Almost two years after project approval (July 2020) and 15 months after effectiveness (March 31, 2021), key foundational and preliminary activities that underpin major reforms for the Niger Governance of Extractives for Local Government (GOLD) project are still pending, notably: (i) the adoption of the legal framework to operationalize the Local government Civil Service (CBP 1.1) is yet to be finalized; (ii) the adoption of the texts on the retrocession of mining revenues to Local Governments (CBP2.1) is yet to be finalized; and (iii) very little progress has been recorded on PDO and intermediate indicators. Furthermore, out of the five Performance-Based Conditions (PBCs) for 2021, only two have been achieved and disbursed. On the 2022 PBCs, so far, two out of four have been achieved pending an independent verification, while the remaining two are being processed. Following project approval in 2020, the country context has changed which has impacted project implementation. With the creation of a new ministry in charge of Petroleum affairs, a former department within the Ministry of Mining, the adoption of the new inter-ministerial decision on the allocation and execution of extractive revenues has been stalled. Although an inter-ministerial committee has been established in 2021 for discussing and drafting the modalities for extractives revenues retrocession to Local Governments, the committee has not been able to proceed with a text satisfactory to all stakeholders. A change in the political landscape following local elections has also contributed to the delay in the adoption of the legal framework to operationalize the local government civil service. Additionally, the creation of the new Local Government Finance Directorate (Direction des Finances des Collectivites Territoriales) within the Ministry of Finance in February 2022 is a much-needed reform that is aimed to better clarify the flow of funds to municipalities; however, with a nascent institution there is a need to build its capacity to successfully undertake its mandate. Furthermore, with increasing insecurity in Niger, no activities have been initiated in the regions of Tillaberi and Diffa where teams are no longer able to travel. In light of this situation, the World Bank team has recommended an action plan with key activities to intensify project implementation. This involves conducting bi-monthly meeting with all stakeholders to ensure an up-close follow up with Government partners. Additionally, the team has recommended that the Project’s mid-term review (MTR), currently scheduled in January 2023, be advanced to September/October 2022 to better understand key bottlenecks that are impacting project implementation and propose a restructuring of the project that can mitigate implementation challenges and better align the project to current country context and needs.
