PROCUREMENT PLAN (Textual Part) Project Country: Kyrgyz Republic information Full Project Name: Resilient Agri-food Clusters Development Project Total Finance ($): USD 35.0 Mln Project Number: P178120 Project Implementation agency Agribusiness Competitiveness Center (ABCC), Credit Line Management Unit (CLMU) Date of the Procurement Plan February 27, 2024 Period covered by this Procurement February 27, 2024 - December Plan: 2029 Preamble In accordance with paragraph 5.9 of the “World Bank Procurement Regulations for IPF Borrowers” (July 2016, revised November 2020) (“Procurement Regulations”) the Bank’s Systematic Tracking and Exchanges in Procurement (STEP) system will be used to prepare, clear and update Procurement Plans and conduct all procurement transactions for the Project. This textual part along with the Procurement Plan tables in STEP constitute the Procurement Plan for the Project. The following conditions apply to all procurement activities in the Procurement Plan. The other elements of the Procurement Plan as required under paragraph 4.4 of the Procurement Regulations are set forth in STEP. The Bank’s Standard Procurement Documents: shall be used for all contracts subject to international competitive procurement and those contracts as specified in the Procurement Plan tables in STEP. National Procurement Arrangements: In accordance with paragraph 5.3 of the Procurement Regulations, when approaching the national market (as specified in the Procurement Plan tables in STEP), Borrower may use the procedures of “Unrestricted” and “Request for Quotations” methods as set forth in the Public Procurement Law dated April 14, 2022 № 27 with amendments dated January 30, 2023 N19 and July 25 2023 N147. When using the Unrestricted method the arrangements shall be subject to the provisions of the paragraph 5.4 of the Procurement Regulations and the following conditions: • The request for bids/request for proposals document shall require that bidders/proposers submitting bids/proposals present a signed acceptance at the time of bidding, to be incorporated in any resulting contracts, confirming application of, and compliance with, Bank Anti- Corruption Guidelines, including without limitation the Bank’s right to sanction and the Bank’s inspection and audit rights. • The request for bids/request for proposals document for civil works and supervision consultants shall require that Bidders/Proposers submitting Bids/Proposals present a signed Code of conduct form, Environmental and Social Performance Declaration and Management Strategies and Implementation Plans. Procurement Documents shall include provisions, as agreed with the Bank, intended to adequately mitigate against environmental, social (including sexual exploitation and abuse and gender-based violence), health and safety (“ESHS”) risks and impacts. • Bidding documents, including contract forms, acceptable to the Bank shall be used. Bidding documents including contract forms should include appropriate requirements for price adjustment (when applicable), insurance and contract termination. The contract conditions shall provide an appropriate allocation of responsibilities, risks, and liabilities informed by an analysis of which party is best placed to manage the risks, considering the costs and incentives of risk allocation.  Goods: Requirements to adequately mitigate against environmental, social (including sexual exploitation and abuse and gender-based violence), health and safety (“ESHS”) risks and impacts, including child labor standards, should be added to country’ own procurement documents.  All Unrestricted Bidding for civil works will be conducted using the Standard Procurement Document for Small Works (SPD) issued by the Bank until the country’ own procurement documents are revised and found acceptable. • The bidding process shall not be cancelled solely on the reason that the bid price of the lowest evaluated bidder is larger than the amount allocated by the Borrower for this procurement. • There shall be no preference of any kind applied during procurement of goods and civil works. • Banking support requirement shall not be applied for contracts under World Bank Project. • During the bidding process for civil works, the borrower shall require bidders to submit bids using the format of the Bill of Quantities acceptable to the Bank and provided in the bidding documents issued by the Borrower. The bidders shall use market prices for calculating the unit rates and the bid price. • Foreign bidders shall be allowed to participate in Unrestricted Bidding without restrictions of any kind. When other national procurement arrangements other than national open competitive procurement arrangements are applied by the Borrower, such arrangements shall be subject to paragraph 5.5 of the Procurement Regulations. Other national procurement method such as “Request for Quotation” may be applied on the same conditions stated above for procuring limited quantities of readily available off-the-shelf goods and for simple works (current repairs, finishing repairs of premises, including existing utilities). Not less than three quotations shall be requested to ensure competition and adequate time should be provided to the participants to prepare their quotations. Use of the Direction Selection method may be appropriate when there is only one suitable firm or there is a justification in line with circumstances included in paragraph 6.9 of the Procurement Regulations.
