camps, construction access roads, attached facilities, as well as any area with environmental pollution and ecological damage resulting from project construction; ƒ Stage of work: environmental supervision of construction preparation, construction, project maintenance; and ƒ Time limit of supervision: from the onset of project construction preparation until expiration of the maintenance period of the project. The warranty period will last one year following completion of construction. Environmental supervision of the project is divided into the three stages, construction preparation, construction and warranty period. Objectives of Supervision The objectives of environmental supervision are to fulfill the obligation of environmental supervision, serve the project independently, impartially, scientifically and effectively, and carry out overall environmental supervision in order to that the project is in compliance with all environmental protection and management requirements in terms of design, construction and operation according to Chinese laws, regulations and policy World Bank technical standards and specifications, as well as approved design documents, tender documents and the supervision and construction contracts. Working Procedures The working procedures include a working recording system, staff training, reporting, correspondence, and regular environmental meetings. There shall be one environmental protection supervision meeting each month. During the meeting, the contractor will give a summary of recent environmental protection work. The Environmental Supervision Engineer will give an overall assessment of environmental protection for each construction activity. The Page 40 Environmental Management Plan Guiyang Guangzhou Railway Project Page outcomes of the work will be approved, the current problems will be tabled and the remedial requirements will be proposed. Meeting minutes will be taken. Preparation for Work Commencement The ESE shall prepare the environmental supervision work plan and submit it to the Preparatory Office of Guiyang-Guangzhou Railway Corporation prior to entering the field. The plan shall include the organization of the environmental supervision team and a list of environmental supervision staff. The ESE shall be familiar with the relevant contractual provisions and technical specifications, and carry out field surveys to gain an overview of landforms, surface features, hydrogeology and other environmental features of importance. The Preparatory Office of Guiyang-Guangzhou Railway Corporation shall approve the work plan for environmental supervision and the provisions of environmental supervision. Quality Control The ESE shall: carry out overall inspection, supervision and management of construction, paying attention to control beforehand, in order to ensure timely prevention and control of factors that might cause environmental impact, and take preventive measures before the accident happens; improve follow-up and control measures and ensure that the project submitted by the contractor complies with drawings and technical specifications and environmental protection measures. Coordination, Information Collection and Management Coordination among various parties will be mainly achieved through project coordination meetings. Information pertaining to environmental supervision shall be filed and classified according to requirements of the Owner, referring to regulations of relevant state government authorities, requirements of the World Bank and in accordance with engineering requirements. Meetings will be convened regularly. All information will be filed in a timely manner to ensure that engineering data is current and up to date. 3.2.2 Content of Environmental Supervision Environmental Supervision Prior to Construction Prior to construction, the ESE will ensure the following: ƒ Review of pollution prevention mechanisms: treatment and disposal measures for waste water, air emissions and solid waste arising from construction shall be reviewed, including technology selection and feasibility. Prior to project commencement, waste treatment measures shall be put in place in accordance with conditions of the Department of Environmental Protection. ƒ Review of environmental protection clauses in the Construction Contract: the construction contractor must abide by all pertinent requirements of environmental protection as per contract provisions. During construction, the contractor shall ensure supervision, inspection, and monitoring to minimize pollution during construction. Environmental Supervision During Construction The ESE will conduct daily on-site supervision, e.g. whether the construction is carried out as per clauses of the environmental protection, and whether any clauses have been changed without approval; whether environmental protection requirements are satisfied during the Page 41 Environmental Management Plan Guiyang Guangzhou Railway Project Page construction process by monitoring; whether construction work is in line with environmental protection standards, and ensure that these measures are properly implemented. The main contents are: ƒ Supervise soil conservation measures and minimize water pollution resulting from construction. This includes measures such as a) soil retention and conservation b) disposal of waste rock (not to side slopes that could cause visual impacts) c) implementation of temporary and permanent erosion control measures d) implementation of measures to reduce sedimentation (settling ponds and silt fences), e) ensure that properly designed runoff control measures are in place and f) that all waste water treatment facilities area in good working condition. ƒ Supervision of industrial and domestic wastewater disposal: Verify sources of industrial and domestic wastewater, discharge amount and emission parameters, construction progress of waste treatment and disposal facilities, and verify final disposal location and procedures. Inspect and supervise that treatment measures are in compliance with permitted discharge standards. ƒ Environmental supervision of atmospheric pollution: air pollution in the work area mainly results from vehicle exhaust gases and dust produced during construction. Verify that discharge parameters are in compliance with permitted air emissions standards. ƒ Environmental supervision of noise: Noise abatement measures shall be implemented in accordance with project design parameters and permitted noise levels. Particular attention shall be paid to blasting. ƒ Environmental supervision of solid waste disposal: solid waste disposal includes industrial, domestic and inert waste. Good housekeeping measures shall be implemented to ensure that construction sites are maintained in a clean and tidy condition. ƒ Environmental supervision of vegetation and wildlife conservation: Measures for protection of vegetation, particularly protection and relocation of ancient trees shall be implemented, as well as faunal protection measures, including relocation of rare species. ƒ Environmental supervision worker and community health: Ensure safety and reliability of the domestic drinking water supplies, prevent infectious disease, and provide necessary welfare and sanitation. ƒ Supervision of construction and installation of the environmental protection facilities: supervise construction of the facilities for sewage treatment, noise abatement and landscaping. Supervision at Completion The ESE shall supervise and manage restoration of the environment and the operation of all pollution prevention equipment, including the following: ƒ Supervise the preparation of as-built documents; ƒ Organize the initial inspection; ƒ Assist the Owner in the organization of final acceptance of construction; ƒ Organize the as-built data of the environment supervision; and ƒ Prepare the final report for the environment supervision of the project. 3.3 Management of Contractors Page 42 Environmental Management Plan Guiyang Guangzhou Railway Project Page During construction, the contractor, shall be responsible for controlling and reducing environmental impacts and that environmental protection measures are fully implemented, including consideration of the following measures: ƒ During pre-qualification, environmental management shall be included in the authentication clause when the contractor’s qualifications are reviewed. Under the same condition, priority shall be given to the bidders who are ISO9001 and ISO14001 certified; ƒ At least one full-time and dedicated person shall be assigned in each construction phase to carry out environmental supervision and environmental monitoring, as well as implementation of specific environmental protection measures; ƒ In the process of preparation of the Bid Document, the project proponent shall incorporate each environmental protection measure (as stipulated in the project approved Environmental Impact Assessment and EMP) into contractual clauses, so that the details and responsibility of environmental protection can be fully understood, including corresponding budgetary estimates. Implementation of these environmental protection measures will become the obligation and responsibility of the successful bidder; ƒ Prior to the commencement of construction, the Contractor shall receive relevant environmental training. In each section, at least 1 senior manager and 1 environmental protection professional shall participate in training convened by experienced consultants versed in environmental protection and local regulatory authorities. Such training shall be carried out 2-3 days prior to signing the contract, and include: - Relevant national and local laws and regulations and discharge standards; - Technical guidelines for environmental protection; - Environmental Impact Assessment and Environmental Management Plan of the Project; - Specific requirements, methods and parameters of all monitoring locations; - Specific requirements on the monitoring reports and feedback of monitoring data; - Applicable mitigation measures; - Emergency measures for any releases of hazardous materials; - Public participation during construction and resolution of public complaints; - Contractor responsibility for environmental protection; ƒ A Construction supervision unit shall be assigned with environmental supervision responsibility through designation of Environmental Supervision Engineer. The requirements of environmental supervision will also be included in the Bid Documents, and be ultimately included in the contracts for the Supervision Engineer companies. At least two persons (one of whom shall be a senior manager) shall participate the above- mentioned training. 4. Environmental Training Program Before the start of construction, all environmental management staff of the environmental protection division of the Project Office of Guiyang-Guangzhou Railway Corporation Project, supervision engineers and contractors shall be trained for environmental protection at least once. The training plan is summarized in Table 4-1. 4.1 Training Targets and Contents Environmental Management Staff and Environmental Supervision Engineer On the job training will be carried out for Project Office management staff and Environmental Supervision Engineers aiming at strengthening environment management during the construction and operation periods, and therefore improve overall environmental quality of the project. Through the training, environmental managerial personnel will be able to identify major environmental problems in the construction stage and shortcomings in environment management, and report to Project Office to take necessary remedial measures. During construction, the Project Office will invite the Environmental Consultant (environmental experts or environmental management authorities with similar experience) to carry out on-site environmental training. Gui-Guang Railway Corporation During project operations, the Gui-Guang Railway Corporation shall hold environmental protection knowledge training for their staff regularly, so that they can identify the possible environmental problem that may occur as part of their respective job and required mitigation measures. Each employee shall have a concept of environmental protection. Contractors Before project commencement, environmental staff and workers of the successful bidder shall receive environmental training in relation to their job responsibilities. The training for environmental staff of Contractors aims at specifying environmental protection responsibility for construction works while worker training aims to reduce environmental impacts as a result of construction activities. The Project Office will arrange for contractor training by hiring a competent Environmental Consultant. The objective of training is to explain possible environment impacts during construction, and the environmental protection and mitigation measures that should be taken. Contractors will be made aware of their environmental obligations as well as potential environmental damage that may occur during construction. Workers will learn of specific environmental measures that will be undertaken as part of their daily work activities. 4.2 Training Methods and Costs The training plan is summarized in Table 4-1. Legal Implications of the EMP The Environmental Management Plan is not only a guideline for the construction unit to implement the environmental protection and mitigation measures, but also forms the basis for the environmental administrative department to inspect and accept the environmental protection works. Therefore, the EMP shall have same legal status as the Construction Contract and Bid Documents etc. When the project owner - Preparatory Office of Guiyang-Guangzhou Railway Corporation Project - invites bids from the public, it shall provide the EMP to the bidder as one of the basic documents. The related mitigation measures in the EMP are to be included in the Bid Document while environmental protection costs shall be included in the proposed budget by the Bidder. When the project owner reviews the Bid Documents, they shall consider the commitment for implementation of the EMP as legally binding. When the engineering contract is signed, the EMP shall be implemented as one of the services provided by the contractor and one of the conditions of project quality acceptance. Construction contractors shall be responsible for environmental damage due to failure to implement the EMP. Prior to the commencement of the project, the environmental management staff of the project owner shall have a comprehensive understanding of the EMP and shall be responsible for explaining its significance to the construction unit. During supervision works, the Environmental Supervision Engineer will consider the EMP conditions as binding for the contractor. If environmental protection measures fail to be implemented, relevant works will not be accepted. Prior to commencement of construction works, the construction unit shall assign dedicated personnel, who shall be responsible for EMP implementation. Each environmental protection measure shall be implemented as per the EMP schedule. Page 48 Environmental Management Plan Guiyang Guangzhou Railway Project Page 6. Framework for New Temporary Land Occupation Works Due to the limit of feasibility study stage, the selection of borrow and spoil disposal sites are considered to be preliminary. More details of these sites will be provided in the next stage of preliminary design and detail design. Also final access road locations can only be determined once Contractors start preparation for site construction. Some borrow sites and spoil disposal sites may also be adjusted due to practical situations, i.e. new borrow/disposal sites would be selected during the construction stage. 6.1 General Principles It is an EMP requirement that, in case of new borrow/disposal sites and access roads, the Contractor shall: ƒ Prepare a borrow/disposal site plan with adequate environmental protection measures; ƒ Prepare an access road plan and register with adequate environmental protection measures; and ƒ Submit the plan to Environmental Supervision Engineer for review and approval before opening such sites/roads. For the optimization of borrow/disposal sites in the design stage and selection of new sites/access roads during construction stage, the following principle shall be followed: Borrow sites ƒ Shall be located in existing or disturbed areas to the best extent possible; ƒ Avoid farmland; ƒ Avoid woodland or grassland or unstable areas ; ƒ Avoid industrial and agricultural production facilities (such as houses, electricity poles, towers etc.); ƒ Avoid sensitive areas such as nature reserves, scenic spots, forest parks, water source protection areas etc. Spoil disposal sites ƒ Avoid environmentally sensitive areas such as nature reserves, scenic areas, forest parks, water source protection areas etc. ƒ Use low elevation areas with large capacity as much as possible; ƒ Avoid erosion prone areas; ƒ Are prohibited to be located along the river, lake or reservoir areas. If the spoil disposal area must be located near to a river, it must be protected by retaining wall; ƒ Shall not affect the flood discharge and irrigation function of rivers, valleys, and drainage and irrigation ditches; ƒ Ensure the safety of farmland and buildings located downstream; ƒ Shall not be located upstream of residential areas; and Page 49 Environmental Management Plan Guiyang Guangzhou Railway Project Page ƒ Shall not be located in a landslide prone area; Access roads ƒ Existing rural roads shall be used as much as possible with adequate reinforcement of road surfaces and drainage systems; ƒ Avoid passing through densely populated towns/villages; ƒ New access roads shall be planned with consideration of use as local village roads for remote villages after construction is concluded; and ƒ Shall avoid environmentally sensitive areas such as nature reserves, scenic areas, forest parks, water source protection areas etc. 6.2 Access Road Design Recommendations Construction access roads shall follow local agricultural machinery roads. Existing rural roads or other roads shall be utilized to reduce fill requirements and minimize soil erosion and agricultural impacts. In light of the actual situation of the project, the construction unit is suggested to negotiate with the Xia-Rong Expressway construction units, so that part of the construction road can be shared to reduce the need for new access roads. The design width of the access road generally shall be 3.5m. If large machinery is transported, the road will be widened appropriately. During access road excavation, protection measures shall be implemented to avoid erosion and sedimentation from entering rivers and farmland. Side slopes caused by excavation shall be protected by seeding or implementation of other erosion control measures. Waste material that cannot be used shall be transported to disposal areas. The access road design should adopt a rolling dip to avoid relatively long stretches of concentrated water flow. Vehicle traffic shall be restricted only to the road right-of-way to avoid impacts on wildlife and surrounding vegetation. A drainage ditch should be set on the both sides of the road right of way as appropriate during construction, and the ditch should be configured with a height of 0.3m and a width of 0.3, and have a 1:1 slope rate. Drainage engineering should consider local drainage patterns. Every 3 km in farmland areas, drainage shall be diverted away from agricultural areas. Access road slopes shall be protected by geotextile, or other material, to reduce erosion. Some roads will be fully restored to prior construction status. Such roads will be covered by topsoil from nearby borrow/disposal sites (no topsoil stripping will be stored from access road construction). Re-vegetation will be done for occupied forest and grassland and wasteland, and reclamation shall be done for occupied farmland. Landscaping shall use suitable local species , such as masson pine and aalii; plant spacing of trees is 4Χ4m, and plant spacing of shrub is 2.0Χ2.0m. Some construction access roads will be transferred to the local communities and used as rural traffic access following construction. Such roads shall be properly maintained and repaired to ensure functioning prior to being transferred to local communities. 7. Environmental Protection Costs 7.1 Principles and Basis Page 50 Environmental Management Plan Guiyang Guangzhou Railway Project Page The following principles are followed for the budget estimate of environmental mitigation measures: ƒ “Those who cause pollution should be responsible for the pollution control, and those who do the development should be responsible for protection.” The costs of environmental protection, monitoring and engineering management to minimize the adverse impact of the project construction on the environment shall be included as a separate cost. In the engineering budget, those budget items for water & soil conservation shall be calculated separately. ƒ “Focusing on key issues” . Those environmental factors subject to significant project impact, public concern or with higher protection class shall be given a high protection priority in regard to preferential fund allocation. ƒ “Function recovery”. Mitigation and compensation measures shall be adopted to restore original function. ƒ “One-off compensation" .
