Self-governing organization that manages administrative and social issues of certain Mahalla living community. 7 UZB-MAS_ESIA for Solar PV_Bukhara – SEP v 4.0 (Final for disclosure) ESIA Volume VI: Stakeholder Engagement Plan Nur Bukhara Solar PV and BESS 1 Introduction and Project Summary 1.1 Project background and location Abu Dhabi Future Energy Company PJSC (“Masdar”) has been awarded, by the Ministry of Energy, Government of Uzbekistan, the design, build, finance, construct, commission and operate, maintain and transfer (DBFOMT) of the Nur Bukhara Solar photovoltaic (PV) Project with a capacity of 250 MWA and 63 MW/126 MWh Battery Energy Storage System (“Project"). The Project will be designed to meet national regulations and international standards. The Project will be implemented through a long-term, i.e., 25 years power purchase agreement (a “PPA”) between Nur Bukhara Solar PV LLC Foreign Enterprise and JSC National Electric Grid of Uzbekistan (“NEGU”).  The Project will support Uzbekistan to: • Reduce energy dependence on carbon-based fuels. • Meet renewable energy targets. • Reduce greenhouse gas emission rates. Masdar has appointed Juru Energy Ltd. (JE or the ESIA Consultant) to perform an Environmental and Social Impact Assessment (ESIA) for the Project. The ESIA will be developed following the requirements of the International Finance Corporation (IFC) Performance Standards (PSs), Asian Development Bank (ADB) Safeguard Policy Statement (SPS) and with reference to the European Bank for Reconstruction and Development (EBRD) Environmental and Social Policy 2019 (ESP 2019) Performance Requirements (PRs) and the Equator Principles. The Project will be required to undergo a separate national environmental impact assessment (EIA) process, submitted Stage 1 EIA to the Ministry of Natural resources for approval (Application Number 81208) on 22 May 2023. A Stage 2 submission was made on 06 August 2023 to provide some supplementary documentation. A positive Stage 2 resolution was received on the 22 August 2023 and is provided in Volume III: Technical Appendix. . The sequence of steps for the EIA and ESIA study is presented in Figure 1. This document is the stakeholder engagement plan (SEP), it has been prepared on behalf of Masdar to maintain and guide stakeholder engagement over the lifetime of the Project. This SEP is currently focusing on engagement during the ESIA preparation, and this iteration of the document presents the findings of stakeholder engagement activities undertaken for the scoping phase. The site covers approximately 649 ha of land in the Alat District of the Bukhara region of the Republic of Uzbekistan. It is located 24 km southeast of Alat city, close to the border with Turkmenistan, which, at the closest point, lies around 25 km southeast of the site. The proposed site is flat and is surrounded by the Amu-Bukhara Irrigation System (ABIS canal) to the North, South and East. The regional road R78 runs alongside the northern boundary of the site. The closest populated areas to the Project site are the Kirlishon and Kulchovdur communities. There is a small community within the existing Khamza 1 substation compound comprising approximately ten families living in eight households (there are about ten houses, but not all are inhabited). These people originate from, and are considered part of, Kirlishon community (the red shaded area in Figure 3). There is currently a worker accommodation camp located within the Khamza 1 compound used by workers from the Chinese company CNTIC, which is undertaking construction works on the Khamza 1 substation (the orange shaded area in Figure 3). There are also workers from a different Chinese company CNNC Ind. undertaking reconstruction works at the Khamza 2 substation. They are located in a walled area just outside the southern part of the Project footprint (the green shaded area in Figure 3). Land allocated for Project site has been leased by the Sericulture and Wool Development Industry Committee (SWID) to Buhoro Karakol Cluster LLC, which in turn leased the land to “Alat Qoraqolchilik” LLC for long term use (49 years). Local villagers living next to Khamza 1 substation actively use the surrounding areas, including Project site for livestock grazing. They have camps that were identified in the area surrounding the 9 UZB-MAS_ESIA for Solar PV_Bukhara – SEP v 4.0 (Final for disclosure) ESIA Volume VI: Stakeholder Engagement Plan Nur Bukhara Solar PV and BESS Project footprint (the black triangles in Figure 3). It is understood that these camps are used for keeping livestock, mainly during the spring months. One herder has been granted permission by “Alat Qoraqolchilik” LLC to graze livestock through a signed agreement (with a duration of 10 months). One farmer has a lease agreement to farm 20 ha of land at the bottom of the southern section of the Project footprint (the pink shaded area in Error! Reference source not found.). He uses approximately 4 ha for agriculture and the remainder he uses for grazing 30-40 cows, between March and June. The Project footprint has been modified so that his access to land will not be impacted. There are two areas on the Project site that have been subject to small-scale quarrying activities, but they have not been used for some time. The Ministry of Mining Industry and Geology has confirmed that these were not official mining sites. In addition, site observations at ESIA and valuation surveys for LRP have not revealed activities. Based on interviews undertaken during the scoping site visit conducted in March 2023, some people were identified as fishing in the ABIS canal. In addition, Khamza 1 and 2 substations (including the worker accommodation and the village members) use water from the canals for construction, and irrigation. PV inverters convert the direct current that will be transformed into alternating current via transformers to raise the voltage from Low Voltage (LV) to Medium Voltage (MV). Then, the energy generated will be conducted through an underground medium voltage (MV) network of 35 kV to the 35/220 kV substation. An overview of the process is illustrated in Figure 4 below. Figure 4: Overview of the PV process (compiled from IFC, 2015) The main components of the Project are: • 513,582 PV modules (half-cut monocrystalline silicon technology). • Single-axis tracker, inverters, and transformers. • Lithium-Ion (Li-ion) battery energy storage system (BESS) consisting of four 40ft containers. • Underground cabling system. • 35/220 kV substation (new). • 30 m 220 kV line-in-line-out (LILO) connection to an existing overhead transmission line (OHTL), “Karaku’l 500 SS” – “Hamza-2 SS” from the Project’s Substation via a 30m 220 kV. • Dismantling and rebuilding approximately 200 m of existing OHTL to enable the new LILO connection. • On-site buildings, including an operational control centre, office, welfare facilities, security guard house, storage facilities and stores. 14 UZB-MAS_ESIA for Solar PV_Bukhara – SEP v 4.0 (Final for disclosure) Stakeholder Engagement Plan Nur Bukhara Solar PV and BESS • New access from Highway R78. • New internal access roads. • Site drainage system. The main construction activities are site clearance (rocks, utilities, vegetation), establishing vehicle access, civil works (OHTL, substation and main site), equipment delivery of PV panels and supporting infrastructure, BESS, installation, and commissioning. Site establishment and civil works are expected to take three months, followed by eight months for installation and a further three months for commissioning. Work on-site is planned to start at the end of 2023. A material storage area will be established within the main site boundary. It is expected that the water source for the construction process will be tankered to the site. Cement will be from a nearby batching plant (not produced on- site). The Project may have some on-site accommodation, but contractors will also use offsite accommodation provided it meets Lender standards and adheres to the management and measures stipulated in the ESIA. The expected lifetime of the PV infrastructure is 25 years (at least), and ten years for the BESS. At the end of its lifetime, options will be considered to replace, repair, or remove all infrastructure from the site. 1.5 Land take requirements There is a possibility of both temporary and permanent land take requirements as a result of the Project. The laydown areas and worker accommodations are expected to be constructed within the Project limits. There will also be servitude rights required for the area underneath the OHTL right of way. The total estimated land take is 649 ha (including PV site, access roads and 30m OHTL connection). The land plot allocated to the Project is owned by the State Committee for Sericulture and Wool Industry Development (SWID) for an indefinite time period. Seven households from Kirilishon community (i.e., the settlement that is located opposite the Project site near to Khamza 1 substation) and one herder (Herder 01) with formal land right granted for ten months by “Alat Qoraqolchilik” LLC” (the company that administers the land), have also been identified. A 70 m setback has been agreed upon with the Alat District Sanitary Epidemiological Wellbeing Department between the ABIS canal and the site boundary. 1.6 Objectives of the stakeholder engagement plan Stakeholder engagement assumes the process of identifying, mapping and prioritizing stakeholders that might be impacted due to the Project activities or have a certain interest or decision-making status. The main objectives of the current Stakeholder Engagement Plan (SEP) are as follows: • Identifying and mapping potential Project stakeholders; 16 UZB-MAS_ESIA for Solar PV_Bukhara – SEP v 4.0 (Final for disclosure) Stakeholder Engagement Plan Nur Bukhara Solar PV and BESS • Preparing a stakeholder matrix that includes all impacted and interested stakeholders as well as key organizations that have decision-making responsibilities for the Project (e.g., the State Committee on Ecology and Environmental Protection); • Establishing relevant communication approaches for each stakeholder group to deliver Project information and conduct consultations; • Recording feedback, concerns, and views of stakeholders regarding the Project; • Developing and maintaining relevant grievance mechanisms (GMs) to accommodate all stakeholders; and • Establishing proper/suitable means of communication with vulnerable groups and women to ensure they are sufficiently consulted about the Project and to identify any risks relating to Gender-Based Violence & Harassment (GBVH) including Sexual Exploitation and Abuse (SEA). 2 Completed Stakeholder Engagement 2.1 Overview This section includes a summary of all stakeholder engagement undertaken to the date of writing of the SEP. To date, stakeholder engagement has been completed for the scoping and ESIA phases of the Project. No evidence of previous engagement for private sector or other projects in the area has been identified. This section will be live and continuously updated throughout the Project’s lifetime. 2.2 Scoping stakeholder engagement During the site visit on 02 and 03 March 2023 that was undertaken to inform the preparation of the Scoping report, the following consultations were undertaken: • Alat District Municipality; • Khamza 1 substation – CNTIC company; • Khamza 2 substation – CNNC Ind. Company; • Shaxram omad LLC farm; • Main Electricity Grids of Bukhara Department; • Alat District Power Grids Department; • Alat District Cadastral Department; • Alat District Construction Department; • Alat District Sanitary Epidemiological Wellbeing Department; • Alat District Natural Resources Department; • Kirlishon and Kulchovdur community representatives; and • Amu Bukhara Main Canal Department. In addition, the most effective modes of engagement for each stakeholder must be considered. 3.2 National requirements Uzbek legislation does not require projects to undertake a stakeholder engagement and communication process. It does not oblige project developers to conduct consultations to assess possible project impacts on local communities and businesses, and there is no requirement to disclose the environmental assessment results. The Resolution of Cabinet of Ministries №541 “On Further Development of Mechanisms for Conducting National Environmental Impact Assessment in the Republic of Uzbekistan” does, however, require projects to conduct a public hearing with relevant organizations as well as local communities to receive their support regarding the Project implementation. The public hearing should be recorded and documented with the evidence of participants’ signatures. This requirement is mandatory only for projects under Category I and II. This Project is considered Category II, and therefore this requirement will apply. Law № 781 “On Procedures for the Withdrawal of Land Plots for Public Needs with Compensation” requires meaningful consultations with Project affected people (PAP) who can be physically or economically displaced due to the realization of the Project. Furthermore, the Law of the Republic of Uzbekistan № 378 “On Appeals of Individuals and Legal Entities” dated 3.12.2014 (as amended on 17.08.2017), provides a legal basis for communication between individuals and legal entities with state organizations as well as their officials. According to this Law, individuals and legal entities can send their grievances and appeals in any form (verbal, written, or electronic). Submitted appeals should be reviewed within 15 days from the date of receipt. If additional investigation is required, a response should be sent within one month. 3.3 Lender requirements Project Lenders are expected to be International Financial Institutions with their own E&S policies. For this SEP, it has been assumed that Lenders will follow the relevant requirements of the IFC Performance Standards (PSs), Asian Development Bank Safeguard Policy Statement (SPS) and the Equator Principles (EPs). The stakeholder engagement requirements related to these four standards are discussed below. 38 UZB-MAS_ESIA for Solar PV_Bukhara – SEP v 4.0 (Final for disclosure) Stakeholder Engagement Plan Nur Bukhara Solar PV and BESS 3.3.1 International Finance Corporation (IFC) All of the IFC PSs include requirements for an amount of stakeholder consultation/engagement (either in the ESIA or as part of the ESMS), and therefore the Project will require a level of engagement. In particular, IFC PSs 1 on “Social and Environmental Assessment and Management Systems” describes the stakeholder engagement requirements in more depth. It states the following: “Stakeholder engagement is the basis for building strong, constructive, and responsive relationships that are essential for the successful management of a project’s environmental and social impacts. Stakeholder engagement is an ongoing process that may involve, in varying degrees, the following elements: • Stakeholder analysis and planning; • Disclosure and dissemination of information; • Consultation and participation; • Grievance mechanism; and • Ongoing reporting to Affected Communities. The nature, frequency, and level of effort of stakeholder engagement may vary considerably and will be commensurate with the project’s risks and adverse impacts, and the project’s phase of development.” The IFC PSs indicate that when affected communities are subject to identified risks and adverse impacts from a project, the developer/client will undertake a process of consultation in a manner that provides the affected communities with opportunities to express their views on project risks, impacts and mitigation measures, and allows the client to consider and respond to them. Effective consultation is a two-way process that will: • Begin early in the process of identification of environmental and social risks and impacts and continue on an ongoing basis as risks and impacts arise. • Be based on the prior disclosure and dissemination of relevant, transparent, objective, meaningful and easily accessible information which is in a culturally appropriate local language(s) and format and is understandable to affected communities. • Focus inclusive engagement on those directly affected as opposed to those not directly affected. • Be free of external manipulation, interference, coercion, or intimidation. • Enable meaningful participation, where applicable. • Be documented. 39 UZB-MAS_ESIA for Solar PV_Bukhara – SEP v 4.0 (Final for disclosure) Stakeholder Engagement Plan Nur Bukhara Solar PV and BESS 3.3.2 Asian Development Bank ADB’s SPS (2009) requires that Projects undertake meaningful consultation processes. The consultation process should: • Begin early in the project preparation stage and be carried out on an ongoing basis throughout the project lifecycle; • Provide the timely disclosure of relevant and adequate information that is understandable and readily accessible to affected people; • Be undertaken in an atmosphere free of intimidation or coercion; • Be gender inclusive and responsive, and tailored to the needs of disadvantaged and vulnerable groups; and • Enable the incorporation of all relevant views of affected people and other stakeholders into decision making, such as project design, mitigation measures, the sharing of development benefits and opportunities, and implementation issues ADB requires borrowers/clients to engage with communities, groups, or people affected by proposed projects, and with civil society through information disclosure, consultation, and informed participation in a manner commensurate with the risks to and impacts on affected communities. Projects must establish a grievance redress mechanism to receive and facilitate resolution of affected peoples’ concerns, complaints, and grievances about the project’s environmental, and involuntary resettlement performance. The grievance mechanism should be scaled to the risks and adverse impacts of the project. It should address affected people's concerns and complaints promptly, using an understandable and transparent process that is gender responsive, culturally appropriate, and readily accessible to all segments of the affected people at no costs and without retribution. The mechanism should not impede access to the country’s judicial or administrative remedies. The affected people will be appropriately informed about the mechanism. 3.3.3 Equator Principles The Equator Principles IV establish key requirements for stakeholder engagement through Principles 5 and 6, they are described below: Principle 5: Stakeholder Engagement • For all Category A and Category B Projects (under the Equator Principles project categorization rankings), the Equator Principles financial institutions (EPFI) will require their client to demonstrate effective stakeholder engagement as an ongoing process in a structured and culturally appropriate manner, with affected communities, workers and, where relevant, other stakeholders. 40 UZB-MAS_ESIA for Solar PV_Bukhara – SEP v 4.0 (Final for disclosure) Stakeholder Engagement Plan Nur Bukhara Solar PV and BESS • For Projects with potentially significant adverse impacts on affected communities, the client will conduct an informed consultation and participation process. The client will tailor its consultation process to the risks and impacts of the project; the project’s phase of development; the language preferences of the affected communities; their decision-making processes; and the needs of disadvantaged and vulnerable groups. This process should be free from external manipulation, interference, coercion, and intimidation. • There are also other requirements for facilitating engagement with indigenous peoples. Principle 6: Grievance Mechanism • For all Category A and, as appropriate, Category B projects, the EPFI will require the client, as part of the Environmental and Social Management System (ESMS), to establish effective grievance mechanisms which are designed for use by affected communities and workers, as appropriate, to receive and facilitate resolution of concerns and grievances about the project’s environmental and social performance. • Grievance mechanisms are required to be scaled to the risks and impacts of the Project, and will seek to resolve concerns promptly, using an understandable and transparent consultative process that is culturally appropriate, readily accessible, at no cost, and without retribution to the party that originated the issue or concern. Stakeholders interested in the Project may be able to influence its outcome, either positively or negatively. This SEP includes a Stakeholder Engagement Matrix consisting of individuals, communities, organizations, and Government agencies that are considered stakeholders of the Project. The Stakeholder Engagement Matrix is based on the outcomes of consultations during the Scoping Phase site visit and will be changed or modified, i.e., new stakeholders’ groups can be added and removed throughout the Project lifecycle as stakeholders and their interest in the Project change. By applying a systematic approach, the current stakeholder matrix has been classified into three main categories based on the type of interest: • (A) - Affected/impacted stakeholders (these can be directly or indirectly affected by the Project). • (I) - Interest-based stakeholders (those with a specific interest in the Project, i.e., the Project’s beneficiaries, NGOs, and civil society). • (D) - Decision-making stakeholders (groups/individuals/organizations that make a decision regarding the Project, i.e., Project lenders, local regulators etc.). 4.2 Stakeholder identification A list of identified stakeholders that should be consulted at the ESIA stage has been prepared based on initial site observation conducted on 02 and 03 March 2023 and the results and outcomes of stakeholder consultations during the ESIA stage. In addition there is a small community within the existing Khamza 1 substation compound comprising approximately eight families living in six households. These people originate from and are considered part of the Kirlishon community. The Figure 9 below shows location of AoI communities. The population of the Kirlishon and Kulchovdur (the AOI) communities were reported to be 669 and 2,636 people respectively in 2022. The gender distribution of the AoI communities, was fairly even with slightly more men (50.1%) than women (49.9%). The majority (97.9%) of the people in the AOI communities are Uzbek while 2.1% are from other nations of Central Asia (Kazakhs, Tajiks, Turkmens, and Kyrgyz). The majority of the population (20.8%) are pensioners, and 12.3% of respondents stated they are employed in the government sector. Entrepreneurs and business owners make up 8% of the AOI. In the AOI registered unemployed people make up 0.1% of the population while those that are not registered unemployed make up another 7.8%. A total of 11% of the AOI respondents reported that they work as seasonal worker (working in temporary and seasonal jobs) while about 9.5% of AOI respondents work on their household farm. Almost all (99.3%) of the households have agricultural land plots (within their communities, not on or near the Project site), 0.7% of households do not have agricultural land. Approximately 10 vulnerable people were identified during consultations with the Kirlishon community leader. A total of potentially 70 vulnerable people were identified during consultations with the Kulchovdur community leader. Also, to be implemented with vulnerable groups where relevant. • Meetings with community leaders – these will be formal and informal meetings held with community leaders to maintain good relations with the community and address any concerns the community might have. • Visual aids and leaflet distribution – such method will be suitable to inform large groups of stakeholders, such as local communities, about the Project, and grievance mechanism process. • Social Media – can be used for communication with stakeholder groups who are not able to meet due to long distances. • Public meetings – these may be in the form of large group meetings and will disclose Project information at key implementation phases throughout the Project lifecycle. • Focus groups discussions (FGDs) – they will be used to gain information for the ESIA phase as well as conduct consultations with vulnerable groups. • Written correspondence – used to invite stakeholders to public meetings. This may be in the form of letters, or business correspondence. Also used to disclose information at key Project phases to a wider distribution of both impacted and interested stakeholders. • Phone calls – used to contact key national and local government stakeholders and also an alternative for vulnerable groups that have difficulty accessing information in other formats. It can also be used in lockdown situations when the health or security of stakeholders or staff may be at risk. • Media releases – may be used at key Project phases to disclose information to wider stakeholder groups. The method for communication selected in Table 4 is based on the interest of the stakeholder group and the influence it has as explained below: • In-depth engagement: regular, one-on-one meetings, task groups, committees, and updates (via letter, telephone calls or emails). • Focused engagement: periodic focus groups, letters, telephone calls and emails, where practicable. 52 UZB-MAS_ESIA for Solar PV_Bukhara – SEP v 4.0 (Final for disclosure) Stakeholder Engagement Plan Nur Bukhara Solar PV and BESS • Informed engagement: occasional public meetings, project information through letters, flyers, internet, and advertisements in local media. • Opportunity to comment: opportunities to lodge comments with the CTT Community Liaison Officer (CLO), CTT Social GBV Officer directly or via Feedback Forms (during construction) or to provide comment via other means (to be determined at the appropriate time) during operation. In each case, feedback forms will be available as well as opportunities to provide verbal feedback. • Information disclosure: specific information disclosure events, flyers, advertisements in conventional media, e.g., radio and newspapers. The use of social media is not foreseen. 4.5 Principles of engagement All stakeholder engagement will be carried out in a culturally appropriate manner and languages understood by stakeholders (including Uzbek and Russian as relevant). Planning for engagement activities will consider cultural and economic elements to ensure the greatest number of stakeholders can attend (for example, when women can attend or when herders are at their houses and not out grazing their animals). All meetings will be arranged in advance and communicated via local and district leaders and other means. All meetings will include visual material and handouts in the local language. Meetings will be held at venues easily accessible to stakeholders, and transportation will be provided when necessary. All outputs will be documented (photos/video, completion of attendance registers and minutes of meetings) for circulation. 4.6 Encouraging the participation of women Considering the local culture and traditions, stakeholder engagement will focus on implementing measures to ensure the active participation of women, mainly from local communities and farm workers, by arranging separate consultations and meetings. Female moderators will lead these meetings, FGDs and consultations to create a comfortable atmosphere for women to be informed about the Project and actively participate, providing their views and concerns and sharing feedback. 4.7 Vulnerable groups In addition to women (discussed above), vulnerable groups include low-income families, the unemployed, youth, older adults, children, and people with disabilities. It can also include people with poor literacy or the illiterate. This section will be updated should more responsible parties (such as the Main Contractor) join the Project. As of now, there are three main parties: • The ESIA Consultant team – Juru Energy (JE); • Project Company – Masdar; and • The Lenders – Unknown at this stage, but expected to follow the requirements of the ADB, IFC and/or the Equator Principles. The responsibilities for each key party are discussed in the sections below. 6.2 Key responsible parties 6.2.1 Juru Energy JE will be responsible for the implementation of stakeholder engagement throughout the Scoping and ESIA preparation of the Project. JE’s responsibilities include: • Undertake high-level stakeholder engagement to inform the Scoping Report (undertaken in March 2023). • Undertake stakeholder engagement, FGDs, and information disclosure to inform the ESIA preparation and disclosure. • Undertake a public hearing, following Uzbek requirements for Category II projects. • Provide relevant stakeholders with information on the grievance mechanism, including contact details. • Public disclosure meetings on the ESIA (including disclosure of non-technical summary in public locations) • Assist in registering, monitoring, and responding to grievances received via the grievance mechanism in coordination with Masdar, as necessary. • Hand over stakeholder engagement and grievance redress requirements to Masdar following the completion of the ESIA phase. 6.2.2 Masdar Masdar will take over stakeholder engagement requirements following the completion of the ESIA phase. It will be ultimately responsible for stakeholder engagement for the Project lifecycle. Masdar’s responsibilities are outlined below: • Disclose this SEP on Masdar’s website. • Where relevant, participate in stakeholder engagement organized by JE during the ESIA phase and ongoing. 58 UZB-MAS_ESIA for Solar PV_Bukhara – SEP v 4.0 (Final for disclosure) Stakeholder Engagement Plan Nur Bukhara Solar PV and BESS • Support JE in investigating and closing grievances during the ESIA phase and later phases • Update this SEP for the construction and operations phases. • Take over and implement stakeholder engagement activities for all phases following the ESIA phase. • Identify qualified staff to implement stakeholder engagement as per the SEP (for example, Community Liaison Officer (CLO) and a person responsible for grievance redress). • Take over the receipt, response, and closure of grievances, after the ESIA phase of the Project, following the requirements of the grievance mechanism (included in Section 7 of this SEP). 6.2.3 Project Lenders Project Lenders will have specific requirements for stakeholder engagement under their loan modalities. They will also have disclosure requirements that a project must comply with before a loan disbursement. Once identified, Lenders will likely disclose this SEP and ESIA on their website and monitor the implementation of the SEP through their own internal mechanisms. 7 Grievance Mechanism 7.1 Overview A grievance mechanism aims to maintain communication with stakeholders, i.e., be aware of their concerns, and respond to their inquiries per Lenders’ requirements. A well- functioning grievance mechanism can identify issues and address them before they escalate. The grievance mechanism has been and will continue to be disclosed during all public consultations and focus group discussions. A statement on the grievance mechanism has been included in the Project Non-technical Summary (NTS) and grievance contact details will be included on all documents/ brochures an leaflets for disclosure to stakeholders. The Grievance Manager will manage grievances. For the ESIA phase, JE will act as the Grievance Manager and be responsible for receiving grievances, with assistance from The Project Company. Following the ESIA phase, the Grievance Manager's responsibilities will be entirely the responsibility of the Project Company. The outcomes of the ESIA did not identify significant GBVH risks that would justify a parallel grievance mechanism to process possible project-related GBVH grievances from the community. However, one may be developed in consultation with the NGO “Oydin Nur”, should GBVH-related grievances be identified during later stages of the Project. 59 UZB-MAS_ESIA for Solar PV_Bukhara – SEP v 4.0 (Final for disclosure) Stakeholder Engagement Plan Nur Bukhara Solar PV and BESS 7.2 Grievance reporting and resolution A grievance is a claim raised by an individual or group whose livelihood, health and safety, cultural norms and heritage are considered to have been adversely affected (harmed) by a project activity which, if not addressed effectively, may pose a risk to operations and the livelihood, well-being, or quality of life of the claimant(s). Grievances can be raised during meetings, Project site visits, via phone calls and in written form (text messages via email, mobile applications, written requests etc.). Grievance boxes with grievance forms will also be installed in the following locaitions: • Khokimyat Offices in Alat District • Kulchovdir community office and Kulonchi community office Upon receiving a grievance by any means of communication, the Grievance Manager will enter the grievance into the grievance log to ensure that all raised concerns/inquiries are investigated and addressed. After receipt and registration of a grievance, a complainant will receive written notification that includes a proposed timeline for investigation depending on the request and the preliminary time of receipt of a response. JE has developed a grievance form and log to keep a tracked record of each grievance received. The grievance form is provided in Annex C, and the grievance log is in Annex D. Allocated members of the ESIA consultant team will be responsible for receiving and monitoring grievances during the ESIA phase of the Project. The grievance form is prepared based on the location, language preferences, and communication opportunities of identified stakeholders. Responses will be provided in a language suitable for the complainant, i.e., Uzbek or Russian. Therefore, JE is the main focal point for stakeholders from local communities, including PAPs, to raise grievances. Any grievances raised will be recorded in the grievance form and in the grievance log. The Project Company (Masdar) will assist in the resolution of grievances, and JE and/or Masdar will respond to the grievance. 7.4.2 Project Company The Project Company will identify a suitable staff member to undertake stakeholder engagement activities as required in this SEP once the ESIA phase has been completed. These staff members will start once identified and assist JE in engagement activities. They will take over engagement activities following the ESIA phase. It is expected that the Project Company will identify a Community Liaison Officer (CLO). This person will be the main point of contact between the Project and the local communities. Where possible the CLO will be responsible for both the construction and operation phases, to maintain consistency and good relations with the local communities. It is expected that the CLO responsibilities will be maintained by the Project Company. The Project Company will be responsible for providing relevant information and training to Project Company personnel and the EPC Contractor (and other contractors as relevant) about the grievance mechanism, who should be informed (such as security guards, who may need to log grievances from community members) and that all grievances (even if they are resolved on the spot) need to be reported to the Project Company for logging.3 Ongoing training on the GM will be given to all workers during the site induction. 3 A separate worker grievance mechanism will also be put in place for workers to raise grievances, which will be managed by the EPC Contractor. 61 UZB-MAS_ESIA for Solar PV_Bukhara – SEP v 4.0 (Final for disclosure) Stakeholder Engagement Plan Nur Bukhara Solar PV and BESS 7.4.3 EPC Contractor A CLO will also be hired through the EPC Contractor. They will work closely with the CLO of the Project Company to ensure all messaging is aligned. The EPC Contractor will be responsible for monitoring its subcontractors, reporting to Masdar any grievances it receives, and providing training to its employees on the grievance mechanism. The EPC Contractor will make sure that reporting and training responsibilities are being cascaded down to contractors and subcontractors. 7.5 Confidentiality and anonymity The grievance mechanism will keep strict data confidentiality, including all complainants' personal information. Although grievances may be reported during the ESIA period, names and identifying features of complainants will be withheld in any public disclosures. At the grievance receipt/registration stage, the complainant will be informed that they can submit a grievance anonymously. Complainants will be informed that some grievances may not be able to be responded to if they are made anonymously. 7.6 Grievance resolution options and response The approaches taken to resolve grievances will depend on the nature, frequency of occurrence and the number of grievances. The resolution of grievances will be formally communicated to the complainant in written form. If a complainant cannot receive a written response, the complainant will be contacted via phone and informed of the results of their grievance. They are discussed in the following sections. 8.2 SEP reporting A SEP is a live document that reflects the changing nature of stakeholder engagement throughout the Project life cycle. It will be subject to further amendments during the ESIA stage to reflect the completion of public hearings and to include any additional stakeholders identified during the ESIA preparation. The final version of this SEP will be disclosed as part of the ESIA suite of documents. This SEP will be reviewed and updated for the pre-construction phase (and at each subsequent Project phase, or at least annually) to identify new and different stakeholders and any changes to engagement activities and the grievance mechanism. All future versions of this SEP will also be disclosed to stakeholders. 8.3 CLO reporting The CLO will be responsible throughout the Project life cycle, undertaking and regularly reporting on stakeholder engagement activities. Reporting by the CLO should include the following: • A summary of disclosure activities undertaken by the CLO, including meeting minutes, attendance sheets, photographic evidence and copies of adverts placed in newspapers and other media. • Minutes of gender-specific consultations and consultations with members of vulnerable groups. • The originally written correspondence concerning stakeholder engagement, including records of media and social media disclosures. Comments and feedback will also be retained and appended to the SEP. The CLO will be hired to work on the Project as early as possible in the mobilization phase; they will be expected to report on their activities at least monthly. 8.4 Grievance reporting Monthly reporting on the status of grievances be prepared by the Project Company on an ongoing process during the ESIA phase and throughout the Project life cycle. This is to monitor the timely close out of grievances and grievance satisfaction. 8.5 Annual reporting The Project Company will prepare annual reporting on the SEP status with the help of the CLO. A Project specific annual report will be prepared to summarise Project performance, CLO activities, including anonymized grievances and updates to the SEP. The first report will be prepared during the construction phase. An external version of this report will also be prepared for disclosure to Affected Communities and implementation of the Project commitments on issues that involve ongoing risks to or impacts on Affected Communities and on issues that the consultation process or grievance mechanism have identified as a concern.
