Background and Objective The Foreign Economic Cooperation Office, the Ministry of Ecology and Environment of China (the FECO) and the World Bank jointly developed the Sustainable Mercury Management and Green Production in China's Non-ferrous Metal Smelting Industry Project (the non-ferrous metal mercury project), aims to strengthen China’s non-ferrous metal industry related policies, laws and regulations revising and promotion plan making, to promote the sustainable management and green production awareness of mercury in the non-ferrous metal industry at the national level, as well as the replication and sustainable application of BAT/BEP in the whole industry. Activity 2 of the non-ferrous metal mercury project is the demonstration of atmospheric mercury emission control and mercury-containing waste concentration technology. One of its contents is to carry out the demonstration of mercury containing waste concentration technology in the lead and zinc smelting industry, which aims to show the demonstration of mercury-containing waste concentration and recovery technology in the demonstration enterprises, to promote the reduction of primary mercury production and use proportion, and reduce the discharge of mercury into the environment during the management and treatment of mercury-containing waste. Henan Yuguang Zinc Industry Co., Ltd. (Yuguang Zinc Industry), as one of the first demonstration enterprises of the Non-Ferrous Metal Mercury Project, has carried out green upgrade and transformation of the existing selenium and mercury recovery system based on its existing mercury enrichment and recovery process (the demonstration project). By rebuilding the workshop, replacing part of the aging equipment, improving production processes equipment sealed system, transforming the off-gas and wastewater treatment system collection, to increase the recovery rate of mercury to 99.2% for higher purity of mercury and selenium, so as to reduce the emissions of mercury to the environment and meanwhile, improve the staff working environment and reduce the possible occupational hazard factors exposure. This report is an environmental and social management plan (ESMP) for the selenium and mercury recovery system green upgrade project of Yuguang Zinc Industry. The purpose of preparation is for the potential environmental and social negative impacts of the demonstration project, to formulate a set of management measures feasible in technology and economy and operational in management, to eliminate or reduce the possible impact and make the demonstration project comply to the World Bank Environmental and Social framework and China's environmental and social laws, regulations and standards. 1.2. Working Scope This ESMP is applicable to the possible impact of the demonstration project on the environment and society inside and outside the factory during the development process, covering the whole project cycle, including the construction period and operation period. The ESMP of the demonstration project can be continuously updated and revised according to project progress, periodic audit results and continuous improvement requirements. Environmental and Social Impact Factors and Mitigation Measures The main environmental and social impacts of the demonstration project come from the construction and operation periods. According to the feasibility study, ESIA report, the main environmental and social impact factors and mitigation measures of the demonstration project are summarized below. 2.1. Impact Factors and Mitigation Measures The environmental and social impact factors and mitigation measures of the demonstration project are shown in Tables 2-1 and Table 2-2, respectively. The environmental and social management plan of the demonstration project can make clear the implementation schedule of the measures, budget, the implementation organization and supervision party, and set the monitoring indicators and frequency, to monitor progress and effect of the implementation of corresponding measures, in order to develop and take the necessary actions to timely strengthen or adjust the measures and ensure that the expected project objectives can be achieved. Organization Setup Many parties are involved in the implementation of the demonstration project. In order to make the project run smoothly and ensure that the demonstration project complies with the environmental and social standards of the World Bank and the regulations and policies in China, it is proposed to set up an environmental and social management organization for the demonstration project consisting of the following parties, as shown in Figure 3-1. For this demonstration project, Yuguang Zinc Industry will set up a special project team, with the project manager as the general leader of the project, responsible for project management and external contact. During the implementation of the demonstration project, the external consultants entrusted by FECO will conduct the environmental and social management capacity building training for Yuguang Zinc Industry. Yuguang Zinc Industry or its external consultants should conduct environmental and social related training for the external contractors during the construction and operation of the demonstration project. The training content, target and frequency are shown in the table below. Objective The overall goal of public participation is to disclose project construction information to relevant stakeholders and the public as early as possible, so that those interested in the project can have easy access to project information. To receive and collect public opinions on the project design and construction, provide feedback on whether the design and construction management of the project has adopted relevant suggestions and feedback through appropriate channels and within the prescribed schedule. Participation should begin as early as possible and continue throughout the project implementation. 5.2. Participation Process and Main Findings In the preparation stage of the demonstration project, Yuguang Zinc Industry has carried out some information disclosure and public participation activities to collect public opinions and provide information support for further improving the technical transformation plan. On the whole, the public paid relatively little attention to the demonstration project and generally held a supportive attitude. No major conflicts of interest or factors that might cause community conflicts have been found. Grievance Mechanism Considering the potential risks and impacts of the demonstration project of Yuguang Zinc Industry, the grievance mechanism of the demonstration project includes two types: community grievance mechanism and labor grievance mechanism. Among them, the community grievance mechanism is mainly aimed at the project preparation, construction and operation period, affected residents and other potential affected people in the surrounding communities, including the public concerned about the demonstration project activities related to the project complaints, complaints receipt, registration, processing and tracking feedback mechanism. The labor grievance mechanism is mainly aimed at receiving, registering, handling and tracking and feedback of complaints that may be raised by project workers, including direct workers, contract workers and contractor employees, during the construction and operation period of the project, including labor injuries, termination of labor relations, economic compensation, unpaid wages and other issues. 5.4.1. Community Grievance Mechanism In view of the potential environmental and social risks and impacts during the implementation and operation of the demonstration project, Yuguang Zinc Industry has established a relatively complete community grievance mechanism to solve the issues of timely receiving, processing, giving feedback to the affected people, recording and archiving of the complaints, which is mainly divided into four stages:  Stage 1: if the affected people in the project area are dissatisfied with the implementation of the project, they can make oral or written appeals to the village committee or Yuguang Zinc Industry; If it is an oral complaint, it should be handled by the village committee or Yuguang Zinc Industry and recorded in writing. The village committee or Yuguang Zinc Industry should organize relevant personnel to check and solve the problem on site within 2 weeks, and feedback the handling opinions to the village committee. Selenium and Mercury Recovery System Green Upgrade Project  Phase 2: If the affected people in the project area are still not satisfied with the treatment decision of Phase 1, they can raise a complaint to the sub- district/township and relevant institutions (the Letters and Visits Bureau) after receiving the decision, and the management organization should make a response within 2 weeks.  Phase 3: If the affected people in the project area are still not satisfied with the decision in Phase 2, after receiving the decision, they may appeal to the administrative authority with jurisdiction level by level for arbitration according to the Administrative Procedure Law of the People's Republic of China.  Stage 4: If they are still not satisfied with the decision, they may, upon receiving the decision, bring a suit in the Civil Court under the Civil Procedure Law. Labor Grievance Mechanism In case of labor and personnel disputes within Yuguang Zinc Industry, employees of the company may appeal through the internal grievance mechanism of the company. If the complaint is not reasonably resolved, the project workers have the right to appeal to the arbitration procedure or judicial system. Project workers can also appeal directly to arbitration proceedings or the judicial system. For any cases related to women’s rights and interests or SEA/SH cases, employee can approach to the Women’s Federation for help to defense their rights. The internal grievance process is as follows: • First: Employees can submit their opinions and complaints to their superiors, party branches, labor union leaders, discipline inspection commission or general manager in written or oral ways, to reflect their opinions and complaints level by level, and the company's human resources department will keep relevant records. • Second: Employees can also lodge complaints or complaints through the mailbox of the general manager of the enterprise or the complaint mailbox of the discipline inspection commission. The human resources department of the enterprise will collect opinions monthly and submit them to the corresponding management level for investigation and solution. For any cases related to women’s rights and interests or SEA/SH cases, employee can raise their complaints to the women’s organization under the labor union. • Third: Employees can put forward their feedback through the staff proposal collecting activity organized in April every year or the staff congress twice a year, which will be fed back by the trade union to the corresponding department for negotiation and settlement. 5.4.3. Grievance Record and Reporting System Yuguang Zinc Industry will disclose the project complaint handling mechanism on the company's website. After receiving a complaint, it will be recorded in the complaint log or bulletin by the enterprise environment and social specialist, and investigated and processed. The complaint log or brief should include: the date of receipt of the complaint, the name of the complainant, a brief description of the complaint, the action taken (including the remedy/resolution/result), and the date of the final resolution of 30 ESMP of the Demonstration Sub-Project - Henan Yuguang Zinc Industry Co., Ltd. In the enterprise labor grievance mechanism, complaints related to gender-based violence can be received through both real-name and anonymous means, in order to respect the complainant 's request for confidentiality. At the same time, the appeal recipient of the project enterprise should include both male and female staff. The record template of complaint processing and feedback is shown in Table 5-4. The environmental and social specialist of the project enterprise should regularly classify and analyze the complaint records or briefs, including complaints’ main sources, types, processing progress, processing results, evaluation and complainants’ experience summary.
